HomeMy WebLinkAbout1975-11-26; Planning Commission; Resolution 1207ll e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 \ PLANNING.COMMISSION RESOLUTION NO. 1207 RESOLUTION OFTHE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA CONCERNING THE SPECIFIC PLAN TO ALLOW A PIPELINE BOOSTER PUMP STATION ON PROPERTY LOCATED ON THE NORTHEAST CORNER OF THE INTERSECTION OF EL CAMINO REAL AND OLIVENHAIN ROAD. APPLICANT: SAN DIEGO PIPELINE CASE NO. SP-767 WHEREAS, a verified application for a certain property, to wit: That portion of Lot 8, in section 2, township 13 south, range 4 west San Bernardino meridian, in the County of San Diego, State of California, according to official plat thereof, lying westerly of the westerly line of the Rancho Encinitas and lying easterly of the easterly line of the 90 foot strip of land described in parcel 67083-A in said deed to the County of San Diego, recorded November 28, 1969, i document No. 217326 of official records and lying northerly of the northerly line of that certain 60 foot strip described in parcel 61294-8 in deed to the County of San Diego recorded September 28, 1961 as document No. 169289 of official records known as road survey No. 16: and further described on file in the Carlsbad City Planning Department has been filed with the City of Carlsbad and referred to the Planning Commission; and 15 I.6. 17 Title 21 of the "Carlsbad Municipal Code"; and in said notice on November 26, 1975; and I* 19 20 21 22 23 24 WHEREAS, said verified application constitutes a request as provided b: WHEREAS, the public hearing was held at the time and in'the place spec Whereas, the applicant has complied with the Public Facility Policy of City of Carlsbad and has provided the necessary information which insures Pub1 ic Facilities will be available concurrent with need; and WHEREAS, the subject application has complied with the requirements of City of Carlsbad "Environmental Protection Ordinance of 1972" in that a Negitive Ceciaration has been issued for the following reasons: 25 26 27 28 29 Use of a pipeline is the safest and most economical method for trans- porting petroleum products. The booster station will be partially enclosed and landscaped to lessen aesthetic impacts. Noise impacts will be negligibe. No petroleum products will be exposed to the air, consequently, there will be no emissions. WHEREAS, at said public hearing, upon hearing and considering the test 30 facts and reasons to exist: 32 considered all factors relating to the Specific Plan and found the followir 31 and arguments , if arty , of a1 1 persons who desired to be heard , said Commiss * 0 1 1 ) The proposed use will not be detrimental to the adjoining propert. 2 3 4 5 2) The site is adequate in size and shape to accomodate the proposed use. 3) Adequate setbacks, fences, landscaping and other features necessal to adjust the proposed use to existing or permitted future uses il the neighborhood will be provided and maintained. 6 I/ I' 4) The street system serving the proposed use is adequate to properl: handle additional traffic flow. 7 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City I 8 Carlsbad as follows: 9 A) That the above recitations are true and correct. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 B) That a Specific Plan is approved to a1 low a pi pel i ne booster pump station on property located on the northeast corner of tt-e inter- section of El Camino Real and Glivenhain Road, and is subject to fol 7owi ng conditions : (1 ) The approval is granted for the land described in the appl ic, and any attachments thereto, and as shown on the Plot Plan s mitted labeled Exhibit A, dated March 14, 1975. The locatio all buildings, fences, signs, roadways, parking areas, land- scaping and other facilities or features shall be located su stantially as shown on the plot plan labeled Exhibit A, except or unless indicated otherwise herein. (2) All lighting shall be arranged to reflect away from adjoinin properties and streets. (3) All outside storage areas shall be screened from adjacent property and streets. (4) A detailed landscape and automated irrigation plan shall be submitted to the Parks and Recreation Director and Planning Director for approval prior to issuance of grading permits to protect the eventual development of the residential area. (5) Prior to occupancy or operation of this project, all land- scaping and irrigation facilities included in the landscape and irrigation plan described in the above Condition be in- stalled to protect the eventual development of the residenti area. (6) All utilities, including electrical, telephone and cable television, shall be installed underground and/or shall be completely concealed frorr view.
