HomeMy WebLinkAbout1975-06-11; Planning Commission; Resolution 1159t .b I 0 0 1 I1 PLANNING COMMISSION RESOLUTION NO. 1159 2 3 4' 5 61 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE SPECIFIC PLAN AMENDMENT TO ALLOW CONSTRUCTION OF 300 DWELLING UNITS ON A 61-ACRE SITE LOCATED AT THE SOUTHEAST CORNER OF POINSETTIA LANE AND 1-5, ZONED P-C, THE AMENDMENT BEING REDUCTION OF LAKE AREA, REDESIGN OF BUILDING EXTERIORS, INCLUSION OF SEVERAL JACUZZI AREAS AND PROVISION OF ADDITIONAL GUEST PARKING. CASE NO. SP-l22(A) , APPLICANT: COVINGTON BROTHERS 7 II 8 WHEREAS, a verified application for a certain property, to wit: 9 A portion of the southeast quarter of Section 38, Township 12 South, Range 4 West, San Bernardino Base and Meridian in the Carl sbad City Planning Department; 10 City of Carlsbad, and further described in the files of the 11 12 Title 21 of the "Carlsbad Municipal Code"; and 15 WHEREAS, said verified application constitutes a request as provided I: 14 Commission; and 13 has been filed with the City of Carlsbad and referred to the Planning Public Facilities will be available and current with need; and 20 the City of Carlsbad and has provided the necessary information which insu! 19 WHEREAS, the applicant has complied with the Public Facility Policy 0- 18 specified in said notice on June 17, 1975; and 17 WHEREAS, the public hearing was held at the time and in the place 16 21 WHEREAS, the subject application has complied with the requirements 0' 22 25 Master Plan was certified in 1973, and a supplement to that Environmental 24 prior compliance. The project meets the requirements of the General Plan Land Use and Housing Elements for density and clustering of units; 2. The project meets the City's Public Facilities Policy; 3. B) That a Specific Plan Amendment is approved to a1 low construction 300 dwelling units on a 61-acre site located at the southeast co of Poinsettia Lane and 1-5, zoned P-C, the amendment being reduc of lake area, redesign of building exteriors, inclusion of sever jacuzzi areas and provision of additional guest parking, and is subject to the following conditions: 1) The approval of the Specific Plan is granted for land as described in the application and any attachments thereto an shown on the plot plan labeled Exhibit A, dated 4/23/75 and elevations labeled Exhibit 9, dated 4/23/75. The location all buildings, fences, signs, roadways, parking areas, land scaping and other facilities or features shall be substant; as shown on these exhibits, except or unless indicated otht wise herein. 2) Unless the construction of the structure or facility is commenced not later than two years after the date the apprc is granted and is diligently pursued thereafter, this apprc is diligently pursued thereafter, this approval will automi cally become null and void. 3) All requirements of any law, ordinance or regulation of thc State of California, City of Carlsbad, and any other goverl mental entity shall be complied with. 4) A detai 1 ed landscape and sprinkler plan prepared by a land: architect, shall be submitted to the Parks and Recreation Director for consideration and approval. 5) All utilities, including electrical, telephone and cable ti vision, shall be installed underground and/or shall be com pletely concealed from view. 6) A1 1 driveways shall have width and turning radii which are satisfactory to the City Engineer. 7) Upon completion of grading, all slopes shall be planted wi erosion control vegetation in a manner acceptable to the C Engineer and Parks and Recreation Director. 8) The applicant shall construct noise mitigating measures a1 the entire western perimeter of the project site prior to occupancy of any units abutting the freeway. This shall t accompl i shed in a manner acceptable to the Planning and BL ing Directors. 9) The applicant shall dedicate a 15-ft. sanitary sewer easen along the westerly boundary of the parcel from the southwc erly corner to the vicinity of Lot 148 or as approved by 1 City Engineer.
