RESOLUTION OF THE PLANNING COMMIS.SION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING AN AMENDMENT TO CUP 92 TO INCREASE THE NUMBER OF VIEWING AUDITORIUMS FROM FOUR (4) TO FIVE (5) AT CINEMA PLAZA LOCATED ON THE SOUTHWEST CORNER OF EL CAMINO REAL AND MARRON ROAD.
APPLICANT: SIEGEL BROTHERS INVESTMENT CO. CASE NO: CUP 92-A
WHEREAS, a verified application for a certain property, to wit:

(1 ) That the CUP amendment is necessary or desirable for the
development of the community in that the expansion of the number of theatres will allow great diversity in movie enter tai nment.
(2) That the proposed CUP conforms to the adopted General Plan b
a) Being consistent with the Regional Commercial designati of the Land Use Element.
b) Being consistent with Noise Element policies and guide1
(3) That the proposed CUP would not be detrimental to existing u in that the site and structure is already being used as a theatre and has been and will be a compatible land use with the surrounding commercial 1 and use.
(4) That the existing street system can serve the proposed use a the traffic generated as a result, providing that conditions of this CUP amendment are met.
C) That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to app an amendment to Planning Commission Resolution No. 1043 (CUP 92), subject to the following conditions:
(1 ) Amend Condition No. 1 to read as follows:
The approval is granted for the land described in the appl ic tion and any attachments thereto, and as shown on the Plot P submitted labeled Exhibit B, dated October 3, 1975. The location of all buildings, fences, signs, roadways, parking areas, landscaping and other facilities or features shall be located substantially as shown on the Plot Plan labeled Exhibit B, except or unless indicated otherwise herein.
(2) Add Condition No. 22 to read as follows:
Prior to occupancy of the converted theatre, the applicant shall submit a program of staggered ingress and egress times and a plan for the channelization of patrons within the thea to the Planning Director for his comment and approval.
(3) Add Condition No. 23 to read as follows:
The applicant shall complete a redesign of the main theatre entrance in the following manner:
a) The redesign of the theatre entrance shall include pro- visions for a pedestrian/patron waiting area. east of thf existing ticket office, the elimination of parking spacc east of the ticket office, replace the parking area wit1 a landscaped, pedestrian control facility. The redesigl shall be accomplished in accordance with the attached
Exhibit A, dated October 29, 1975. There shall be an appropriate number of handicapped parking places so marked in the parking area.
b) The redesign shall be submitted to the Planning Director for review and approval within 30 days of the approval of this Conditional Use Permit.

c) Construction and redesign shall be completed prior to
occupancy being issued for the proposed alteration of tl main auditorium.
d) A lighting program shall be submitted for Staff approvi to augment the existing lighting for ingress and egress
e) Queuing equipment to be of substantial material such as
I used at Disneyland.
