HomeMy WebLinkAbout1976-08-11; Planning Commission; Resolution 1266w ii e b 1 PLANNING COMMISSION RESOLUTION NO. 1266 2 3 4 5 6 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RE- LATIVE TO REZONING PROPERTY FROM R-1 TO R-2 ON PROPERTY LOCATED ON THE NORTH SIDE OF CHESTNUT AVENUE BETWEEN ADAMS STREET AND EUREKA STREET APPLICANT: JAMES B. MAGUIRE, JR. ~ CASE NO. : ZC-181 i 7 11 8 9 WHEREAS, a verified application for a certain property, shown on the attached map has been filed with the City of lo Carlsbad and referred to the Planning Commission; and =I ll WHEREAS, said verified application constitutes a reques 12/j as provided by Title 21 of the "Carlsbad Municipal Code"; an 13 11 WHEREAS, the public hearing to consider the subject rei 14 15 ing was held at the time and in the place specified in said notice on August 11 , 1976; and 16 17 18 19 20 21 22 23 WHEREAS, the subject application has complied with the quirements of the City of Carlsbad "Environmental Protectior Ordinance of 1972"; and WHEREAS, at said public hearing, upon hearing and cons ing the testimony and arguments, if any, of all persons wh desired to be heard, said Commission considered all factors lating to the Zone Change and found the following facts and reasons to exist: '*I/ 1) The zone change is consistent with the General Plan be 25 26 ' 27 28 a) The General Plan Land Use Plan Map shows the pror as RM-Residential Medium Density, 4-10 dwelling L per acre. b) The zone change will have no adverse affect on a1 element of the General Plan. " e * 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 2) The zone change is consistent with the Carlsbad Environr Protection Ordinance of 1972 because: a) A Negative Declaration has been issued for the fol' ing reasons: 1) The property is an individual lot in an urban, area. 2) No significant alteration of topography or vel tation will result. 3) No significant increase in traffic will occur 3) The proposed zone change is consistent with applicable City Public Facilities Policies and Ordinances because: a) Street improvements exist on Chestnut Avenue. b) Utility systems are available to the site without pansi on. c) The medium density area will be close to public su systems. NOW, THEREFORE, BE IT RESOLVED by the Planning Commissi of the City of Carlsbad as follows: A) That the above recitations are true and correct. 9) That the Zone Change from R-1 to R-2 is recommended for approval. PASSED, APPROVED AND ADOPTED at a regular meeting of tl City of Carlsbad Planning Commission held on August 11, 197f the following vote, to wit: AYES: Commissioners Watson, Fikes, Larson, Jose an L'Heureux. NOES: Commissioner Rombotis. ABSENT: Commi ssioner Ne1 son. ABSTAIN: None -2-
