HomeMy WebLinkAbout1976-12-08; Planning Commission; Resolution 1302& -. - w, e * I /I PLANNING COMMISSION RESOLUTION NO. 1302 2 3 4 5 6 7 a 9 RESOLUTION OF THE PLANNING COMMISSION OF ING AMENDMENTS TO ORDINANCE NO. 9447 OF VALLEY KNOLLS DEVELOPMENT, TO PROVIDE FOR 18 LOTS ON APPROXIMATELY 7 ACRES ON PROPERTY BORDERED BY EL CAPIINO REAL ON THE WEST, LEVANTE STREET ON THE SOUTH AND MENT ON THE EAST. APPLICANT: LA COSTA LAND COMPANY THE CITY OF CARLSBAD, CALIFORNIA, CONCERN- THE SPECIFIC PLAN (SP-171) FOR THE GREEN A SAN DIEGO GAS AND ELECTRIC POWER EASE- CASE NO.: SP-171 (A) 10 /I WHEREAS, a verified application for a certain property, a 11 11 shown on the attached map has been filed with the City of Carl 12 13 14 15 16 17 and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in i place specified in said notice on December 8, 1976; and WHEREAS, at said Public Hearing, upon hearing and considc 18 19 the testimony and arguments, if any, of all persons who desirc to be heard, said Commission considered all facts relating to 20 11 the Specific Plan Amendment, found the following facts and ret 21 22 to exist: 1) The proposed Specific Plan Amendment is consistent 1 the General Plan because: 23 24 25 I a) The Land Use Plan Map of the General Plan show the subject property as Residential Medium-Hig Density (10-20 dwelling units per acre). The Specific Plan Amendment would provide 2.5 dwel units per acre. 26 27 2) The proposed Specific Plan Amendment is consistent the adopted Master Plan because: 28 a) A La Costa Master Plan partial amendment was a by City Council Ordinance 9469 (Nov. 2, 1976) accommodate the subject proposal. A w m 1 of 1972 because: 2 3) The proposed Specific Plan Amendment is consistent w the City of Carlsbad Environmental Protection Ordina 3 4 5 6 7 8 9 10 a) An EIR and supplemental information have been previously submitted and accepted. b) The Planning Director has determined that the Environmental Protection Ordinance has been met by Prior Compliance (Section 19.04.153). 4) The proposed Specific Plan Amendment conforms to applicable City policies and ordinances dealing with public facilities because: a) Conditions of previous approvals ensure the above. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission 11 January 6, 1976, is hereby amended to read: 15 14 B) That an Amendment to SP-l71(A) be approved and that 13 A) That the above recitations are true and correct. 12 of the City of Carlsbad as follows: Ordinance No. 9477 be amended as follows: 1) Condition 2 of City Council Ordinance No. 9447, date 16 17 18 19 20 21 22 23 a) All development conditions of the R-1 zone shal apply to all areas encompassed by this Specific P1 an. 2) Condition 3 of City Council Ordinance No. 9447, date January 6, 1976, is hereby deleted.
