HomeMy WebLinkAbout1975-09-10; Planning Commission; Resolution 11870 0 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 1187 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF THE TENTATIVE MAP REQUEST FOR 105 LOT SUBDIVISION ON PROPERTY GENERALLY LOCATED ON THE NORTH AND SOUTH SIDE OF ALFIL WAY BETWEEN ALTISMA NAY AND SAN MARCOS CANYON. CASE NO.: CT 75-6 APPLICANT: LA COSTA LAND CO. - ALICANTE HILLS 6!i 7 WHEREAS, pursuant to the provisions of the Municipal Code, the Planni 8 consider a request by La Costa Land Co.; and 9 Commission did on September 10, 1975, hold a duly noticed public hearing t 10 WHEREAS, a verified application for a certain property, to wit: 11 12 13 14 15 All of Carlsbad Tract No. 72-25 (Alicante Hills) according to map thereof No. 7784 on file in the Office of the County Recorder of San Diego County and a portion of the South Half of Section 25, Township 12 South, Range 4 West, San Bernardino Meridian according to the official plat thereof in the City of Carlsbad, County of San Diego, State of California; has been filed with the City of Carlsbad and referred to the Planning Commi 16 Public Facilities will be available and current with need; and 21 City of Carlsbad and has provided the necessary information which insures 20 1 WHEREAS the applicant has complied with the Pub1 ic Facility Policy of 19 the "Carlsbad Municipal Code"; and 18 WHEREAS, said verified application constitutes a request as provided t 17 and 22 WHEREAS, the subject application has complied with the requirements of 23 25 (1) The project is in conformance with the City's environmental goal: 24 the City of Carlsbad "Environmental Protection Ordinance of 1972" because: WHEREAS, the proposed map meets or performs the requirements or condi t 28 27 26 (2) The project is in an urbanized area with utilities installed and grading accomplished as a result of a previous entitlement; (3) Consequently the project will have no significant effect on the existing environment. 0 e 1 of the "Carlsbad Municipal Code": or the Subdivision Map Act; and 2 IdHEREAS,at said hearing a staff report was presented and a1 1 persons 3 inafter set forth. 6 Commission made certain findings and reached a decision on the request as 5 said hearing, after considering all the evidence presented, the Planning 4 desiring to speak on the subject request were heard. At the conclusion of 7 A) That the above recitations are true and correct. 9 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City 8 Carlsbad as follows: 10 B) That the Planning Commission makes the following findings of fac 11 12 13 1) The proposed subdivision is consistent with the General Pla because: a) The density of the proposed subdivision conforms with I policies and guide1 ines of the Land Use Element; and I 14 15 16 17 18 19 20 21 22 23 24 25 I 2) 3) b) The design of the proposed subdivision conforms with t policies and guidelines of other applicable Elements o General Pl an. The proposed subdivision is consistent with the Carlsbad Environmental Protection Ordinance of 1972 because: a) The proposed project has been found to have an insigni impact on the Environment. A negative declaration has filed by the Planning Director. The proposed subdivision is consistent with applicable City Facilities policies and ordinances because: a) Minimum public facilities exist on-site. b) The proposed subdivision has been approved by the affe school districts. C) That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to ap CT 75-6 subject to the following conditions: I 26 1) The final map shall be submitted for approval within 18 mon division Map. The final map shall be in substantial confor 27 from the final action by the City Council on the Tentative with the Tentative Subdivision Map known as Exhibit A, date 28 Au.gust 5-,"'1975. -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 2) The development of the property described herein shall be s to the restrictions and limitations set forth herein which addition to all the requirements, limitations and restricti all municipal ordinances and State and Federal statutes. 3) If requested by the City Engineer, an amended tentative map be submitted for approval by the City Engineer prior to pre tion of the Final Map to assure compliance with all conditi approval. 4) Final Subdivision Map 7784 shall be reverted to acreage pri Final Map approval. 5) In order to provide for reasonable fire protection during t construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrant with required fire flows shall be installed as recommended Fire Department. 6) All land and/or easements required shall be granted to the of Carlsbad without cost to the City and free of all 1 iens encumbrances. No easements shall be recorded prior to reco of the final map unless approved by the City Engineer. 7) The improvement and grading plans shall include a report of geological investigation and a complete grading plan of th entire site, when required by the City Engineer. The repor plan shall be prepared by a Civil Engineer licensed by the of Califonria, and experienced in erosion control , who shal acceptable to the City Engineer. He shall certify that he has investigated the site and prepared date with full consi of the consequences to the included and neighboring propert and in conformance with the Geologic anc Seismic Safety Ele of the General Plan. 8) All public improvements shall be made in conformity with th of Carlsbad Standards, the Subdivision Ordinance and other standards, to the satisfaction of the City Engineer without to the City of Carlsbad and free of all 1 iens and encumbran Improvement plans for water and sewer system shall meet the requirements of the respective service districts. 9) No development shall be allowed to occur within the 100 yea plain, the boundary of which shall be delineated on the fin and grading plans. 10) The design of all streets shall be approved by the City Eng and all street construction shall be inspected and approved by the Public Works inspector, and standard checking and inspection fees paid. 11 ) The proposed 1 ocation of the security fence, shown in Exhi b dated August 5, 1975, shall be resolved between the applica Planning Director and the Parks and Recreation Director. -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 0 12) Prior to final map approval the design of a1 1 proposed ser gates shall be submitted to the City Engineer and Fire Ch. for their approval. Any security gate located on Alfil Wi be recessed at least 60 feet from the extention of the SOI easterly right-of-way line of Alicante Road. A gate shal' retained at the easterly boundary of the subdivision at tl utilities and access easement extending from Alfil ,Way. 13) On-site fire hydrants and fire protection appurtenances SI constructed in accordance with the Fire Department requirc and shall provide fire flows of 1750 gallons per minute. 14) Improvement plans and grading plans shall provide, by des- by specification, that no earthwork or construction crow the easterly boundary of the subdivision or is installed ( deposited in the San Marcos Canyon Open Space. Said lots shall shown on the final subdivision map and shall be offered fc dedication to the City of Open Space purposes concurrent v final map recordation. 18) An open space easement over a portion of lot 99 as shown i Exhibit A, dated August 5, 1975, shall be granted to the C Pub1 ic in perpetuity concurrent wi th final map recordation addition, a twenty foot wide open space easement over lot extending from the end of the public road to the northern boundary of the subdivision adjacent the eastern boundary subdivision shall be granted to the City of Carlsbad in pe concurrent with Final Map recordation. 19) An open space easement over portions of lots 1, 100, 101 , 105, as shown in Exhibit A, dated August 5, 1975, shall be granted to the genera? public in perpetuity concurrent wit final map recordation. 20) Lots 103 and 104 as shown in Exhibit A, dated August 5, 15 shall be dedicated to the City of Carlsbad for Open Space concurrent with recordation of the Final Map. Prior to de tion of lot 104, the existing debris and grading deposits be removed from said lot or the unconsolidated fill compac to the satisfaction of the City Engineer. -4- 0 9 1 2 3 4 5 6 21) Park-in-1 ieu fees shall be granted to the City prior to C. Council approval of the Final Map. 22 1 CC&R's shall be required for CT-75-6. The CC&R's shall bc submitted to the City Attorney for review and approval pr' to approval of the final map. The CC&R's shall contain PI or the proper maintenance of private streets and/or roads maintenance of the open space portions of lots 1 and 105 I CT 75-6. The maintenance provision for streets and open : shall be the obligation of the applicant or a homeowner's association or their successors in interest. 7 23) All extensions of the existing ;public water and sewer sysl 8 9 10 required to provide water and sewer s'ervice to all lots ir subdivision shall be installed by the developer in accord: with the standards of the applicab7e service districts. 24) Street names shall be subject to approval of the Planning Director prior to Final Map approval. 11 12 13 14 15 16 17 18 25) All drainage and flood control facilities shall be approvt the County of San Diego Flood Control District prior to ir tion. 26) A detailed landscape and irrigation plan for a1 1 phases of project, prepared by a landscape architect, shall be submi to the Parks and Recreation Director and the City Engineer consideration and approval prior to approval of any buildi permit for any phase of the project. This requirement sha apply to all private park areas, open space areas, propose meandering sidewalks and proposed entrance medians. Said shall also include the detailed plans for the proposed rec facilities to be installed in the private park areas.
