HomeMy WebLinkAbout1975-06-25; Planning Commission; Resolution 1167w- 0 0 3. il PLANNING COMMISSION RESOLUTION NO. 1167 2 3 4 5 61 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE APPROVAL COUNCIL ORDINANCE NO. 9392, EXTENDING THE TIME LIMIT TO 'EIGHTEEN MONTHS ON PROPERTY LOCATED ON ELM AVENUE BETWEEN HIGHLAND DRIVE AND PI0 PICO. OF AN AMENDMENT TO A SPECIFIC PLAN (SP-142), CITY APPLICANT: DAVID ELLSWORTH (CARLSBAD PROFESSIONAL & FINANCIAL CENTER I 7 I/ WHEREAS, a verified application for a certain property, to wit: 8 9 10 11 Portions of Tract 119 of Carlsbad Lands in the City of Carlsbad, County of San Diego, State of California, according to map there- of No. 1661, filed in the Office of the County Recorder of San Diego County, March 1 , I91 5. has been filed with the City of Carlsbad and referred to the Planning 12 13 Commission; and Public Facilities will be available concurrent with need; and 19 the City of Carlsbad and has provided the necessary information which insurt 18 WHEREAS, the applicant has complied with the Public Facility Policy of 17 specified in said notice on June 25, 1975; and 16 WHEREAS, the public hearing was held at the time and in the place 15 Title 21 of the "Carlsbad Municipal Code"; and 14 WHEREAS, said verified application constitutes a request as provided bj 20 WHEREAS, the applicant has complied with the requirements of the City 21 following facts and reasons to exist: 29 Commission considered all factors relating to the Specific Plan and found th 28 testimony and arguments, if any, of all persons who desired to be heard, sai 27 WHEREAS, at said public hearing, upon hearing and considering the 26 mental Quality Act; and 25 requirements of the Ordinance and the requirements of the California Enviror 24 for reason of prior compliance finds that the subject application fulfills t 23 has determined the subject application will have a non-significant effect ar 22 of Carlsbad "Environmental Protection Ordinance of 1972". The Planning Dire 30 31 32 (1) The proposed Specific Plan is consistent with the City of Carlsbad General Plan in that: a) The proposed Specific Plan Amendment implements the professio and related Commercial Land Use designation as identified on the Land Use Element. .. 7 II a e 1 2 3 4 5 b) The proposed Professional and Financial Center allows for development which is compatible with governmental offices and surrounding residential Land Use as provided by the Land Use Element of the General Plan. The Planning Commission may extend, by minute motion, the proposed Specific Plan on recommendation of the staff for a period of one year, not to exceed two such extentil Conditions 2 through 14, as contained in Section 3 of Ordinance 93 shall be met.
