HomeMy WebLinkAbout1975-07-09; Planning Commission; Resolution 11680 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 PLANNING COMMISSION RESOLUTION NO. 1168 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE AMENDMENT TO A SPECIFIC PLAN ALLOWING DEVELOPMENT OF 501 LOTS ON 85.5 ACRES LOCATED ON THE EAST SIDE OF EL CAMINO REAL BETWEEN ELM AVENUE AND MARRON ROAD. CASE NO. SP-l04(A), APPLICANT: LARWIN-SAN DIEGO, INC. WHEREAS, a verified application for a certain property, to wit: A portion of Lot "J" in Rancho Agua Hedionda in the County of San Diego, according to partition map thereof No. 823 filed with the San Diego County Recorder November 16, 1886, and further described in the files of the Carlsbad City Planning Department; has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request as provided t Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on July 9, 1975; and WHEREAS, the applicant has complied with the Public Facility Policy 0- the City of Carlsbad and has provided the necessary information which insul Public Facilities will be available concurrent with need; and WHEREAS, the subject application has complied with the requirements 0' the City of Carlsbad "Environmental Protection Ordinance of 1972", in that City Council has certified an EIR for the Master Plan of the proposed proj in which the environmental impacts of said project were described and miti1 ing measures identified; and in that there are no changes in said project the Master Plan nor changes in the environmental setting of the project; a WHEREAS, at said public hearing, upon hearing and considering the testimony and arguments , if any, of a1 1 persons who desired to be heard, 5 Commission considered all factors relating to the Specific Plan and found following facts and reasons to exist: 1 ) The proposed Specific P1 an is consistent with the General P1 an because: a) The Land Use and Density conform to General Plan designatic b) Provisions for open space and retention of the natural lanc cape are provided for. e 0 1 2 3 4 5 6 7 8 9 10 i 11 ~ 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ~ ~ c) A major road has been provided in conformance with the Circu' ti on El ement . NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City 1 Carl sbad as follows: A) That the above recitations are true and correct. 6) That a Specific Plan is approved to allow development of 501 lots on 85.5 .acres located on the east side of El Camino Real between Avenue and Marron Road, zoned P-C, and subject to the following conditions: ~ 1) Ordinance No. 9324, adopting a Specific Plan on property lyi easterly of El Camino Real and southerly of Marron Road exte ion is hereby revoked. 2) The development of the property shall be subject to the rest ions and limitations set forth herein, which are in additior all requirements, 1 imitations and restrictions of all munici ordinances and State and Federal statutes. 3) A1 1 public improvements shall be made in conformity with thc subdivision ordinance and other City standards to the satisl ion of the City Engineer, without cost to the City of Carlst and free of all liens and encumbrances. 4) A1 1 land and/or easements required by this Ordinance shall 1 granted to the City of Carlsbad without cost to the City an( free of all liens and encumbrances. 5) Elm Avenue shall be dedicated and improved as follows: a) The Elm Avenue Right of Way as shown within the bounda of Exhibit B, dated July 9, 1975, shall be dedicated t the City of Carlsbad upon the recordation of the final subdivfsion map for the second phase of the developmen b) Elm Avenue shall be improved so as to provide for a 42 half street section where the Elm Avenue alignment is partly within the boundaries of SP-l04(A). Elm Avenue shall be improved so as to provide for the 84-ft. street section where the Elm Avenue alignment i completely within the boundaries of SP-l04(A). The pu improvements shall include a separate bicycle path on northerly side in place of the required sidewalk. 6) A realigned perpendicular intersection shall be constructec' Appian Way and Elm Avenue. Appian Way shall be dedicated E improved based on a 60 ft. full width within the tentative boundary and improved based on a 28 ft. minimum street secl south of the tentative map boundary to a point where it cor forms with the existing alignment and grade of Appian Way. proposed realignment and improvement shall be subject to tf approval of the City Engineer. 7) The applicant or his sucessor in interest shall provide fol adequate ingress and egress on properties fronting on Appii Way where said ingress and egress is eliminated due to the realignment of Appian Way with Elm Avenue. - 2- 0 e 1 2 3 4‘ 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 I i 8) 9) 10) 11 1 12) 13) 14) ’15) 16) 17) 18) The developer or his successor in interest shall enter into separate secured agreement guaranteeing payment of 1/4 of th future traffic signals which will be required at the inter- section of Elm Avenue and El Camino Real. The agreement sha include 700% of the future traffic signal at Marron Road and Avenida de Anita. The developer shall be reimbursed to the extent authorized by law, by the developers to the north of Marron Road for their proportional share of the Marron Road signal. Alleys shall be a minimum of 28 ft. in width, and there shal no physical encroachments upon or over them, including but nl limited to mail boxes or tuility guard rails. The garages shall set back at least 4 ft. from the outside e of the alleys. Planter boxes, with a minimum dimension of 4 shall be provided for each garage and landscaping and irriga shall be provided to the satisfaction of the Planning Direct The offer of dedication of all alleys with the development s be rejected. i The developer shall provide hamerhead turnarounds as approv by the City Engineer and Fire Chief at ends of alleys. The applicant or his successor in interest shall cause the circulation system within the development to be posted “NO Parking”. The applicant or his successor in interest shall request the City of Carlsbad to assist in the enforcement of parking and traffic control ordinances as provided for in thl appropriate sections of the California State Motor Vehicle CI Separate screened, accessible facilities for trailers, boats and campers shall be provided within the second phase of the subject development and shall be paved and landscaped in a manner approved by the Planning Director. A total of three parking spaces per dwelling unit shall be provided. Two of these parking spaces shall be in private garages, and at least 25% of the remaining required spaces shall be provided as off-street guest parking. An application for an amendment to the Tiburon Master Develol ment Plan (MP-5) shall be submitted to the City for approval prior to the issuance of building permits in subsequent phasc The Master Plan Amendment shall include the Avedian Parcel 1 acres), shown as Parcel A on Exhi bit B, dated July 9, 1975, i shall be designated as Park/Open Space. The density seven dwelling units/acre may be transferred to the area designate( Area B Garden Apartments on MP-5, shown as Exhibit Cy dated June 19, 1975. That parcel known as the Avedian property, shown as Parcel A Exhibit By dated July 9, 1975, shall be dedicated as an open space/recreation area upon the recordation of the final sub- division map for the second phase of the development. Irrigation and landscaping shall be ( to the satisfaction of the City Engineer and Parks and Recreation Director. The exteriors of all private buildings, open spaces, and rec tion facilities shall be maintained by an established home- owners association. Privately owned manufactured and planted slopes and privatel, owned Open Spaces shall be maintained by the applicant until such time as maintenance is performed by an established Home Owner's Association. The sidewalks normally placed adjacent to the curb on dedica streets shall be constructed in a meandering fashion and mad part of the pedestrian traffic system for the project. Portland cement concrete garage slabs shall be extended to t alley right of way line. All weather access shall be provided to all manholes and cle outs. Any water, sewer or storm drain lines installed in sl shall be placed normal to the slope. All streets shall be named in accordance with the City stree naming pol icy. Structures adjacent to El Camino Real wi 11 have red ti 1 e man roofs in keeping with the Spanish trail concept of El Camino Real. The conditions, covenants and restrictions and provisions fc maintenance of the community spaces shall be approved by the City Attorney prior to approval of any final subdivision map Construction of the model structures and related swimming PC recreation buildings, and other structures as indicated on t model site detail will be permitted upon approval of this Specific Plan by the City Council. Said structures are not be utilized for other than sales purposes until a final sub- division map has been filed for the units involved. All hydrants and additional fire appurtenances shall be insi ed as required by the Fire Department. Street improvements. as required by Ordinance shall be constu ed in accordance with City standards, subject to the approvz of the City Engineer, on all streets within the development on Elm Avenue and Marron Road as in the required adopted Ma: Plan for the subject property (MP-5, Ordinance 9315). The underground drainage, water and sewerage systems are no1 shown and are subject to modification and approval by the C. Engineer as part of final map improvement plans. Sidewalks shall be provided to connect each dwelling unit tc major points of pedestrian attraction. Materials to be use( shall be subject to approval of the staff. The applicant's design for patio covers, as shown in Exhibi. dated June 19, 1975 shall be the only types of patio covers permi tted. - 4- ." s 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 0 0 34) Street trees and 10 ft. street-tree maintenance easements sha be required for Elm Avenue and Marron Road. 35) The Building Department shall not approve any building for occupancy until the Planning Director has certified that all conditions of this ordinance have been satisfied. 36) Prior to the issuance of any building permits 9 the applicant his successor in interest and the City of Carlsbad shall ensu that proper grading and drainage has been provided.
