RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING
LATIVE TO AN AMENDMENT TO TITLE 21 OF THE FORTH ITS FINDINGS AND RECOMMENDATION RE-
MUNICIPAL CODE, PROVIDING FOR CITY INITIA- TION OF BOUNDARY ADJUSTMENTS IN THE F-P FLOODPLAIN OVERLAY ZONE CASE NO.: ZCA-76
WHEREAS, the Planning Commission of the City of Carlsbad

17 WHEREAS, the Planning Commission did find that the propc
18 amendment to Title 21 has complied with the requirements of 1
19 City of Carlsbad "Environmental Protection Ordinance of 1972'
20 because the proposed amendment is of an administrative naturc
21 and will therefore not have a significant impact on the phys:
22 environment; and
23 WHEREAS, the Planning Commission did find that the propc
24 amendment to Title 21 will help implement the intent of the
25 Geologic and Seismic Safety Element of the General Plan; and
did adopt Resolution of Intention No. 126 declaring its in-
tention to recommend to the City Council an Amendment to Tit1
21 of the Municipal Code; and
WHEREAS, the Planning Commission did hold a duly noticed
Public Hearing to consider the subject amendment; and
WHEREAS, the Planning Commission received all testimony
those persons interested in and opposed to, if any, the propos
Zone Code Amendment; and
26 WHEREAS, the Planning Commission did find the following
27 facts and reasons to be present which in their opinion are

I necessary to carry out the general purpose of Title 21 of the

6 that land may not be actually located in a flood-prone

is a potential hardship on the property owner.
2) It is therefore desirable to facilitate the removal of land from said zone when new information indicates that
area.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commissic
of the City of Carlsbad that it does recommend approval to th
City Council of an amendment to Title 21 as follows: loll 21.31.025 - Zone Boundary Adjustments

The Planning Commission shall initiate a zone change to remove the F-P overlay designation from a particular property.upon report of the City Engineer that new information, including but not limited to updated topographic maps, updated meteorological reports, or updated Covps of Engineers studies , indicates that a floodplain boundary line is incorrect.
If such a zone change is approved, appropriate documentation shall be forwarded to the Federal Insurance Administration to insure adjust- ment of said boundary line on Federal Flood Hazard Boundary Maps.
