HomeMy WebLinkAbout1975-12-10; Planning Commission; Resolution 1210f a i i I. // PLANNING COMMISSION RESOLUTION NO. 1210 2 3 4 5 6 7 8 9 10 11 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING THE CONDITIONAL USE PERMIT TO ALLOW CONSTRUCTION AND OPERATION OF A TEMPORARY BRANCH OFFICE AS AUTHORIZED IN SECTION 21.42.01 O(5S) OF THE ZONING ORDINANCE APPLICANT: GIBRALTAR SAYINGS AND LOAN ASSOCIATION CASE NO. CUP-114 WHEREAS, a verified application for a certain property, to wit: Those portions of Lots 4 and 5 of Franctional Section 32, Township 11 South, Range 4 West, San Sernardino Meridian, and more particularly described in the files of the City Planning Department, has been filed with the City of Carlsbad and referred to the Planning Commi: 12 and 13 Title 21 of the "Carlsbad Municipal Code"; and 14 WHEREAS, said verified application constitutes a request as provided b; 15 ll WHEREAS, the applicant has complied with the Public Facility Element 0- 16 17 the City of Carlsbad and has provided the necessary information which insurc current project under Section 19.04.153; and 21 Planning Director has issued an Endorsement of Prior Compliance for the 20 City of Carlsbad "Environmental Protection Ordinance of 1972" in :that the 19 WHEREAS, the subject application has complied with the requirements of 18 Public Facilities will be available and current with need; and 22 WHEREAS, the public hearing was held at the time and in the place spec 23 24 in said notice on December 10, 1975; and Commission considered all factors relating to the Conditional Use Permit. 26 testimony and arguments, if any, of all persons who desired to be heard, sa 25 WHEREAS, at said public hearina, upon hearing and considering the 27 NOW, THEREFORE, BE IT RESOLVED b.y the Planning Commission of the City 28 B) That the Planning Commission makes the following findings of fact 30 A) That the above recitations are true and correct. 29 Carlsbad as follows: 31 32 (1 ) The requested use is necessary and desirable for the develor ment of the community because: 4 .. w m i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 20 29 30 31 32 a) The General Plan Land Use Element designates the project site for Community Commercial use; b) A specific plan for a community shopping center has been approved for the site; and c) A temporary banking facility is compatible with these pl (2) The requested use is not detrimental to existing uses or to u specifically permitted in the zone in which the proposed use to be located because: a> The land uses existing on the project site and adjacent it are commercial in nature, (3) The site for the intended use is adequate in size and shape t accommodate use because: a) The site has been graded to accommodate commercial land uses t (4) A1 1 yards, setbacks 3 landscaping, improvements, and other features necessary to adjust the requested use to existing ar permitted future uses in the neighborhood will be provided ar maintained because: a) The proposed use has been designed in conformance with 1 adopted specific plan for the project site; b) The necessary parking has been provided for; c) Other necessary landscapinq and improvement features ha1 been guaranteed through conditions of approval. (5) The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use because: a) El Camino Peal is an arterial street with adequate capal to handle the traffic generated by the project. C) The in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to app' Case No. CUP 114, subject to the following conditions: (1 ) The approval is granted for the land described in the appl ic and any attachments thereto, and as shown on the plot plan submitted and labeled Exhibit A, dated 10-28-75. The locati of a1 1 structures y roadways y parking areas shall be located substantially as shown on the plot plan labeled Exhibit A, unless indicated otherwise herein. (2) Any mechanical and/or electrical equipment to be located on the roof of the structure shall be screened in a manner acceptable to the Planning Director. Detailed plans for sai screening shall be submitted to the Planning Director for hi approval prior to the issuance of occupancy permits. (3) A detailed landscape and sprinkler plan for the project shal be submitted to the Parks and Recreation Qirector for his approval. Said landscaping and sprinkler system shall be instal led prior to the issuance of occupancy permits. -2- 4 . r 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 rn * (4) The Conditional Use Permit is granted for a period of one ye in accordance with Section 21.42.010 (5s) of the zoning ordinance: S) Temporary uses of trailers or mobile homes for commercia offices under the following conditions: (i ) The occupancy shall not exceed one year after the issuance of the permit unless otherwise extended by Planning Commission. The conditional use permit sh not be extended unless construction of the structur intended for occupancy by applicant has begun and reasonable progress toward completion is being made (ii) The method of placement of the trailer, the landsca and other design aspects shall be approved as part the Conditional Use Permit. (5) Prior to the granting of an occupancy permit, the following improvements shall be made: (a) Construction of full street improvements on El Camino (b) Construction of full street improvements of the shoppin Real adjacent to the subject property center entrance on the portion adjacent to the subject property. (c) Construction of a water system serving the two existing banking facilities as well as the proposed project to t satisfaction of the Fire and Engineering Departments. (6) Prior to the granting of occupancy permit, the applicant sha post a bond for redesign and construction of existing El Carr Real intersection improvements. This bond shall be released the City upon satisfaction of the City Manager that Gibralta Savings and Loan has vacated the site within a time period agreed upon by the City. I (7) Prior to the granting of occupany permits , the applicant sha submit an interim grading plan for the site.
