BETWEEN PALOMAR AIRPORT ROAD AND SOLAMAR MOBILE HOME PARK. OF THE CITY OF CARLSBAD, CALIFORNIA CON- ALLOW THE CONTINUED USE OF A 100-FOOT CASE NO.: CUP-119 APPLICANT: HARRY J. ASHER (OFFSHORE NAVIGATION) 9 10 11 12 13 14 15 16 17 18 19 20 WHEREAS, at said public hearing, upon hearing and consil 21 ing the testimony and arguments, if any, of all persons who 1 22 sired to be heard, said Commission considered all factors re 23 24 WHEREAS, a verified application for a certain property, wit: Portion of Lot H of Rancho Agua Hedionda in the City of Carlsbad, County of San Diego, State of California has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in the place specified in said notice on June 9, 1976; and lating to the Conditional Use Permit. NOW, THEREFORE, BE IT RESOLVED by the Planning Commissi 25 A) That the above recitations are true and correct. 26 of the City of Carlsbad as follows: 27 28 B) That the Planning Commission makes the following findin of fact: 4 * ; jl e @ 1 2 3 1) The requested use is necessary or desirable for the development of the community, is essentially in har mony with the various elements of the General Plan, and is not detrimental to existing uses or to uses specifically permitted in the zone in which the pro use is to be located because: 4 5 a) The activity serves as a good interim use for subject property which would be otherwise tota unused. 6 7 b) The activity has been in continuous use since with no major detrimental effects. 8 ;I c) The site is buffered on three sides by highwag railroad right-of-way. 9 10 2) The site for the intended use is adequate in size 2 shape to accommodate the use because: 11 12 a) Only % of the total site square footage is re- quired to house the transmitting equipment anc accommodate the tower. 13 14 3) All yards, setbacks, walls, fences, landscaping anc other features necessary to adjust the requested uc to existing or permitted future uses in the neighb hood will be provided and maintained because: 15!i 16 17 a) The above are existing on site. b) Conditions of approval will insure maintenanc of the existing landscaping and surrounding a 18 4) The street system serving the proposed use is adeq to properly handle all traffic generated by the pr 19 20 posed use. b) Access from Solamar Drive is available for 21 a) The facility requires no permanent personnel. periodic maintenance. 22 C) That in view of the findings heretofore made and consid 23 the applicable law, the decision of the Planning Commis is to approve CUP-119, subject to the following conditi 24 1) The approval is granted for the land described in 25 application and any attachments thereto, and as sh on the plot plan submitted labeled Exhibit A, date 26 4/22/76. 27 2) The approval will commence on the date of Eesoluti 28 approval and shall be for a 4-year period. ll -2- .- 0 m 1 2 3 4 5 3) 60 days prior to expiration, the Planning Commission will review the CUP. If the Planning Commission wis and the applicant elects to extend the CUP, it may t accomplished by minute motion for a period of the Planning Commission's choice. 4) All of the following existing improvements will rema intact and maintained as required in original approi of the application: 6 a) A navigational beacon on the tower; 7 d) Lighting directed away from surrounding proper1 9 c) Irrigation system; 8 b) Landscaping; 10 11 12 13 14 15 16 e) Conformance to the City of Carlsbad's weed abal program. 5) Within 10 days of final approval, the applicant will submit to the Planning Director a clean-up maintenar schedule, the application will adhere to the schedul as provided. If verified complaints regarding site appearance are received by the Planning Department, the CUP will be placed on the Planning Commission a{ for immediate review and termination if necessary. 6) This CUP is granted to Offshore Navigation Incorpori and is not assignable to others. 17 18 7) That the proper air navigational beacon be installec on the top of the radio antenna. 19 I 20 21 22 23 8) A 10 foot wide landscaped area on the perimeter be planted with dense shrubs and trees for a screening effect. 9) A suitable irrigation system be provided with an au' matic control devise. 10) A plan for said landscaping and irrigation system bt submitted to the Planning Director for approval. 24 ~ 11) All lights within said site be directed so there wi' be no direct light or glare upon adjoining propertic 12) This CUP will be reviewed on September 8, 1976 for ( pliance to conditions regarding landscaping, irriga. and maintenance. 25 26 27 xxxxx 28 xxxxx -3- .i.. . 1 m * 1 PASSED, APPROVED AND ADOPTED at a regular meeting held ot 2 AYES : Commissioners Jose, Dominguez, L'Heureux, Nelsc 4 following vote: 3 June 9, 1976, by the Carlsbad City Planning Commission by the Larson, Dominguez and Jose.
