The design or improvement of the proposed subdivision is consistent with applicable General or Specific Plans beci a) Open Space and Circulation are provided for in a mar consistent with applicable Elements of the General F and the adopted La Costa Master Plan. The site is physically suitable for the type of developme because: a) An Environmental Impact Report (EIR-35) for a prior project on the site was certified by City Council ar a supplement covering the proposed project prepared. The site is physically suitable for the proposed density development because: a) The land use and density of the project (3.2 dwellir per acre) conform to the Site's designation in the Land Use Element of the General Plan Land Use Elemen (Residential Medium-High density, 10-20 dwellings/ac and adopted La Costa Master Plan (6.2 dwellings/acre There are no unique or unusual topographic features that would restrict the number of dwelling units pro posed. The design of the subdivision or the imposed improvements will not cause substantial environmental damage or substa tially and avoidably injure fish or wildlife or their habi tate because: a) The adverse impacts identified in said Environmental Impact Report #35 will be mitigated by Conditions of approval, previous project approvals on the site, or going local , State and Federal programs, or have be€ found to be outweighed by the social and economic be fits of the project. The design of the subdivision or the type of improvement will not cause serious public health problems. a) There are no unique or unusual circumstances in the development of the subject project that would affect pub1 i c health qual i ty. That the design of the subdivision or the type of improve ments will not conflict with easements acquired by the pu at large for access through, or use of, property within the proposed subdivision. 3 e 0 1 this approval or subsequent approvals prior to con- 2 a) Dedication of all public easements and right-of-way: will be insured through conditions imposed through struction. 3 8. The proposed map has complied with the requirements of ti 4 City of Carlsbad Environmental Protection Ordinance of l< because: 5 a) An Environmental Impact Report (EIR-35) for a prior 6 project on the site was certified by City Council ar a supplement covering the proposed project prepared, 7 8 9 10 11 12 13 14 15 16 b) The adverse impacts identified in said Environmenta: Impact Report will be mi tigated by Conditions of thi approval , previous project approvals on the site, on going local, State and Federal programs, or have bee found to be outweighed by the social and economic benefits of the project. 9) The proposed map conforms to applicable City policies anc dinances dealing with public facilities because: a) The provision of Public Facilities has been assured, meeting City standards concurrent with need, as conc tions of approval of this project and prior project approvals on the site. b) The parks agreement has been met with the previous dedication of land for parks purposes. 17 18 10) The subject property does not front on public waterways, rivers, streams, lakes, reservoirs, coastline or shorelir NOW, THEREFORE, BE IT RESOLVED by the Planning Commissior l9 A) That the above recitations are true and correct. 2o of the City of Carlsbad as follows: 21 22 23 B) That in view of the findings heretofore made and consider ing the appl icable law, the decision of the P1 anning Com- mission is to approve Case No. CT 76-3 subject to the fol i ng condi ti ons : 24 25 26 27 1) Approval of that portion of CT 72-20, adopted by City Council on June 5, 1973 (Resolution No. 3129), included in this approval shall be amended by this approval. 2) The approval is granted for the land described in the application and attachments thereto, and as shor 28 I1 )I -3- 0 0 1 2 3 4 5 6 7 on the plot plan submitted, labeled Exhibit I'B", dated March 9, 1976, except as indicated herein. The final map shall be submitted for approval withit 18 months from the date of final action by the City Council. The final map shall be in substantial con. formance with the tentative subdivision map, Exhibi: "B", except as provided by the development conditior of SP-176. 3) Street names shall be designated in accordance with City Council Policy 20 and shall be approved by the Planning Director prior to approval of the final may 8 9 10 11 12 13 14 4) Lot 115 shall be divided into two lots. The portior labeled "Open Space" shall become Lot 117 as indica1 on Exhibit I'B", dated March 9, 1976, and the remain( designated as Lot 115. An open space easement for i poses of maintenance and improvement shall be grantc to the City of Carlsbad for open space and parks puu poses. Both dedications on Lots 115 and 117 shall c i ~ concurrent with final map recordation. 5) The applicant shall grant to the City of Carlsbad a twenty-foot wide easement for public access over the length of Lot 116, the location of which shall be de termined prior to approval of the final map. 15 16 6) The applicant shall grant an open space easement for maintenance and improvement purposes over the remair of Lot 116 concurrent with final recordation. 17 18 19 20 21 22 23 24 25 26 27 7) Prior to the issuance of any building permits, the a cant shall submit a permanent landscaping and irriga plan to the Parks and Recreation Director for his ap al. The plan shall: a) Cover those slopes at the rear of Lots 1-6, 28- 48-65, 100-102, 115, 116 and the slope at the e side of Lot 41. b) Utilize fire-retardant, drought-resistant land- scaping which includes trees and shrubs which r a variety'of sizes at maturity. ~ c) Utilize an irrigation system appropriate for co mon maintenance of the required landscaping in conformance with Conditions 9, 10 and 11. 8) Concurrent with final map recordation, the applicant shall grant an easement over the slopes to be land- scaped and irrigated in conformance with Condition 7 for the purpose of landscape maintenance. 28 xxxxx -4- Q q 1 2 3 4 5 6 7 8 9) All drainage easements shall be improved by a culvev or drainage channel of adequate size, whichever is 1 quired by the San Diego County Department of Sanital and Flood Control. Where a drainage channel is reql such channel shall be lined with a suitable material specified by the County Department of Sanitation and Flood Control. All easements shall be monumented along property lines at locations approved by the Co Department of Sanitation and Flood Control. An acce easement shall be provided to each drainage system maintenance access point not directly accessible fro a public roadway, said access easement shall be pave and aligned to the satisfaction of the County Depart ment of Sanitation and Flood Control. 9 10 11 12 13 14 l5 of Carlsbad Planning Commission held on May 26, 1976, by the f l6 ing vote, to wit: 10) Additional drainage easements and drainage structure shall be provided or installed as may be required b) the San Diego County Department of Sanitation and Flood Control. 11) All surface waters originating within the subdivisio and all surface waters that may flow onto the subdi- vision from adjacent lands shall be disposed of by a drainage system satisfactory to the County Departmen of Sanitation and Flood Control.
