HomeMy WebLinkAbout1975-07-23; Planning Commission; Resolution 1176r - 0 1 2 3 4 5 f3 il PLANNING COMMISSION RESOLUTION NO. 1176 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF THE TENTATIVE MAP REQUEST FOR A ONE LOT SUBDIVISION ON PROPERTY GENERALLY LOCATED IN LA COSTA SOUTH. APPLICANT: DENIS HOBSON CASE NO. CT 75-5 WHEREAS, pursuant to the provisions of the Municipal Code, the Plannin 7 consider a request by Denis Hobson of Denbar Construction; and 8 Commission did on July 23, 1975 hold a duly noticed public hearing to 9 Lot 405, La Costa South, Unit No. 5, Map 6600, City of Carlsbad 10 WHEREAS, a verified application for a certain property, to wft: 11 14 WHEREAS, said verified application constitutes a request as provided b 13 Commission; and 12 has been filed with the City of Carlsbad and referred to the Planning 32 Carlsbad as follows: 31 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City 30 hereinafter set forth. 29 Commission made certain findings and reached a decision on the request as 28 said hearing, after considering all the evidence presented, the Planning 27 desiring to speak on the subject request were heard. B) That the Planning Commission makes the following findings of fact 1 ) That the proposed map is consistent with the General Plan because: a) The project conforms to the General Plan density range. b) The project conforms to the General Plan policies and is in an area planned and prepared for development. 2) The site is physically suitable for the type of development because: a) The subject property has been graded to accomodate b) Street improvements are in, including streets, curbs, development. gutters, sidewalks, lighting and trees. C) That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to approve Case No. CT-75-5 subject to the following conditions: 1) The final map shall be submitted for approval within 18 mont from the final action by the City Council on the Tentative Subdivision Map. The Final Map shall be in substantial con- formance with the Tentative Subdivision Map known as Exhibit dated 6-9-75. 2) The development of the property described herein shall be subject to the restrictions and limitations set forth herein which are in addition to all the requirements, limitations ai restrictions of all municipal ordinance and State and Federa' statutes now in force, or which, hereafter, may be in force . the purpose of preserving the residential characteristics of adjacent properties. 3) A1 1 publ ic improvements shall be made in conformity to the C of Carlsbad Engineering Design Criteria and Standard Plans, the Subdivision Ordinance and other City Standards, to the satisfaction of the City Engineer, without cost to the City of Carlsbad, and free of all liens and encumbrances. Improv ment plans for water and sewer systems shall meet the requir ments of the respective service districts. 4) All land and/or easements required by this Ordinance shall bf granted to the City of Carlsbad without cost to the City and free of all 1 fens and encumbrances. No easements shall be recorded prior to approval of the Final Map unless approved I the City Engineer. 5) All slopes created as a result of this development shall not exceed a 2:l slope. 6) Ingress and egress along the property 1 ine bordering publ ic street right of way for all lots shall be dedicated, except at location as specified by the City Engineer. Dedication 5 be made prior to approval of Final Map. 7) If requested by the City Engineer, an amended Tentative Map 5 be submitted for approval by the City Engineer prior to prep: tion of the Final Map to assure compliance to all conditions approval. City Council approval of the Final Map. It shall be the responsibility of the applicant to make all arrangements wit1 the Parks Department concerning the requirements of this condition. 11 ) A bikeway along La Costa Avenue shall be provided for to the satisfaction of the City Engineer.
