PLANNING COMMISSION RESOLUTION NO. 1157
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF
CARLSBAD, CALIFORNIA, CONCERNING THE CONDITIONAL USE PERMIT TO ALLOW THE UTILIZATION OF A PORTION OF THE PLAZA CAMINO REAL PARKING LOT FOR THE ANNUAL BOY'S CLUB CARNIVAL FOR A PERIOD OF NOT MORE THAN SIX DAYS WITHIN THE NONTH OF JUNE FOR THE YEAR 1975 AND THE
APPLICANT: LOUIS A. SCIARRA NEXT THREE YEARS FOLLOWING. CASE NO. CUP-708,
WHEREAS, a verified application for a certain property, to wit:
Portions of Section 32, Township 11 South, Range 4 West, San Bernardino Meridian, and Lots 40, 41 , 42 and portions of Lots 39 and 13 through 17 inclusive of Eucalyptus Forest Company's Tract Map 1136 in the City of Carlsbad , County of San Di ego;
has been filed with the City of Carlsbad and referred to the Planning
Commission; and
WHEREAS, said verified application constitutes a request as provided
Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, the public hearing was held at the time and in the place
specified in said notice on May 27, 1975; and
WHEREAS, the applicant has complied with the Public Facility Policy c
the City of Carlsbad and has provided the necessary information which ins1
Public Facilities will be available concurrent with need; and
WHEREAS, the subject application has complied with the requirements (
the City of Carlsbad "Environmental Protection Ordinance of 1972"; becausf
Carnival is categorically exempt (Title 19, Sec. 19.04.090); and
WHEREAS, at said public hearing, upon hearing and considering the
testimony and arguments, if any, of all persons who desired to be heard, I
Commission considered all factors relating to the Conditional Use Permit i
found the following facts and reasons to exist:
1. The use does not conflict with the various Elements and objecti, of the General Plan.
2. The use is not detrimental to existing uses in the area.
3. The site for the intended use is adequate in size and shape to accommodate the use.
4. The supporting street system is adequate to handle traffic gene by the use.

5. The compatibility of the proposed carnival to the adjacent commert development and the isolation of the site from any residential development makes the area suitable for such activity. 31

4 NOW, THEREFORE, BE IT RESOLVED, by the Planning Commission of the City
5 Carlsbad as follows:
A) That the above recitations are true and correct.

B) That a Conditional Use Permit is approved to allow the utilizatio' a portion of the Plaza Camino Real Parking Lot for the Annual Boy
Club Carnival for a period of not more than six days within the m of June for the year 1975 and the next three years following, and subject to the following conditions:
1 ) The Conditional Use Permit is granted for the land as described i the application and on Plot Plan, Exhibit A.
2) All requirements of any law, ordinance or regulation of the State California, City of Carlsbad and any other governmental entity sh be complied with.
3) No signs or advertising of any type whatsoever shall be erected c installed until plans for such have been approved by the City of Carl sbad .
4) All operations authorized by this Conditional Use Permit shall bc restricted to those hours listed herein: 9:00 A.M. to 17:OO P.M. dai ly .
5) This Conditional Use Permit is granted to the Boy's Club Only, a1 is not assignable to others.
6) The Conditional Use Permit is granted for a period of not more t' six consecutive days within the month of June for this year and next three years.
7) All 1 iabili ty for carnival operations will be assumed by the app cant to the satisfaction of the City Attorney.
