HomeMy WebLinkAbout1976-09-08; Planning Commission; Resolution 12707- " ,e 0 I I/ PLANNING COMMISSION RESOLUTION NO. 1270 2 3 4 5 6 7 RESOLUTION OF THE PLANNING COMMISSION OF MENDING TO THE CITY COUNCIL ADOPTION OF ELEMENT TEXT AND LAND USE PLAN OF THE GENERAL PLAN THE CITY OF CARLSBAD, CALIFORNIA, RECOM- GPA-42, MINOR AMENDMENTS TO THE LAND USE WHEREAS, the Plannning Commission did on the 8th day of : 8 9 ember, 1976, hold a duly noticed pub1 ic hearing as prescribed law to consider amendments to the General Plan making minor an 10 11 12 13 14 15 16 17 18 1 ments and additions to the Land Use Element Text and Land Use and WHEREAS, the subject General Plan Amendments have complit with the requirements of the City of Carlsbad Environmental P1 tection Ordinance of 1972; and WHEREAS, at said public hearing, after the testimony and guments of all persons who desired to be heard, said Commissic considered all the factors relating to the General Plan Amend1 and found the following facts and reasons to exist: 19 11) The present classification of "Travel Services and Traff 20 21 22 23 24 25 26 Dependent Commercial" describes two dissimilar types of land use; 2) The present locations of the 'ITS" designation on the Lan Plan are appropriate for the "Travel Service" uses but n for the "Traffic Dependent" uses; 3) There is not a need for a separate "Traffic Dependent" c fication since the uses under this category can appropri be located within other commercial designations; 4) It is unnecessary and inappropriate to have the entire n west corner of Interstate-5 and Palomar Airport Road des as 'ITS" becuase there are existing uses that do not fit 'ITS" designation; and 27 28 5) These amendments will not adversely affect the environme because: "- * w 1 2 3 4 5 6 a) The change to the text simply eliminates inconsisten and confusing wording from the definition of the "Travel Service" commercial classification. b) The change of designation on the two (2) acre parcel will not affect existing uses. c) Both changes are generally of an administrative natu and will have a minimal effect on the physical and human environment. 7 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission 8 9 of the City of Carlsbad as follows: A) That the above recitations are true and correct. 10 11 12 13 14 15 16 B) That the following amendments and additions to the General Plan are recommend to the City Council for approval : 1) Change the full title of the 'ITS" category in both the text and ,plan from "Travel Service an( Traffic Dependent Commercial" to "Travel Servic Commerci a1 I' ; I 2) Delete the present definition of "Traffic Deper dent Commercial'' (Subcategory 2) and retain thl present definition of "Travel Service Commerci (Subcategory 1); 17 3) Designate on the plan "RS" (Regional Service) 18 as the land use for the 1.7 acre area located of Palomar Airport Road. between Avenida Encinas and Interstate 5, nort 19 20 21 22 23 Nelson, Rombotis and Jose. 24 NOES: None 25 ABSENT: None PASSED, APPROVED AND ADOPTED at a regular meeting of the Planning Commission held on September 8, 1976 by the followin vote, to wit: AYES: Commissioners Larson, L'Heureux, Watson, Fikes 26 27 ABSTAIN: None Aa tk 28 Donald A.
