APPLICANT: LA COSTA LAND CO. CASE NO. CT-75-7 I i 7 /I WHEREAS, a verified appl i cation for a certain property, to wit : 8 9 Portion of Section 35 and 36, Township 12 South, Range 4 West and Portion of Section 2, Township 13 South, Range 4 West, SMB, City of Carlsbad, County of San Diego, State of California 10 has been filed with the City of Carlsbad and Referred to the Planning Commis 11 WHEREAS, the Public Hearing was held at the time and in the place speci 12 and 13 the "Carlsbad Municipal Code":or::the Subdivision Map Act; and 16 WHEREAS, said verified application constitutes a request as provided by 15 12, 1975 Planning Commission meeting; and 14' in said notice on October 14, 1975 and subsequently continued to the Novembe 17 WHEREAS, the applicant has complied with the Public Facility Policy of 18 Facilities will be available concurrent with need; and 19 City of Carlsbad and has provided the necessary information which insures Pu 20 WHEREAS, the subject application has complied with the requirements of 21 after set forth. 32 Commission made certain findings and reached a decision on the request as he1 31 said hearing, after considering all the evidence presented, the Planning 30 desiring to speak on the subject request were heard. B) That the Planning Commission makes the following findings of fact: 1) The proposed map, its design and improvements, is consistent with the General Plan because: a) The land use and density of the project (2.8 dwelling PC acre overall) conform to General Plan designations (medi high residential density, 10-20 dwellings per acre); b) Open Space, Parks, Circulation and Noise Attenuation are provided for in a manner consistent with applicable Elem of the General Plan. 2) The proposed subdivision map, its design and improvements, is consistent with the applicable Specific Plan because: a) The lots so created are consistent with the residential designated by the Specific Plan. C) The in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to appr CT 75-7, subject to the following conditions: 1 ) CT 73-20, adopted by City Council on October 16, 1973, Resol u 3251 , shall be rescinded. 2) The final map shall be submitted for approval within 18 month from the final action by the City Council on the Tentative Subdivision Map. The Final Map shall be in substantial confo mance with the tentative subdivision map known as Exhibit B, dated October 24, 1975. 3) The development of the property described herein shall be sub to the restrictions and limitations set forth herein which ar addition to all the requirements, limitations, and restrictio of all municipal ordinances and State and Federal statutes no in force for the purpose of preserving the residential charac istics of adjacent properties. 4) In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by Fi re Department. 5) Ornamental street lighting shall be provided for as required I Municipal Ordinance. The developer shall deposit cash in the amount necessary to energize said street lights for an eightec month period after construction to permit the incorporation 0' the subdivision into a maintenance district. 6) A1 1 land and/or easements required shall be granted to the Ci. Carlsbad withoug cost to the City, and free of all liens and encumbrances. The report plan shall be prepared by Civil Engineers licensed by the Sta of California, and experienced in erosion control, who shall acceptable to the City Engineer. They shall certify that the have investigated the site and prepared data with full con- sideration of the consequences to the included and neighborin properties and in conformance with the Geologic and Seismic Safety Element of the General Plan. 8) The cross gutter at the intersection of "A" Street and Levant Street is not approved as shown but shall be redesigned and approved by the City Engineer at such time as improvement pla are presented for review and approval. 9) "A" Street shall be dedicated and improved as a residential 10) Dedication of streets shall include a waiver of direct access col 1 ector street . rights from El Camino Real , Levante Street and Anillo Way shown on the final map as abutting thereon, except that a waiver of access rights to Levante Street from lots 82-88 is not required. 11 ) Improvement of the intersection of Levante Street and Anillo Way shall include a raised island to channelize right turn movements from Levante Street to Ani1 lo Way. 12) Park-in-1 ieu fees shall be paid to the City prior to City Cou 13) Concurrent with final map recordation an open space easement shall be granted to the City of Carl sbad over lots 226 and a portion of lots 223 and 227 as shown in Exhibit B, dated October 24, 1975. At the same time 20 foot open space easeme over portions of lots 16, 34, 172 and 186 shall be granted tc the City of Carlsbad as shown in said Exhibit, or shall be included in lots 226 and 227 if approved by the Planning Dire approval of the final map. 14) A detailed landscape and automated irrigation plan shall be submitted to the Parks and Recreation Director for his approv prior to issuance of grading permits. Said plan shall includ all slopes with toes-of-slope adjacent to public rights-of-wa and lots 226 and 227. 15) Prior to the acceptance of subdivision improvements by the Ci all landscaping and irrigation facilities included in the lar scape and irrigation plan described in the above condition SI be installed. The applicant shall maintain said landscaping until such time as permanent maintenance is established. 16) Prior to any occupancy of any portion of the Specific Plan ar the applicant shall file with the Clerk of the City of Carlst a petition for thr formation of an Open Space Maintenance Dis as provided for in Section 50590 of the California State Government Code. The applicant shall maintain all landscapir installed in conformance with this plan until such time as ar Open Space Maintenance District is established and accepts maintenance responsibilities as prescribed in the Open Space Maintenance Act, or until maintenance responsibility is accer by another entity acceptable to the City. The CC&R-s for the Association SI contain provisions guaranteeing maintenance of said landscap. and shall be reviewed by the Planning Director. Prior to the issuance of building permits on lots 223, 224, ; a study of the noise levels of said lots shall be made by an acoustical engineer experienced in noise attenuation. Said study shall determine if attenuation measures are necessary to bring noise levels within 65 dB(A) outdoors and 45 dB(A) indoors. Said study shall recommend such attenuation measure as deemed necessary and approved by the Planning Director. $ measures shall be incorporated in the site design and buildir plans for said lots. The water main serving "J" Street, as shown on Exhibit A, dated September 5, 1975, shall be looped unless rejected by Olivenhain Municipal Water District. The pub1 ic water system shall meet all of the current requirements of the Olivenhain Municipal Water District and 1 developer shall be responsib le for the preparation of all nc ary engineering construction plans and will enter into the fc agreements, including financial guarantee for construction 01 pu bl i c water sys tem. Construciton of sewer facilities, easements, and sewer access easements shall conform to the standards of the Leucadia Coun Water District. The location of fire hydrants and fire flows shall be approve by the Fire Chief prior to final map approval. All drainage easements shall be improved by a culvert or drai age channel of adequate size, whichever is required by the Sa Diego County Department of Sanitation and Flood Control. . Whc a drainage channel is required, such channel shall be lined with a suitable material as specified by the County Departmer of Sanitation and Flood Control. An access easement shall bc provided to each drainage system maintenance access point as required by the San Diego County Department of Sanitation and Flood Control. Additional drainage easements and drainage structures be pro- vided or installed as may be required by the County Departmen of Santiation and Flood Control. All surface waters originating within the subdivision and all surface waters that may flow onto the subdivision from adjace lands shall be disposed of by a drainage system satisfactory to the County Department of Sanitation and Flood Control. Prior to the issuance of grading permits the developer shall a recognized archeological organization to submit a report to Planning Commission for its approval, setting forth a program for preserving the archeological resources of the site. The Planning Commission may consider recommending the imposition I additional conditions deemed necessary in view of the archeoll a7 report. Upon receipt of such recommendations, the City COI may impose any additional conditions in that regard which sha be satisfied prior to approval of the final map. - 4- . .r (I e e /I 1 2 3 4i 26) Street names shall be approved by the Planning Director prior to approval of the Final Map.
