RESOLUTION OF THE PLANNING COMMISSION OF
ING A MINOR SUBDIVISION WITH THREE LOTS
(ONE OF THEM BEING A PANHANDLE LOT) ON
SON STREET BETWEEN fOREST AVENUE AND
BUENA VISTA WAY.
APPLICANT: MR. AND MRS. ROBERT GILLINGHAM
THE CITY OF CARLSBAD, CALIFORNIA, APPROV-
PROPERTY LOCATED ON THE EAST SIDE OF WIL-
CASE NO.: MS-285
WHEREAS, a verified application for a certain property,
wit:
The southwesterly 211 feet of Lot 15 of Wilsonia Tract, per Map 2169, filed in the Office of the County Recorder of San Diego County, August 13,
1929
has been filed with the City of Carlsbad and referred to the
Planning Commission pusuant to Title 21 , Section 21.10.080 fo
a panhandle lot.
WHEREAS, said verified application constitutes a request
provided by Title 21 of the "Carlsbad Municipal Code"; and
WHEREAS, a hearing was held by the Planning Commission o
November 22, 1976; and
WHEREAS, at said hearing, upon hearing and considering t
testimony and arguments, if any, of all persons who desired t
heard, said Commission considered all factors relating to the
panhandle lot and found the following facts and reasons to ex
1) The property cannot be served adequately with a public s
without panhandle lots due to unfavorable conditions res
ing from unusual topography, surrounding land developmen
or lot configuration because:
a) The subject lot contains the square footage to prov
three lots under current zoning requirements, howev
the lot does not contain the necessary lot frontage
provide 60 feet of frontage for these lots.

b) The location of the parcel within the block would not afford a possible future East/West through street, because the parcel is too close to Forest Street.
2) Subdivision with panhandle lots will not preclude or adv ly affect the ability to provide full public street acce to other properties within the same block of the subject property because:
a) A possible future East/West street slignment would require a more central location within the subject parcels block.
3) Development standards for panhandle lots under Section 21.10.080(d) are met because:
a) The panhandle portion of the subject lot exceeds 10,000 square feet.
b) The narrowest portion of the subject lot is greater than the minimum width required.
c) The location of the proposed residence, as shown on the submitted plot plan conforms to the yard requir ments for interior lots in R-1-7500 zones.
d) The panhandle portion of the subject lot does not e 150 feet in length and is not less than 20 feet in width.
e) A 14 foot improved driveway is proposed, and shown submitted plot plan.
f) Adequate drainage is provided.
g) Three non-tandem parking spaces are proposed, with foot back-up space as shown on the submitted plot p
h) A condition of approval will ensure that structures the access portion of the subject lot shall be limi to mail boxes, fences, trash enclosures, landscape tainers and name plates. Except for mail boxes, th structures shall not be greater than forty-two inch in height if located within twenty feet of the stre property line or greater than six feet in height be yond this point.
i) A condition of approval will ensure that the proper owner shall agree to hold the City or any other put: service agency harmless from liability for any dama to the driveway when being used to perform a public service.

1 NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio

of the City of Carlsbad as follows:
A) That the above recitations are true and correct.

B) That a Minor Subdivision with three lots (one of them be a panhandle lot) on property located on the east side of Wilson Street between Forest Avenue and Buena Vista Way be approved subject to the following conditions:
1) Approval is granted for the land described in the applic and attachments thereto, and as shown on the plot plan s mitted, labeled Exhibit A, dated November 9, 1976. The cation of all buildings, roadways, parking and other fac ties shall be located substantially as shown on the plot plan labeled Exhibit A, except as otherwise indicated he

2) All required fees and deposits shall be paid prior to fi

5) All utilities installed as part of any proposed construc shall be completely underground.
