CASE NO. THE TENTATIVE MAP REQUEST FOR A ONE-LOT PARCEL ON CT 75-3, APPLICANT: DALE ELKINS WHEREAS, pursuant to the provisions of the Municipal Code, the Planning Commission did on May 27, 1975 hold a duly noticed public hearing to conside request by Dale El kins. WHEREAS, a verified application for a certain property, to wit: Lot 357, La Costa South, Unit No. 5, Map No. 6600, Carlsbad, California has been filed with the City of Carlsbad and referred to the Planning Commis ion; and WHEREAS, said verified application constitutes a request as provided bJ the "Carl sbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Facility Policy of City of Carlsbad and has provided the necessary information which insures Public Facilities will be available concurrent with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protection Ordinance of 1972" because tl project is small in scal e and is in an a1 ready devel oped area; and WHEREAS, the proposed map meets or performs the requirements or condit, of the "Carlsbad Municipal Code" or the Subdivision Map Act; and WHEREAS, at said hearing a staff report was presented and all persons desiring to speak on the subject request were heard. At the conclusion of said hearing, after considering all the evidence presented, the Planning Commission made certain findings and reached a decision on the request as h inafter set forth. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City Carlsbad as follows: A) That the above recitations are true and correct. B) That the Planning Commission makes the following findings of fact 1) That the proposed map is consistent with the General Plan because: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 C) 0 e a) The development is within the density requirements of tl General P1 an. 2) That the proposed map is consistent with appl icable Specific Plans because: a) It meets the requirements of the La Costa Master Plan. 3.) That the site is physically suitable for the type of developr because: a) Grading has been completed. b) No topographic or geologic hazards are present. 4) That the design of the subdivision or the proposed improvemel will not cause substantial environmental damage or substanti, injure fish or wildlife or their habitat because: a) Natural habitat has been removed. That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to app Case No. CT 75-3, subject to the following conditions: 1) The Final Map shall be submitted for approval within eightee months from the final action by the City Council on the Tent tive Subdivision Map. The Final Map shall be in substantial conformance of the Tentative Subdivision Map known as Exhibi dated 4/3/75. This Exhibit A is for the lot only, not appro of location of buildings. 2) The development of the property described herein shall be su ject to the restrictions and limitations set forth herein wh are in addition to all requirements, limitations and restric ions of all municipal ordinances and State and Federal statu now in force, or which, hereafter, may be in force for the p pose of preserving the residential characteristics of adjace properties. 3) A1 1 pub1 ic improvements shall be made in conformity to the C of Carlsbad Engineering Design Criteria and Standard Plans, Subdivision Ordinance and other City standards, to the satis faction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improveme plans for water and sewer systems shall meet the requirement of the respective service districts. 4) All land and/or easements required by this Ordinance shall t granted to the City of Carlsbad without cost to the City anc free of all liens and encumbrances.
