NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio the City of Carlsbad as follows: A. That the above recitations are true and correct. B. That the Planning Commission makes the following finding of fact: 1) The proposed map is consistent with the General Pla because: a) The General Plan designates the site to accomn 0-4 dwell ing units per acre and 4 to 10 dwell i units per acre. The proposed density will fa1 within the allowable densitites. 2) The design or improvement of the proposed subdivisi is consistent with the General Plan because: a) Public facilities will be available concurrent with need. b) The circulation patterns proposed are consistc with the adopted Circulation Element of the Gc Plan. 3) The site is physically suitable for the type of de ment because: a) An Environmental Impact Report (EIR-706) and supplemental information have been certified a previous annexation and tract map applicati for this site. 4) The site is physically suitable for the proposed d of development because: a) Environmental Impact Report (EIR-106) and sup mental information have been certified for th subject location. -2- 0 0 1 2 3 4 5 6 7 5) The design of the subdivision or the imposed improv ments are not likely to cause substantial environme damage or substantially injure fish or wildlife or habitat because: a) Environmental Impact Report (EIR-106) and supp mental information have been certified for the Project. 6) The design of the subdivision or the type of improv ments are not likely to cause serious public health problems because: i 8 I/ 9 10 a) Public services such as sewer and water will t available to the site concurrent with need. b) Pub1 ic health requirements will be met througt standard City design standards. 11 12 13 14 15 16 7) The design of the subdivision or the type of improb ments will not conflict with easements acquired by the public at large for access through, or use of, property within the proposed subdivision because: a) No public easements exist on the property at this time. 8) The subdivision will have no restrictive effects or access to any public waterway, rivers, streams, 1 ai reservoirs, coastline or shoreline because: 17 a) The project does not front on any of the abovt 18 C. The Final Map shall be s! mitted within 18 months from the date of final app by the City Council of the Tentative Subdivision M Final Map being in conformance with Tentative Subd Map, Exhibit ''A". 2) The applicant shall insure adequate noise attenuat for all portions of the site subject to ambient no levels in excess of 65 dB(A). This shall be acco plished in a manner acceptable to the Planning Dir and according to the policies and goals of the Noi Element of the General Plan. ~ -3- 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e 3) Additional right-of-way shall be dedicated and stre improvements made to provide a standard 126-foot st section with separate bikeway for El Camino Real, f Alga Road to Arenal Road. 4) Arenal Road shall be dedicated and improved on the basis of a full 84-foot street section with separat bikeway, in conformance with the Circulation Elemen of the General Plan. Improvements shall be constru from El Camino Real to the rear lot line of the lot the west side of the Street 'IC" intersection. Dedi tion shall be for entire Alga Road within the subdi sion boundary, and applicant shall provide offsite street right-of-way where the street overlaps the s boundary of the subdivision. 5) A four-way, fully actuated traffic signal with left turn pockets shall be installed at the intersectior Alga Road and El Camino Real. City will attempt tc cure reimbursement for the developer by agreements the surrounding or abutting developers. 6) Dedication of Arenal Road shall include a waiver 01 direct access rights from all lots shown on the fir map as abutting thereon. 7) Two 15-fOOt wide public easements for pedestrian/ec trian use shall be dedicated between the most westc North-South street and the 150 foot SDG&E easement, 8) Phase I, IV and V abutting El Camino Real will coni to the Landscape and Irrigation Plan submitted labt Exhibit "B", dated July 14, 1976. 9) Street trees should be selected by the Parks and Rc ation Department, in conjunction with the Landscapc architect, on all streets. 10) Landscape and irrigation plans shall be submitted . approval by the Director of Parks and Recreation. 11) Hydroseed mix will be approved by the Parks and Re1 ation Department and also proof of plant specie ani quality of seed shall be submitted for approval. 12) All banks hydroseeded shall have a soil analysis t no closer than 500' or farther than 1000' apart an' said analysis will show a minimum of nitrogen, pho phorus and potassium, E.C., Ph., and organic compo 13) Park fees in lieu of land shall be paid to the Cit Carlsbad for park purposes as required by the Subd Ordinance and Parks and Recreation Element prior t approval of each Final Map. The applicant shall dedicate an open space easement along the bank at the rear of lots backing up to El Camino Real. All areas of the subdivision shall be designated as legal lot or public right-of-way. The method of storm drainage shown on the map is no approved. Storm drainage shall be designed per the requirements of the City Engineer and San Diego Cou Flood Control District. All drainage easements shall be improved by a culve drainage channel of adequate size, whichever is req by the San Diego County Department of Sanitation & Control. Where a drainage channel is required, SUC channel shall be lined with a suitable material as fied by the County Department of Sanitation and Flc Control. An access easement shall be provided to E drainage system maintenance access point not direct accessible from a public roadway, said access easerr shall be paved and aligned to the satisfaction of t County Department of Sanitation & Flood Control anc City Engineer. Additional drainage easements and drainage structur be provided or installed as may be required by the Department of Sanitation and Flood Control and/or t City Engineer. A desilting basin, within an adequate easement, anc signed to the satisfaction of the County Department Sanitation and Flood Control will be required at tk let of the major drainage facility. In order to provide for reasonable fire protection ing the construction period, the subdivider shall n tain passable vehicular access to all buildings, ar adequate fire hydrants with required fire flows shi installed as recommended by the Fire Department. All public improvements shall be made in conformit? the City of Carlsbad Engineering Design Criteria ar Standard Plans, the Subdivision Ordinance and othe! Standards to the satisfaction of the City Engineer out cost to the City of Carlsbad, and free of all - and encumbrances. All utilities, including provisions for cable TV, s be placed underground and/or shall be completely co cealed from view. All land and/or easements required by this Ordinanc shall be granted to the City of Carlsbad without co to the City and free of all 1 iens and encumbrances. Street names shall be designated in accordance with adopted City Street Name Policy and shall be approv by the Planning Director prior to Final Map approva If required by the City Engineer, the improvement p shall include a report of a geological investigatio and a complete grading plan of the entire site. Th report and plan shall be prepared by civil engineer licensed by the State of California, and experience in erosion control who shall be acceptable to the C Engineer, and they shall certify they have investig the site and prepared data with full consideration the consequences to the included and neighboring pr ties. The development of the property described herein sk be subject to the restrictions and limitations set forth herein which are in addition to all the requi ments, limitations and restrictions of all municipz ordinances and State and Federal statutes now in fc or which, hereafter, may be in force, for the purpc of preserving the residential characteristics of ac cent properties. Prior to consideration of each Final Map and Impro\ ment Plan, a grading and plot plan of the tract wil all proposed dwelling units located thereon, and st ing appropriate setback dimensions, shall be submil to the Planning Department for approval to insure 1 adequate area requirements can be met. All land and/or easements required shall be grantec the City of Carlsbad without cost to the City, and of all liens and encumbrances. No easements shall recorded prior to recordation of each final map un- approved by the City Engineer.
