PLANNING COMMISSION RESOLUTION NO. 1200
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE CQNDITIONAL USE PERMIT TO ALLW A FIRE STATION TO BE CONSTRUCTED ON PROPERTY LOCATED ON THE SOUTHWEST CORNER OF THE INTERSECTION C!F EL CAWNO REAL AND CHESTNUT AVENUE.
APPLICANT: CITY INITIATED CASE NO.: CUP-112

WHEREAS, a verified application for a certain property, to wit:
El Camino Mesa Unit No. 1 , Map 5493, Lot 1
has been filed with the City of Carl sbad and referred to the P1 anning Commis
and
WHEREAS, said verified application constitutes a request as provided b:
Title 21 of the "Carlsbad Municipal Code"; and
MHEREAS, the public hearing was held at the time and in the place spec
in said notice on October 15, 1975; and
MHEREAS, the applicant has complied with the Public Facility Element o
the City of Carlsbad and has provided the necessary information which insur
Public Facilities wi'll be available and current with need; and
!dHEREAS, the subject application has complied with the requirements of
City of Carlsbad "Environmental Protection Ordinance of 1972" because the
project is designed to be compatible with the architecture and character of
neighborhood. Sirens will not be used within the neighborhood.
WHEREAS, at said public hearing, upon hearing and considering the test
and arguments, if any, of all persons who desired to be heard, said Cotnmiss
considered all factors relating to the Conditional Use Permit.
NOM, THEREFORE, BE IT RESOLVED by the Planning Commission of the City
Carlsbad as follows:
A) That the above recitations are true and correct. .
B) That the Planning Commission makes the following findings of fac.
1) The requested use is necessarv or desirable for the develop
of the community, is essentially in harmony with the variou: Elements and objectives of the General Plan, and is not det> mental to existing uses or to uses specifically permitted il zone in which the proposed use is to be located.
a) The community is developing to the east, and north a south a1 ong El Camino Real . Fire services are needel this area of the Cit.y.

b) The activity is compatible with the goal and objectives the Public Safety Element and the Development guideline Utilities and Public Services section of the Land Use E of the General P1 an.
c) Potential hazards and/or undesirable aspects of the act will be adequately mi tigated by traffic control and noi control .
2) That the site for the intended use is adequate in size and s to accomodate the use.
3) That all of the yards, set backs, walls, fences, landscaping other features necessary to adjust the requested use to exis or permitted future uses in the neighborhood will be provide and maintained.
a) The project will be reviewed prior to building permit issuance to insure the above.

b) Landscaping and maintenance thereof, will be provided tl satisfaction of the Parks and Recreation Director.
4) That the street system serving the proposed use is adequate properly handle all traffic generated by the proposed use.
a) The activity is located at the intersection of two majo thoroughfares.
The in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to app Case No. CUP 112, subject to the following conditions:
1) The Conditional Use Permit is granted for the land on the so west corner of the intersection of El Carnino Real and Chestn Avenue, identified as Parcel 1 , El Cami no Mesa , Unit No. 1 , Map 5493.
2) A system to allow the signal lights at the intersection of E Camino Real and Chestnut to be controlled by Fire Station personnel will be installed to the satisfaction of the City Engineer.
3) Traffic warnings and controls will be provided on streets anc intersections that must be used for ingress and egress at thc fire station to the satisfaction of the City Engineer.

4) With the exception of emergencies within the surrounding sub, division, siren or claxon will not be used until the emergenc vehicles are out of the subdivision.
5) A detailed landscape plan including provisions for proper screening and fencing shall be submitted for approval to the Planning Director and Parks and Recreation Director before building permits are issued.
PASSED, APPROVED AND ADOPTED at a regular meeting held on the 15th day
of October, 1975, by the Carlsbad City Planning Commission by the following
vote, to wit:
