HomeMy WebLinkAbout1976-05-12; Planning Commission; Resolution 1248d a 1 0 0 1 ;I PLANNING COMMISSION RESOLUTION NO. 1248 2 3 4 5 6 7 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RE- LATIVE TO REZONING PROPERTY FROM R-A-10,000 TO PM-Q ON PROPERTY LOCATED AT THE NORTHWEST CORNER OF AVENIDA ENCINAS AND PALOMAR AIR- PORT ROAD CASE NO.: ZC-775 APPLICANT: L. BRUCE STALLARD (AGENT) 8 shown on the attached map has been filed with the City of 9 WHEREAS, a verified application for a certain property, Calrsbad and referred to the Planning Commission; and lo 11 WHEREAS, said verified application constitutes a requesi l2 notice on May 12 , 1976; and l5 zoning was held at the time and in the place specified in sa l4 WHEREAS, the public hearing to consider the subject re- 13 as provided by Title 21 of the "Carlsbad Municipal Code"; an( 2o 19 Ordinance of 1972"; and l8 quirements of the City of Carlsbad "Environmental Protection l7 WHEREAS, the subject application has complied with the 16 ing the testimony and arguments, if any, of all persons who 21 desired to be heard, said Commission considered all factors 22 relating to the Zone Change and found the following facts an 23 reasons to exist: 24 25 WHEREAS, at said public hearing, upon hearing and consi 1) The Change of Zone is consistent with the General Plan because: 26 27 a) The P-M zone restricts land use to the type described in the Planned Industrial section of the Land Use Element. 28 4 - 0 0 1 2 3 4 b) Public Facility adequacy will be insured sub- ject to Site Development Plan review at the time of development. c) The zone change will have no adverse effect on any element of the General Plan. 5 2) The proposed zone change is consistent with the Car' bad Environmental Protection Ordinance of 1972 becal 6 7 8 a) A negative declaration has been filed by the Planning Department for the project because th site is flat, located between established in- dustrial uses, is buffered by the railroad rig of-way, and is near major transportation corri 9 10 11 3) The proposed zone change is consistent with applica City Public Facilities Policies and Ordinances beca a) Minimum public facilities exist. 12 13 b) At the time of development, staff review will evaluate the land use type in relation to adeq of current and future availability of public facilities. 14 15 16 17 18 recommended for approval. NOW, THEREFORE, BE IT RESOLVED by the Planning Commissic of the City of Carlsbad as follows: A) That the above recitations are true and correct.
