HomeMy WebLinkAbout1975-09-10; Planning Commission; Resolution 1184I! 0 e 1 /I PLANNING COMMISSION RESOLUTION NO. 1184 2 3 4 5 6 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA CONCERNING THE SPECIFIC PLAN AMENDMENT TO EXTEND THE ADOPTED TIME LIMIT FOR COMMENCEMENT OF CONSTRUCTION AND TO AMEND THE PHASING OF THE PROJECT ON PROPERTY LOCATED ON THE NORTHERLY SIDE OF OLIVENHAIN ROAD BETWEEN EL CAMINO REAL AND RANCHO SANTA FE ROAD. APPLICANT: PONDEROSA HOMES CASE NO.: SP-131A 7 11 8 I/ WHEREAS, a verified application for a certain property, to wit: 9 10 11 12 That portion of Lot 11 of Rancho Las Encinitas, according to Map No. 848 thereof filed in the Office of the County Recorder of the County of San Diego, State of California, June 27, 1898; and further described in the files of the Planning Department; has been filed with the City of Carl sbad and referred to the Planning Cor 13 WHEREAS, said verified application constitutes a request as provide( 14 and Public Facilities will be available and current with need; and 20 the City of Carlsbad and has provided the necessary information which in: 19 WHEREAS, the applicant has complied with the Public Facility Policy 18 in said notice on September 10, 1975; and 17 WHEREAS, the public hearing was held at the time and in the place SI 16 Title 21 of the "Carlsbad Municipal Code"; and 15 21 WHEREAS, the subject application has complied with the requirements 22 project; and 27 and no additional significant environmental effects are involved with th 26 approved as presented in connection with previous entitlements for this 25 public hearing held by the Planning Commission and the City Council and ' 24 Environmental Impace Report was presented and discussed at a duly noticel 23 the City of Carlsbad "Environmental Protection Ordinance of 1972", and a' WHEREAS, at said public hearing, upon hearing and considering the t 28 I! 0 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 1'7 18 19 20 21 22 23 24 25 26 27 28 and arguments , if any, of a1 1 persons who desired to be heard, said Commi: considered all factors relating to.the Specific Plan Amendment and found following facts and reasons to exist: (1) The Revised Specific Plan conforms with approved Master Plan No. 105. (2) The revised Specific Plan conforms with all requirements of the Municipal Ordinance for property located in the Planned Communi Zoned District. (3) The precise development conforms with existing and proposed development in the area. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cil Carl sbad as foll ows: A) That the above recitations are true and correct. B) That a Specific Plan Amendment is approved to extend the adoptc time limit for commencement of construction and to amend the phasing of the project on property located on the northerly sic 01 ivenhain Road between El Camino Real and Rancho Santa Fe Roac and is subject to the following conditions: 1) Ordinance No. 9398, adopting a Specific Plan (SP-131) for a 420 unit residential development shall be revoked. 2) The approval of this Specific Plan is granted for the lan described in the application and any attachments thereto shown on the Plot Plan submitted, labeled Exhibit A. The location of a71 buildings, fences, signs, roadways, parki landscaping, and other facilities or features shall be lo substantially as shown on the plot plan, labeled Exhibit dated August 1, 1975, except or unless indicated otherwis 3) Compliance with and execution of all conditions listed he shall be necessary, unless otherwise specified, prior to ing final building inspection clearance. Deviation from requirement will be permitted only by written consent of Planning Director. 4) Prior to final building inspection clearance for each phi landscaping and recreation facil ities included in the 1; scape and sprinkler plans described in Condition 8 shall installed. Said Home owner's Association shall maintain all landscaping and rec facilities installed in conformance with Condition 4, comn 12 months following installation of said landscaping and r tion facilities. Said landscaping shall be maintained in a manner that erosion and fire hazards are mitigated. 6) Prior to any construction the applicant shall submit plans to the appropriate entity providing domestic water to the proposed development for its approval of location, type ar adequacy of water 1 ines and to the City of Carlsbad Fire Department for approval of location of fire hydrants. 7) CC&R's for this development shall be submitted to the Plat Director for review and approval prior to the final builc inspection clearance for any phase. 8) A detailed 1 andscape and irrigation plan for all phases 0' project, prepared by a landscape architect, shall be subm, to the Parks and Recreation Director and the City Engineel consideration and approval prior to approval of any build, permit for any phase of the project. This requirement shi apply to all private park areas, open space areas, proposl meandering sidewal ks and proposed entrance medians.
