TAMARACK AVENUE BETWEEN JEFFERSON STREET 5 PROPERTY LOCATED ON THE NORTH SIDE OF FORTY APARTMENTS IN FIVE BUILDINGS ON 4 SPECIFIC PLAN 20 TO ALLOW DEVELOPMENT OF MENDING APPROVAL OF AN AMENDMENT TO 3 THE CITY OF CARLSBAD, CALIFORNIA, RECOM- RESOLUTION OF THE PLANNING COMMISSION OF 2 PLANNING COMMISSION RESOLUTION NO. 1295 7 8 9 LO WHEREAS, a verified application for a certain property, as shown on attached map has been filed with the City of Carlsbad and referred to th 11 12 13 14 15 16 17 18 19 20 21 22 23 24 P1 anni ng Commission ; and WHEREAS, said verified application constitutes a request as provide Title 21 of the "Carlsbad Municipal Code" ; and WHEREAS y the pub1 ic hearing was held at the time and in the place 5 fied in said notice on November 8, 1976; and WHEREAS , at said Pub1 i c Hearing y upon hearing and considering the testimony and arguments, if any, of a1 1 persons who desired to be heard Commission considered all facts relating to the Specific Plan found the ing facts and reasons to exist: 1 ) The proposed Specific Plan Amendment is consistent with the Genera because: a) The Land Use Plan Map of the General Plan shows the subject property as RMH (Residential Medium-High Density y 10-20 dwelling units per acre). The proposed project will provide 16.2 dwelling units per acre. 2) The proposed Specific Plan Amendment is consistent with the City of Carlsbad Environmental Protection Ordinance of 1972 because: 25 26 a) A negative declaration has been issued for the project based 27 28 on the following findings: 1) There is no significant vegetation or land form to be impacted by the development; and 2) The site is surrounded by urbanization. " 0 e 1 2 3) The proposed Specific Plan Amendment conforms to applicable City policies and ordinances dealing with public facilities because: 3 4 a) Conditions of approval will insure the above. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the Cit 5 6 7 8 of Carl sbad, as follows: A) That the above recitations are true and correct. B) That an Amendment to Specific Plan 20 is approved to a1 low developme of 40 apartments in 5 buildings on property located on the north si(. of Tamarack Avenue between Jefferson Street and Hibuscus Circle, an( subject to the following conditions: 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 ) SP-20 as adopted by City Counci 1 Ordinance No. 9302 shall be rescinded. 2) The approval is granted for the land described in the appl i cat, and attachments thereto, and as shown on the plot plan submittc labeled Exhibit Cy dated 10/26/76. The location of all lots, 1 ways and other features shall be located substantially as show1 the plot plan labeled Exhibit Cy except or unless indicated otl wise herein. 3) In the event that the currently anticipated 34 feet of dedicat on Tamarack Avenue is not required at the time of bui 1 ding per issuance, and the required dedication is not over 10 feet, thc approval herein wi 11 apply to the plot plan 1 abeled Exhibit D! dated 10/26/76. Minor changes may be approved by the Planniy Director to accommodate approved dedication that may affect ti pl an. 4) The applicant shall submi t a permanent landscape and irrigatic plan to the Park and Recreation Director prior to issuance of bui 1 ding permi ts . 5) In order to provide for reasonable fire protection during the construction period, the subdivider shall maintain passable vehicular access to all buildings and adequate fire hydrants with required fire flows shall be installed as recommended by Fire Department prior to combustible materials on site. 6) The applicant shall process an adjustment plat to consolidate the two lots within the specific plan boundary. One of the conditions of.'approval of the adjustment plat will be that th owner offer to dedicate 34 feet along the Tamarack Avenue fro including a 20 foot radius segment at the intersection of Taw and Jefferson, and execute a lieu contract agreement for futu improvement of Tamarack Avenue on the basis of half street se 7) If onsi te public fire hydrants are required by the Fire Marsh they shall be served by pub1 ic water1 ine extensions approved the City Engineer, and 12 foot waterline easements shall be dedicated. 11 -2- - 1 2 3 4 5 6 * m 8) The existing school wal kway y or an acceptable paved a1 ternate walkway, shall be maintained during construction. 9) The developer shall enter into a secured agreement with the City to contribute to the cost of a traffic signal at the intersection of Tamarack and Jefferson Streets according to su a traffic signal policy as the City Council may adopt. 10) A six foot high masonry wall shall be constructed along the no and west boundaries of the property prior to the issuance of occupancy permits. 7 PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Car 8 9 P1 anni ng Commission he1 d on November 8 y 1976 , by the fol lowing vote y to w 10 AYES : Commissioners Rombotis, Watson, Fikes, and Jose.
