' II m 0 I j/ PLANNING COMMISSION RESOLUTION NO. 1297 2 3 4 5 6 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOM- MENDING APPROVAL OF THE TENTATIVE MAP RE- QUEST FOR A 211-LOT SUBDIVISION ON PROPERTY LOCATED ON THE EAST SIDE OF RANCHO SANTA FE ROAD BETWEEN LA COSTA AVENUE EXTENSION AND OLIVENHAIN ROAD. APPLICANT: LA COSTA LAND COMPANY CASE NO.: CT 75-9 7 11 8 ncticed public hearing to consider a request by La Costa Land 10 the Planning Commission did on November 22, 1976, hold a duly 9 WHEREAS, pursuant to the provisions of the Municipal Codc 11 Company; and 12 WHEREAS, a verified application for certain property, to 13 14 Assessor's Book No. 223 , Page 060, ParCdS 7 , 9 10 and 11; Assessor's Book No. 223, Page 220, Parcel 39 15 by the "Carlsbad Municipal Code"; and 18 WHEREAS, said application constitutes a request as provic 17 Planning Commission; and l6 has been filed with the City of Carlsbad and referred to the 19 ~ WHEREAS, the applicant has complied with the Public Faci' 2o formation which ensures Public Facilities will be available cc 21 Policy of the City of Carlsbad and has provided the necessary 23 current with need; and 22 WHEREAS, the proposed map meets or performs the requiremc 24 or conditions of the "Carlsbad Municipal Code" or the Subdivi: 25 Map Act; and 26 WHEREAS, at said hearing, a staff report was presented at 27 all persons desiring to speak of the subject request were heal 28 At the conclusion of said hearing, after considering all the f I, m 0 '11 evidence presented, the Planning Commission made certain find- 2 3 and reached a decision on the request as hereinafter set forti 6 5 the City of Carlsbad as follows: * NOW, THEREFORE, BE IT RESOLVED by the Planning Commissior A) That the above recitations are true and correct. B) That the Planning Commission makes the following finding' 7 fact: 8 ( 1 ) The proposed map is consistent with the General Plan because: 9 10 11 12 (a) The project density of 3.0 dwellings per acre conforms with the Land Use Element designation of Residential Low-Medium density (0-4 dwellings per acre) ; and (b) The project does not conflict with any Element of the General P1 an. 13 14 (2) The design or improvement of the proposed subdivision is consistent vided as required by the Public Facilities Element and City 15 with the General Plan because: (a) Sewer , water , street and other pub1 i c faci 1 i ties wi 11 be pro- Pol icy. 16 17 18 19 20 21 22 23 24 25 26 27 28 (3) The proposed map is consistent with the La Costa Master Plan because (a) The design of the project is consistent with the R-1-7500 devel ment standards approved in the Master Plan; and (b) The dedication of the High School site denoted in the Master P1 has been made a condition of approval. (4) The site is physically sui table for the type of development because: (a) The subdivision has been designed recognizing the natural slopes and soil constraints of the site. (5) The proposed subdivision has complied with the requirements of the Carlsbad Environmental Protection Ordinance through Prior Compliance (Section 19.04.153) because: (a) An Environmental Impact Report (EIR-307) was prepared for amendments to the La Costa Master Plan and certified by City Council April 27, 1976; (b) A supplement to that EIR has been prepared for the proposed project in conformance with the requirements of the Master EIR; // -2- ? 9 1 2 3 4 (c) A report, Archaeological Investigations at Santa Fe Knolls has been accepted which mitigates the impacts of the proposed proje on the archaeological resources of the project site; and (dl There are no substantial changes in the proposed project which have not been adequately addressed by the Master or Supplementa EIR's. I 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 (6) The design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage or substantially and unavoidably injure fish or wildlife or their habitat because: (a) The adverse Environmental Impacts identified in the Environ- mental Impact Report prepared for the La Costa Master Plan , and its Supplement , have been mi tigated by the conditions of approv, of the subdivision map. (7) The design of the subdivision or the type of improvements are not 1 i kely to cause serious publ ic health problems because: (a) Conditions of approval will ensure the above. (8) The design of the subdivision or the type of improvements will not conflict with easements required by the public at large for access through or use of property within the proposed subdivision because: (a) Conditions of approval wi 11 ensure necessary easement service access. (9) The subdivision wi 11 not prohibit reasonable access to publ i c water- ways, rivers, streams, lakes, reservoirs, coastlines or shorelines because : (a) No such public areas exist within or adjacent to the project si' C) That in view of the findings heretofore made and considering the appl law, the decision of the Planning Commission is to approve CT 75-9 si to the following conditions: (1) The approval is granted for the land described in the application and attachments thereto , and as shown on the plot plan submitted, 1 abel ed Exhibit "A" , dated November 16, 1976 , except as indicated herein. The final map shall be submitted for approval within eightec months from the date of final action by the City Council , and shall t in substantial conformance with the tentative subdivision map, Exhibi "A" . (2) Street names shall be designated in accordance with City Council Pol icy 20 and shall be approved by the Planning Director prior to approval of the final map. (3) Concurrent with final map approval , the applicant shall grant an open space easement for maintenance and improvement purposes over those portions of those lots described in Condition 5 below. I I! -3- 0 e 1 (4) 2 3 4 5 (5) 6 7 8 9 10 11 12 Prior to the issuance of grading permits, the City Engineer shall approve a plan submi tted by the applicant for interim erosion contro' on all man-made slopes in excess of five feet created by this sub- division. Prior to this issuance of grading permits, the applicant shall post bonds and agreements ensuring the installation and main- tenance of the erosion control system until permanent landscaping is installed and maintained. Prior to the issuance of any building permits , the applicant shall submit a permanent landscaping and irrigation plan to the Parks and Recreation Director for his approval. The plan shall : (a) Cover those slopes at the rear of lots 2-19 , 44-48, 169-1 74 , 193, 194, 200-211, and the sides of lots 44, 58, 74, 121-122, 154, 160, 174-175, 185, 198, and 211; (b) Utilize fire-retardant, drought-resistant landscaping which in- cludes trees and shrubs which reach a variety of sizes at maturity; and (c) Utilize an irrigation system appropriate for common maintenance of the required landscaping in conformance with conditions 6, 7- & 8. 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ' (6) Permanent landscaping and irrigation shall be installed on all lots identified in Condition 5(a) before any of those lots are occupied. If residential construction occurs in units, this condition shall be met on a unit-by-unit basis. (7) Prior to the issuance of building permits , the provision of permanenl open space maintenance on those areas as indicated in Condition 5 shc be assured to the satisfaction of the Planning Director. Such maintc may be assured by the formation of an Open Space Maintenance Districl Homeowners' Association, or similar institution suitable for commonlj maintaining open space. (8) Vegetation clearing operations shall be made no more than 2 weeks in advance of grading. (9) No grading shall occur during the months of January through March, except when special measures can be taken to control si 1 tation. This condition shall be met to the satisfaction of the City Engineer. (1 0) A1 1 graded surfaces shall be watered and roll ed to form a compacted cap of soi 1. (1 1 ) Concurrent with final map recordation the applicant shall dedicate Area "A" to the City of Carlsbad as shown on Exhibit "A" dated Novem- ber 16, 1976, for park purposes. The park site so dedicated shall be 12.5+ acres in size, and its precise boundaries approved by the City Council prior to final map approval. (12) The water system shall be looped from Rancho Santa Fe Road, to Missio Estancia, to La Costa Avenue; and back to Rancho Santa Fe Road. -4- 9, I. e 0 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1 (13) The water system, serving lots 1-30, as shown on Exhibit "AI' dated November 16, 1976 , shall be looped from "A" Street to "Bll Street to Mission Estancia. (14) All drainage easements shall be improved by a culvert or drainage channel of adequate size, whichever is required by the San Diego County Department of Sanitation and Flood Control. Where a drainagc channel is required, such channel shall be lined with a suitable material as specified by the County Department of Sanitation and .Flood Control. A1 1 easements shall be monumented along property lines at locations approved by the County department of sanitation and Flood Control . An access easement shall be provided to each drainage system maintenance access point not directly accessible frc a public roadway, said access easement shall be paved and aligned tc satisfaction of the County Department of Sanitation and Flood Contrc (15) Additional drainage easements and drainage structures shall be prov- or installed as may be required by the San Diego County Department c Sanitation and Flood Control. (16) All surface waters originating within the subdivision and all surfac waters that may flow onto the subdivision from adjacent lands shall be disposed of by a drainage system satisfactory to the San Diego County Department of Sanitation and Flood Control. (17) That portion of Exhibit "A" , dated November 16, 1976, 1 abeled High School site, shall be included within the boundaries of the final subdivision map. Compliance with this condition shall not be requil if the San Dieguito Union High School District does not enter into a binding commitment with the applicant to accept the dedication. (18) If requested by the City Engineer, an amended Tentative Map shall bc submitted for approval by the City Engineer prior to review of the final map to assure compliance with all conditions of approval. (19) The location of fire hydrants shall be approved by the Fire Marshal' In order to provide for reasonable fire protection during the con- struction period, the subdivider shall maintain passable vehicular access to a1 1 buildings and adequate fire hydrants with required fire flows shall be in service and accessible prior to the location of combustibles on site. (20) Ornamental street lighting shall be provided for as required by Mun cipal Ordinance. The developer shall deposit cash, in the amount necessary to energize said street lights, for an eighteen month period after construction to permit the incorporation of the sub- division into a maintenance district. (21) A1 1 land and/or easements required shall be granted to the City of Carlsbad, without cost to the City, and free of all liens and en- cumbrances. No easements shall be recorded prior to recordation of the final map unless approved by the City Engineer. ~ -5- I. 0 0 1 2 3 4 5 (22) The improvement and grading plans shall include a report of geologic; investigation and a complete grading plan of the entire site, when required by the City Engineer. The report and plan shall be preparec by civil engineers licensed by the State of California, and experienc in erosion control, who shall be acceptable to the City Engineer. They shall certify that they have investigated the site and prepared data with full consideration of the consequences to the included and neighboring properties and in conformance with the Geologic and Seis- mic Safety Element of the General Plan. 6 (23) Mission Estancia right-of-way, including slope easements, shall be dedicated and graded on the basis of an 84 foot street section from Avenue, Mission Estancia shall be improved on the basis of a 24 foot street Mission Estancia shall be improved on the basis of a 42 foot half str 11 proposed La Costa Avenue. 12 Improvements shall be as shown on the tentative map, except that street lights shall be included according to City of Carlsbad standar and all slopes adjacent to the street shall be 2: 1 maximum. 13 14 dedicated and La Costa Avenue shall be graded on the basis of an 15 84 foot street section and improved on the basis of a 42 foot half street section from Rancho Santa Fe Foad to the intersection with proposed Mission Estancia. These man-made slopes may be increased to grade of 2.00:l upon approval of the San Dieguito Unified High Schoo District.
