HomeMy WebLinkAbout1976-01-14; Planning Commission; Resolution 1213- " e m /I 1 2 3 4 5 PLANNING COMMISSION RESOLUTION NO. 1213 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA CONCERNING THE CONDITIONAL USE PERMIT TO ALLOM A YOUTH RECREATION PARK DESIGNED PRIMARILY FOR THE USE OF SKATEBOARDS, ROLLER SKATES AND BICYCLES TO BE CONSTRUCTED ON PROPERTY LOCATED AT CARLSBAD RACEWAY. I APPLICANT: LARRY GRISMER CASE NO. C) That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to appr Case No. CUP-42EY subject to the following conditions: 1) Conditional Use Permit 42E is approved for the property shown on the plot plan submitted Exhibit A, dated 12-5-75. 2) The development of the subject project shall conform to the phasing plan submitted as Exhibits B and C dated 12-29-75. P deviation from this plan shall require review and approval by the Planning Director. 3) The conditional use permit 42E shall expire on the same date as CUP 42D, that is April 25, 1982. 4) Each development phase shall be reviewed by the Planning Dire to insure adherence to the various conditons of the Condition Use Permit. -2- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 20 29 30 31 32 m * 5) 6) 7) 8) 9) 10) 11) 12) 13) 14) 15) 16) 17) First Aid facilities shall be provided at the project site a! approved by the Planning Director for the first phase and for each subsequent phase. No alcoholic beverages shall be permitted on the grounds or premises of the skatepark. Parking facilities shall be reviewed by the Planning Director and City Engineer at each development phase. All buildings planned for the subject project shall be reviev by the Planning Director prior to application for building permits . Operating hours for the skatepark shall be confined to 9:00 o’clock AM to 1 hour before sunset. Any deviation from thesc operating hours will require approval of the Planning Direct( At no time shall opening and closing hours of the skatepark coincide with opening and closing hours of other activities c the Raceway property. A permanent residence for a night watchman is permitted pro- vided al 1 requirements of the City Code are met. During con- struction of the skateboard facility a temporary trailer may placed on the property provided all requiremtns of the City C are met. If the applicant wishes to install night lighting at some ful date, approval by the Planning Director shall be required anc the lighting plan shall be submitted to the Planning Director for approval prior to application for building permits. No search lights shall be allowed for the purpose of advertis of the skatepark facilities. A landscaping and automatic sprinkler system plan for the ska park development shall be submitted to the Parks and Recreati Director for approval prior to 1st phase building permit issu and for each additional phase thereafter. A potable water supply meeting the standards of the San Diego County Health Department shall be supplied, at no expense to City of Carlsbad. The skatepark shall be completely fenced, bermed and separate from the other activities on the Carlsbad Raceway property to the satisfaciton of the Planning Director, prior to first pha building permit issuance and for each subsequent phase Sanitary facilities acceptable to the County Health Departmen and the City Public Morks Department shall be provided. Thes facilities shall be expanded as necessary prior to special events or at any time when larger than average crowds are anticipated. If special events as determined by the Planning Director, are scheduled for the skatepark, all commercial interests not directly control led by the skatepark or Carlsbad Raceway shal be required to obtain a business license from the City. -3- 0 9 1 2 3 4' 5 6 /I 7 8 9 10 11 12 13 14 15 16 17 18 18) Thirty days prior to any special event, as determined by the Planning Director, the skatepark operator and sponsor or the promoter of the event shall meet and confer with representat of the Police, Fire and City Public Works Department in Plav and establishing guidelines pertaining to public safety, special fire problems, sanitation, traffic control, etc. 19) All signs advertising the skateparkviewable from off the sit shall conform to the City of Carlsbad sign regulations. A s program for interior oriented directional, service and adver ing purposes shall be approved by the Planning Director. 20) To mitigate potential concentrated runoff problems, a rip-ra settling basis will be provided at a downgrade location of t canyon in which the skatepark will be developed, to the satisfaction of the City Enaineer, prior to 1st phase buildi: evaluated at each subsequent development phase by the City , permit issuance. The adequacy of the cacil i ty shall be ~ Engineer and modified if necessary. 21 ) The construction priviledges hereby granted are granted sole to the owner, his vestee or agent in said construction and these priviledges are not transferable without the expressed consent of the City Council of the City of Carlsbad. 22) Skateboards, rollerskates, and bicycles will be the only vehicles allowed on the skatepark course. At no time will motor vehicles be allowed, accept for maintenance purposes. 23) Planning Comission shall review the operation every five yei to determine if the skateboard park is deterimental to surrounding properties or traffic movement. If it is deter- mined that the skateboard park may be deterimental, the Plan!
