HomeMy WebLinkAbout1976-07-14; Planning Commission; Resolution 1264.. 0 0 1 RESOLUTION OF THE PLANNING COMMISSION OF 2 PLANNING COMMISSION RESOLUTION NO. 1264 4 MENDING APPROVAL OF THE TENTATIVE MAP RE- 3 THE CITY OF CARLSBAD, CALIFORNIA, RECOM- QUEST FOR A 15-LOT SUBDIVISION ON PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF CHINQUAPIN AVENUE BETWEEN HIGHLAND DRIVE 5 AND ADAMS STREET CASE NO.: CT 76-6 6 7 APPLICANT: JOHN McCOY (CARLSBAD DEVELOP- 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 all persons desiring to speak of the subject request were h 27 At the conclusion of said hearing, after considering all th 28 evidence presented, the Planning Commission made certain fi MENT CORPORATION) WHEREAS, pursuant to the provisions of the Municipal Cc the Planning Commission did on July 14, 1976 hold a duly no1 public hearing to consider a request by John McCoy (Carlsbac Development Corporation); and WHEREAS, a verified application for a certain property, shown on the attached map has been filed with the City of Ci bad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reque! as provided by the "Carlsbad Municipal Code"; and WHEREAS, the applicant has complied with the Public Fac Policy of the City of Carlsbad and has provided the necessal information which ensures Public Facilities will be availab' and current with need; and WHEREAS, the proposed map meets or performs the requirl ments or conditions of the "Carlsbad Municipal Code" or the Subdivision Map Act; and WHEREAS, at said hearing a staff report was presented Q e J. forth. 2 ings and reached a decision on the request as hereinafter SI 3 11 NOW, THEREFORE, BE IT RESOLVED by the Planning Commiss * A. C. That in view of the findings heretofore made and consic ing the applicable law, the decision of the Planning Cc mission is to approve Case No. CT 76-6 subject to the following conditions: 1) The approval is granted for the land described in application and any attachments thereto, and as SI on the plot plan submitted labeled Exhi bit IIB" , di July 8, 1976. The Final Map shall be submitted w' eighteen (18) months from the date of final actio! the City Council on the Tentative Subdivision Map Final Map shall be in substantial conformance wit1 Tentative Subdivision Map, Exhibit I'B". 2) Park-in-lieu fees shall be granted to the City of Carlsbad prior to City Council approval of the Fir Map. 3) In order to provide for reasonable fire protectior ing the construction period, the subdivider shall tain passable vehicular access to all buildings ar adequate fire hydrants with required fire flows SI be installed as recommended by the Fire Departmenl 4) All land and/or easements required shall be grantt the City of Carlsbad without cost to the City, an( of all liens and encumbrances. No easements shal' recorded prior to recordation of the Final Map un' approved by the City Engineer. The developer st. deposit cash in the amount necessary to energize : street lights for an eighteen month period after ( struction, to permit the incorporation of the subc vision into a maintenance district. 6) All land and/or easements required shall be grant€ to the City of Carlsbad without cost to the City, free all liens and encumbrances. No easements sh; be recorded prior to recordation of the final map approved by the City Engineer. 7) The improvement and grading plans shall include a of a geological investigation and a complete gradi plan of the entire site, when required by the Citj Engineer. They shall certify that they have inve: gated the site and prepared data with full considc tion of the consequences to the included and neigt ing properties and in conformance with the Geologi Seismic Safety Element of the General Plan. 8) Applicant shall install half-street improvements i Chinquapin Avenue along the subdivision frontage, according to City of Carlsbad standards. 9) The existing trees on the west property line shall saved where feasible. PASSED, APPROVED AND ADOPTED at a regular meeting held the 14th day of July, 1976, by the Carlsbad City Planning Cc mission by the following vote, to wit: AYES: Commissioners Larson, L'Heureux, Watson, Fikt Nelson, Rombotis and Jose.
