RESOLUTION OF THE PLANNING COMMISSION OF
MENDING APPROVAL OF THE TENTATIVE MAP
MINIUM PROJECT ON PROPERTY LOCATED ON THE WEST SIDE OF JEFFERSON BETWEEN LAGUNA AND BUENA VISTA.
APPLICANT: JOHN McKEAND

1) The proposed map is consistent with the General Plan because:
a

a) The Land Use Element designates the area for Residential Medium-High density (10-20 dwelling units per acre). Thc project provides 7 dwelling units per acre.

with the General Plan because:

a) The project wi 11 provide orderly residential development and

b) The project will not cause excessive expansion of public facilities and/or expense to the taxpayer.
3) The site is physically suitable for the type of development bl cause:
a) The parcel has sufficient flat area with no significant vegetation to accommodate the proposed structures within ordi nance requirements.
4) The site is physically sui table for the proposed density of development because:
a) Clustering the dwelling units allows for reduced land coverage and elimination of interference with the existi i bank or mature vegetation; and

b) The dwelling units requested are fewer per acre than a1 1 by the General P1 an.

5) The design of the subdivision or the imposed improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or thei habitat because:
a) A negative declaration has been issued based on the foll
ing findings:

3) The site is surrounded by urbanization.
6) The design of the subdivision or the type of improvements are ' 1 ikely to cause serious public health problems because:
a) Conditions of approval will insure the above.
7) The design of the subdivision or the type of improvements will not confl ict with easements required by the publ i c at 1 arge fc access through or use of, property within the proposed subdivi because:
a) Conditions of approval will insure necessary easement ser access.
8) The subdivision will not prohibit reasonable access to public ways y rivers , streams , lakes y reservoirs , coast1 ines or shore' because:
a) No publ i c access was available over the subject property the previous land use (single-family residence).
b) The subject property does not legally front on any of th above.
That in view of the findings heretofore made and considering the al; law, the decision of the Planning Commission is to approve CT 76-16 to the following conditions:
1 ) The approval is granted for the land described in the appl icz and any attachments thereto and as shown on the Plot Plan sut labeled Exhibit A, dated 10/5/76. The location of all roadwz parking areas y landscaping and other facilities or features z be located substantially as shown on the plot plan 1 abeled E: A, except or unless indiated otherwise herein.
2) Final Map shall be completed within 18 months from the date 1 City Council action on the Tentative Map. Two extensions of year each may be approved by City Council upon staff review 1 original decision.
3) All publ ic improvements shall be made in conformity with the Subdivision Ordinance and other City standards to the satisf of the City Engineer, without cost to the City of Carlsbad a of all liens and encumbrances.
4) In order to provide for reasonable fire protection during tf construction period, the subdivider shall maintain passable vehi.cular access to all buildings , and adequate fire hydrant
with required fire flows shall be installed as recommended t the Fire Department.

encumbrances. No easements shall be recorded prior to recorda tion of the final map unless approved by the City Engineer.
6) The improvement and grading plans shall include a report of a geological investigation and a complete grading plan of the entire site, when required by the City Engineer. The report and Plan shall be prepared by civil engineers licensed by the State of California and experienced in erosion control, who shall be acceptable to the City Engineer. They shall certify that they have investigated the site and prepared data with fl consideration of the consequences to the included and neighbor ing properties and in conformance with the Geologic and Seism. Safety Element of the General Plan.
7) Storm drainage collected within the improved surface of the pi condominium shall be directed to the lagoon through a closed ( duit drainage system equipped with a silt trap.
8) The applicant shall dedicate land adjacent to Buena Vista Lagc per Ordinance 9190 and the Parks and Recreation Commission.
9) Prior to recordation of the final map, reciprocal easements s~ be recorded to protect the joint use of a 24 foot wide drivewl strip between the owners of the lot and the northerly adjacen' lot.

10) An onsi te fire hydrant shall be instal 1 ed, as required by the Fire Marshal 1 , and served by a pub1 ic water1 ine extension app by the City Engineer. A 12 foot public waterline easement sh be dedicated on the final map. Meters for domestic and lands irrigation water shall be installed at the end of the waterli extension.
11) The existing driveway opening in the lot frontage shall be re moved and a 24 foot driveway opening shall be installed, acco ing to City of Carlsbad standards, at the entrance to the pro joint driveway.

13) A landscape and sprinkler system plan shall be submitted to t Parks and Recreation Director for evaluation and approval pri to recordation of the Final Map.
