RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, DENYING A PLANNED UNIT DEVELOPMENT PERMIT FOR 171 APARTMENT UNITS ON PROPERTY LOCATED ON THE SOUTHWEST CORNER OF MARRON ROAD AND AVENIDA DE ANITA.
APPLICANT: GEORGE BILLINGS CASE NO. : PUD-1

WHEREAS, a verified application for a certain property, '
wit:
That portion of Lot 'IJ" of Agua Hedionda, according to the Map thereof No. 823, filed in the Office of the County Recorder of San Diego County, November 16, 1886 AND of Lots 3, 4 and 5 in Section 32, Town-
ship 11 South, Range 4 West, San Bernardino Base and Meridian, according to United States Government survey, all being in the City of Carlsbad, County of San Diego, State of California l4l1 has been filed with the City of Carlsbad and referred to the 1511 Planning Commission; and

provided by Title 21 of the "Carlsbad Municipal Code"; and 17'
WHEREAS, said verified application constitutes a request

WHEREAS, the public hearing was held at the time and in 18
the place specified in said notice on September 22, 1976 and I 20/l continued to October 13, 1976; and
21 WHEREAS, at said public hearing, upon hearing and consid

would significantly be below pad elevation of the develop ment and therefore parking would not be functional.,

5 yet been adequately solved on Marron Road and El Camino R
6 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission

the City of Carlsbad as follows:
A) That the above recitations are true and correct.

B) That a Planned Unit Development Permit is denied to alloh 171 apartment units on property located on the southwest corner of Marron Road and Avenida de Anita.
PASSED, APPROVED AND ADOPTED at a regular meeting of the
City of Carlsbad Planning Commission held on October 13, 1976
the following vote, to wit:
AYES: Commissioners Nelson, L'Heureux, Larson and Jos
NOES: Commi ssi oner Fi kes.
ABSENT: Commissioner Watson.
ABSTAIN: Commissioner Rombotis.
