HomeMy WebLinkAbout1976-05-19; Planning Commission; Resolution 1253r f ~ -. *, e 0 1 2 3 4 5 6 7 8 9 PLANNING COMMISSION RESOLUTION NO. 1253 A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, RECOMMENDING TO THE CITY COUNCIL ADOPTION OF THE MASTER PLAN AMENDMENT FOR 4026 ACRES LOCATED ON THE EAST SIDE OF EL CAMINO REAL, NORTH LETION OF EXISTING MASTER PLANS FOR THE SAME PROPERTY AS APPROVED BY ORDINANCES 9322 AND 9376 AND CITY COUNCIL RESOLUTION NO. 3183. APPLICANT: LA COSTA LAND COMPANY AND WEST OF THE CITY LIMITS, AND THE DE- CASE NO.: MP-l49(A) 10 WHEREAS, a verified application for a certain property, 11 bad and referred to the Planning Commission; and 'I2 shown on the attached map has been filed with the City of Car 13 WHEREAS, said verified application constitutes a request l4 provided by Title 21 of the "Carlsbad Municipal Code"; and 15 I' place specified in said notice on May 19, 1976; and 17 WHEREAS, at said Public Hearing, upon hearing and consic l8 ing the testimony and arguments, if any, of all persons who ( I' sired to be heard, said Commission considered all facts relai 2o to the Master Plan found the following facts and reasons to t 21 1) The proposed Master Plan amendment is consistent with tl 22 23 24 with those of the Land Use Element; 25 b) The Circulation System proposed conforms in locati 26 27 proposed Master Plan which implement the other ele of the General Plan and policies contained therein 28 These i ncl ude: WHEREAS, the public hearing was held at the time and in General Plan because: a) Residential densities and locations, and the locat of commercial, park and open space uses are consis and design with the Circulation Element; c) Other programs and policies have been included in e * e @ 1 3) Phasing Program; 2 1) Sign program; 2) A Parks Program and Parks Improvement Prog 4) Geotechnical Safety Program. 3 2) The proposed Master Plan Amendment has complied with the 4 quirements of the Carlsbad Environmental Protection Ordin because: 5 a) An Environmental Impact Report, EIR-307, has been CE 6 f ied by the City Council in connection with a Genera Plan Amendment for the project area on April 27, 197 7 8 b) The project entails no new environmental impacts not considered in that EIR; 9 c) The project does not significantly differ from that 10 11 12 13 Public Facilities Policy because: 14 needs generated by the Master Plan. 15 a) All public facility service agencies have indicated 17 b) The phasing plan of the project will allow the cit4 16 program capital improvements to provide public faci ties as needed to serve the anticipated service den l8 4) The proposed Master Plan Amendment is not a static docun 19 and will be reviewed and amended during the life of the Master Plan to ensure that development of the La Costa I 20 munity occurs in conformance with the City's policies bl 21 a) The Master Plan document includes provisions for a' annual information status report on the progress 0' 22 the Master Plan's programs and a formal review of document every three years. 23 24 the City of Carlsbad as follows: 25 26 27 sidered in that EIR; and d) The mitigation measures for Environmental Impacts il fied by EIR-307 have been incorporated as condition the amended Master Plan. 3) The proposed Master Plan Amendment conforms with the Cit their ability to provide services concurrent with NOW, THEREFORE, BE IT RESOLVED by the Planning Commissi A) That the above recitations are true and correct. B) That a Master Plan Amendment is approved for 4026 acres located on the east side of El Camino Real, north and h of the City limits, and the deletion of existing Master 28 il -2- v e 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 Plans for the same property as approved by Ordinances No. 9322 and 9376 and City Council Resolution No. 3183, and is subject to the following conditions: 1) The approval is granted for the land described in th application and any attachments thereto. Developmen within said land shall occur in conformance with the exhi bits, plans, objectives and policies included ir the Master Plan document submitted labeled Exhibit ' dated May 15, 1976. 2) Following final adoption by the City Council of a re vised Planned Community Zone (ZCA-80), no subdivisic map, site development plan, or other application wil the amended Master Plan area shall be accepted by t' Secretary of the Planning Commission until it can bl determined that the application is consistent with provisions of the Planned Community Ordinance. If appropriate, the applicant shall apply for an amendl and the City will hold necessary hearings on an Arne rnent to the Master Plan to insure conformance with revised P-C Zone. 3) The submittal of supplements to EIR-307 shall be re quired with applications for any development within the project area. These supplements shall contain the following: - Detailed soil and geologic investigations; - Detailed archeological investigations; - Detai 1 ed bi 01 ogi cal surveys ; - Mitigation measures and alternatives for all im- pacts which may affect significant resources; - Discussions of impacts attributable to the develo which have not been adequated addressed in EIR-3C 4) The original Master Plan for La Costa (Ordinance Nc 9322 and 9376) and the Kratter Master Plan (MP-128; City Council Resolution No. 3183) shall become voic concurrent with the effective date of the Master P- Amendment. 5) Approval of this Master Plan Amendment indicates acceptance by the City Council of a general scheme development for the property. It does not guarantt that individual developments within the Master Plat boundary wi 11 be approved. Individual development will be evaluated in accord with Municipal Ordinan and Policies in force at the time of plan submitta Approval and construction of an individual develop under this Master Plan will not vest any developme rights in the balance of the Master Plan area. -3- ' r. .
