APPLICANT: LA COSTA LAND CO. 75 FEET OF STREET FRONTAGE FOR EVERY LOT IN THE R-1-10,000 CASE NO.: V-252 6 /I 7 II WHEREAS, a verified application for a certain property, to wit: 8 9 10 11 12 All of Carlsbad Tract No. 72-25 (A1 icante Hills) according to Map thereof No. 7784 on file in the Office of the County Recorder of San Diego County and a portion of the South Half of Section 25, Township 12 South, Range 4 West, San Bernardino Meridian according to the official plat thereof in the City of Carl sbad, County of San Diego, State of California has been filed with the City of Carlsbad and referred to the Planning Corn 13 WHEREAS, said verified application constitutes a request as provided 14 and Facilities will be available and current with need; and 20 City of Carlsbad and has provided the necessary information which insures 19 WHEREAS, the applicant has complied with the Public Facility Policy c 18 in said notice on September 10, 1975; and 1'7 WHEREAS, the public hearing was held at the time and in the place spe 16 Title 21 of the "Carlsbad Municipal Codell' and 15 21 WHEREAS, the subject application has complied with the requirements c 22 and reasons to exist: 26 considered all factors relating to the Variance and found the following f' 25 and arguments, if any, of all persons who desired to be heard, said Commi 24 WHEREAS, at said public hearing, upon hearing and considering the te: 23 City of Carlsbad "Environmental Protection Ordinance of 1972"; and 27 28 (1 ) There are exceptional conditions present to the project site no present in the same vicinity and zone because: 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ir m 0 a) The size of the project site is sufficient for the number o proposed, but the shape and topography of the site does not full street access to all lots, (2) The Variance is necessary for the preservation and enjoyment of substantial property right possessed by other property in the sa vicinity and zone, but which is denied to the property in questi because: a) The property in the same vicinity and zone has enjoyed deve ment at the density proposed for the subject property. (3) The granting of the Variance will not be materially detrimental the publjc welfare or injurious to the property and improvements the vicinity and zone in which the project is located because: a) The lots so created are relatively large and therefore will permit the mitigation of the problems associated with lots substandard frontage. (4) The granting of the Variance will not adversely affect the comprehensive General Plan because: a) The overall project of which the Variance is a part is in conformance with the policies and intent of the General Pla NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City Carl sbad as follows: A) That the above recitations are true and correct. B) That a Variance from Section 21.10.080 requirfng 75 feet of stre frontage. for every lot in the R-1-10,000 Zone District be approv property located on the North and South side .of Alfil Way betwee Altisma Way and San Marcos Canyon, and is subject to the followi condi ti ons : 1) The approval is granted for the land described in the appl i and any attachments thereto, and is shown on the Plot Plan submitted labeled Exhibit A, dated August 5, 1975, except a: otherwise indicated herein. 2) This approval shall automatically become null and void upon expiration of CT 75-6. 3) The flag lots enabled by this approval shall have graded dr as approved by the City Engineer.
