RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, APPROV ING A VARIANCE FROM SECTION 21 .lO.OSO(i) WHICH REQUIRES 60 FEET OF STREET FRONTAGE FOR
AT 1200 CHINQUAPIN, CARLSBAD, CALIFORNIA

WHEREAS, a verified application for a certain property, to wit:

considered all factors relating to the Variance and found the following facts 24
and arguments, if any, of all persons who desired to be heard, said Commissio

1) There are special circumstances applicable to the subject propertJ which are not shared by other similarly zoned property in the area as fol 1 ows :
a) The parcel has a shape other than the conventionally shaped 1 in the area in that the parcel is narrower in the street fro age to the point it does not provide adequate frontage for a1 four lots proposed as part of the parcel map.
b) The subject parcel is larger than other parcels in the area conventionally developed with single family residences.

2) Because of said special circumstances, the property may not be utilized in the same manner as the other similarly zoned property the area because:
a) The property is relatively large in size yet has narrow stree frontage, therefore, it cannot under standard ordinance, be developed to its density potential.
b) Other properties in the area have either sufficient street frontage, lot size, or both, to be developed to their full potential.
3) The Variance will not be materially detrimental to the public welf or injurious to the property or improvements in such vicinity and zone on which the subject property is located because:
a) The parcel will be developed with single family residences on larger than average lots compatible with the neighborhood.
4) The Variance is consistent with the General Plan in that:
a) The resulting development wi 11 minimize "sprawling" trends as mentioned in the Housing Element by intensifying development already committed areas.
b) The development will allow for design flexibility for urban expansion as mentioned in the Housing Element by providing ot than standard lots.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City c
Carlsbad as follows:
A) That the above recitations are true and correct.
B) That a Variance from Section 21.10.080(i) requiring 60 feet of str frontage for every lot in the R-1-7500 Zone District be approved ( property located at 1200 Chinquapin, Carlsbad, California, and is subject to the following conditions:
1) The approval is granted for the land described in the applicz and any attachments thereto, and as shown on the plot plan submitted labeled Exhibit A, dated 3-25-75.
2) All utilities, including electrical, telephone and cable telt vision, shall be installed underground and/or shall be complf ly concealed from view.
3) There shall be no ingress or egress to the property except fc those driveways shown on the revised plat map.
4) All existing mature trees on the property shall be retained 1 the satisfaction of the Parks and Recreation Director.
5) The Variance shall become null and void if a final parcel mal is not recorded for the subject property within 18 months of this approval.
6) Concentrated storm drainage on all proposed lots shall be directed to Chinquapin Avenue.

7) A parcel map shall be required and any required frontage improvements shall be assured prior to parcel map approval.
PASSED, APPROVED AND ADOPTED at a regular meeting of the City of
