RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE TENTATIVE
ON PROPERTY LOCATED AT THE SOUTHWEST CORNER OF PINE AVENUE AND WASHINGTON STREET ADJACENT TO THE AT&SF RAILROAD RIGHT OF !JAY.
APPLICANT: REGAN CONSTRUCTION
MAP TO ALLOW A ONE-LOT, 22 UNIT CONDOMINIUM PROJECT

WHEREAS, a verified application for a certain property, to wit:

1 ) An Environmental Impact Assessment of the project was completed ar a negative declaration issued for the following reasons:
a) The project is located in an existing urbanized area with all utilities installed.
22 b) The project entails minimal grading.

sistent with the General Plan because:

a) The land use and density of the project (21.7 dwellings per a conform to the Land Use Element designations (Residential Hi: Densitys, 20-30 dwell ings per acre).
b) Noise attenuation has been guaranteed through conditions of approval providing for further site review in accordance with Noise Element Action Program 2.3.

2 A) That the above recitations are true and correct.

B) That a tentative map to allow a one-lot, 22 unit condominium projc on property located at the southwest corner of Pine Avenue and Washington Street adjacent to the AT&SFRR right-of-way, be approvc and is subject to the following conditions:
1 ) The approval is granted for the land described in the appl ici and any attachments thereto, and as shown on the plot plan SL mitted labeled Exhibit A, dated August 25, 1975. The locatic of all buildings, fences, signs, roadways, parking areas, lan scaping and other facilities or features shall be located sub stantially as shown on the plot plan labeled Exhibit A, excep or unless indicated otherwise herein. All buildings and structures shall be of the design as shown on the elevation p labeled Exhibit A.
2) The Final Map shall be submitted for approval within 18 montt- from the final action by the City Council on the tentative subdivision map. The Final Map shall be in substantial conf mance with the Tentative Subdivision Map known as Exhibit A dated August 25, 1975.
3) In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants
with required fire flows shall be installed as recommended bJ the Fire Department.

4) Ornamental street lighting shall be provided for as required by Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an eighteen month period after construction, to permit the incor poration of the subdivision into a maintenance district.
5) A1 1 land and/or easements required shall be granted to the Ci of Carlsbad without cost to the City and free of all liens an encumbrances. No easements shall be recorded prior to record tion of the final map unless approved by the City Engineer.

6) Half street frontage improvements shall be installed in Pine Avenue, based on a 30 foot half street section. The sidewalk shall be installed as to minimize the removal of existing tre as approved by the City Engineer.
7) Washington Avenue shall be dedicated and improved on the basi of a 30 foot half street width along the property frontage. Dedication shall include a 20 foot radius property line retur at the intersection of Washington Avenue and Pine Street. Im provements shall include a complete cross gutter across Pine Street, designed to conform with future improvement of Pine S and Washington Avenue.
29 I/ 8) Park-in-lieu fees shall be granted to the City prior to City Council approval of the final map.

9) The CC&R's for this development shall be submitted to the Planning Director for review and approval prior to the approv of the Final Map.

10) No signs or advertising of any type whatsoever shall be erected or installed until plans therefore have been approved by the City of Carlsbad.

PASSED, APPROVED AND ADOPTED at a regularly scheduled meeting of the
City of Carlsbad Planning Commission held on October 15, 1975, by the follow
noise levels on the project site shall be made by an acoustical engineer experienced in noise attenuation. Said study shall determine if attenuation measures are necessary to bring noise le> within 65 db(A) outdoors and 45 db(A) indoors. Said study shall recommend such attenuation measures as deemed necessary, and shal be consistant with applicable provisions contained in the Noise Element of the General Plan and consistent with appropriate sectil
of the.Uniform Building Code.
