HomeMy WebLinkAbout1976-04-28; Planning Commission; Resolution 1243v 0 1 PLANNING COMMISSION RESOLUTION NO. 1243 2 3 4 5 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING LATIVE TO AN AMENDMENT TO TITLE 21 OF THE MUNICIPAL CODE, PROVIDING FOR AGRICULTURAL USES IN THE OPEN SPACE ZONE. FORTH ITS FINDINGS AND RECOMMENDATIONS RE- CASE NO.: ZCA-74 6 II 7 11 WHEREAS, the Planning Commission of the City of Carlsbac 8 of the Municipal Code; and lo tion to recommend to the City Council an Amendment to Title 2 9 did adopt Resolution of Intention Nu. 119 declaring its inter; 11 I' 13 Public Hearing to consider the subject amendment; and WHEREAS, the Planning Commission did hold a duly noticec WHEREAS, the Planning Commission received all testimony '1 4 l5 16 proposed Zone Code Amendment; and 17 from those persons interested in and opposed to, if any, the WHEREAS, the Planning Commission did find the following facts and reasons to be present which in their opinion are l8 20 19 necessary to carry out the general purpose of Title 21 of the Carlsbad Municipal Code: 1) A number of agricultural uses are considered consistent 21 with the intent of the Open Space Land Use and Zoning categories. 22 2) Certain restrictions should apply to the type of agricul 23 tural uses permitted, because of the location of several 24 25 Protection Ordinance of 1972 because: 0-S zoned parcels within or near urbanized areas. 3) The action complies with the Carlsbad Environmental 26 27 28 A negative declaration has been issued for the follow- ing reason: This proposed ordinance amendment is of administrative nature and will not have a direct or significant impact on the physical environment. f 1) 0 1 2 in open space designated areas. 4) The General Plan considers agricultural uses desirable 3 NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio 4 6 the City Council of an amendment to Title 21 as follows: 5 of the City of Carlsbad that it does recommend approval to (14) Agriculture - Only the following agricultural 8 as follows: by addition thereto of subsection (14) which reads 7 Section 21.33020 of Chapter 21.33 is hereby amended 9 uses are permitted in the 0-S Zone: 10 11 12 13 (a) Field and seed crops; (b) Truck crops; (c) Horticultural crops; (d) Orchards and vineyards; (e) Pasture and rangeland; (f) Tree farms; (9) Fallow lands. 14 Carlsbad City Planning Commission held on April 28, 1976, by 15 PASSED, APPROVED AND ADOPTED at a regular meeting of thE 17 the following vote, to wit: 16 AYES: Commissioners Dominguez, Fikes, Jose, L'Heurei Larson and Watson. l8 1) NOES: None 19 11 ABSENT: None 2o I!
