HomeMy WebLinkAbout1976-01-28; Planning Commission; Resolution 1215t. * 3 I/ 0 0 1 2 3 4 5 6 7 8 9 PLANNING COMMISSION RESOLUTION NO. 1215 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA , CONCERNING ANiAMENDMENT TO CITY COUNCIL RESOLUTION NO. 3771 TO PROVIDE TWO ADDITIONAL LOTS FOR OPEN SPACE AND PARK SITES AND ELIMINATION OF A 20' WIDE OPEN SPACE EASEMENT APPLICANT: LA COSTA LAND COMPANY CASE NO. 75-6(A) WHEREAS, a verified application for a certain property, to wit: All of Carlsbad Tract No. 72-25, Map No. 7784 and a portion of Section Township 12 South, Range 4 West, San Bernardino Meridian, in the City o Carlsbad, County of San Diego, State of California 10 and 11 has been filed with the City of Carlsbad and referred to the Planning Commis 12 WHEREAS, the public hearing was held at the time and in the place speci 13 public facilities will be available concurrent with need; and 18 the City of Carlsbad and has provided the necessary information which insure l7 WHEREAS, the applicant has complied with the Public Facilit9 Policy of 16 the "Carlsbad Municipal Code" or the Subdivision Map Act; and 15 NHEREAS, said verified app7ication constitutes a request as provided b) 14 in said notice on January 28, 1976; and 19 WHEREAS, the subject application has complied with the requirements of 2o compliance (Title 19, Sec. 19.04.153). 21 City of Carlsbad "Environmental Protection Ordinance of 1972" by pridr .' said hearing, after considering a1 1 the evidence presented , the Planning 24 desiring to speak on the subject request were heard. At the conclusion of 23 WHEREAS, at said hearing a staff report was presented and all persons 22 25 Commission made certain findings and reached a decision on the request as hc 26 inafter set forth. 27 28 Carlsbad as follows: 29 30 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City o A) That the above recitations are true and correct. B) That the Planning Commission makes the following findings of fact: 31 32 1) The proposed lot 107, a 6.2 acre lot, is suitable for park ar open space purposes. Y 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 e 0 2) The proposed 2.3 acre portion of Lot 107 is acceptable in shi to provide adequate park use for the property. 3) Adequate public access will be available to the park from thc south, through a previously dedicated 20 foot open space easc ment. 4) The Parks and Recreation Element of the General Plan designa. the subject park area as a "Proposed Park Site" . 5) Environmental Protection requirements have been satisfied through prior compl iance (Title 19, sec. 19.04.1 53). C) That in view of the findings heretofore made and considering the applicable law, the decision of the Planning Commission is to app' an amendment to City Council Resolution 3771 through CT 75-6(A) b; following conditions: 1) Amend Condition No. 1 to read as follows: The final map shall be submitted for approval within 18 months from the final action by the City Council on the Tentative Subdivision Map. The final map shall be in sub- stantial conformance with the tentative subdivision map knowr as Exhibit A and B, dated December 4, 1975. 2) Amend Condition #16 to read as follows: An additional lot, lot 106, shall be created 10' wide along . eastern boundary adjacent to lot 61, 60, 59, 58. Said lot 11 shall be shown on the final subdivision map and shall be offered for dedication to the City for Open Space purposed cc current with final map recordation. 3) Combine Conditions 17 and 18 (to be shown as Condition No. 1' to read as fol lows: An open space easement over portions of lots 1 , 99, 100, 101 102, and 105, as shown in Exhiibit A, dated December 4, 1975, shall be granted to the general pub1 ic in perpetuity concurrl with final map recordation. 4) Add Condition No. 18 to read as follows: Lot 107 shall be divided as shown on Exhibit C, dated Januar? 21, 1976, with the divisions occurring as follows: Prior to recordation of the final map, a 2.3 acre parcel identifiec as lot 107A shall be dedicated to the City of Carlsbad for p; purposes. Lot 107B shall, be 'identified as 0.8 acre parcel al lot l07C as a 3.1 acre parcel ,, 5) Amend Condition No. 19 to read as :follows: Lots 103 and 104 as shown in Exhibit A, dated December 4, 19: shall be dedicated to the City of Carlsbad for Open Space us( concurrent with recordation of the Final Map. Prior to dedit tion of Lot 104, the existing debris and grading deposits shi be removed from said lot or the unconsolidated fill compacted to the satisfaction of the City Engineer. 6) Amend Condition No. 20 to read as follows: An open space easement shall be dedicated to the City of Carlsbad over the portion of Lot 107 identified as 107B, 1071 equalling 3.9 acres. .. - z- 4" . 1 2 3 4 5 f3 /I 7 8 9 10 11 12 i I 0 e 7) Amend Condition No. 25 to read! as foll ows: A detailed landscape and irrigation plan for all phases of the project, prepared by a landscape architect, shall be submitted to the Parks and Recreation Director and the City Engineer for consideration and approval prior to approval of any building permit for any phase of the project. This requirement shall apply to the major slope areas which do no' have landscaping or irrigation already installed or which ma. be manufactured as a result of new grading. PASSED, APPROVED AND ADOPTED at a regular meeting held on January 28, by the Carlsbad City Planning Commission, b.y the following vote, to wit: AYES: Commissioners Watson, L'Heureux, Larson, Packard, Fikes Jose and Dominquez NOES : None ABSENT: None I * ""t: '\i& Stephen F1.
