CASE NO.: CUP-129 I APPLICANT: ROBERT KNAUF I 8 II 9 WHEREAS, a verified application for a certain property, tc 10 Assessor's Book Number 211, Page 060, Parcel 211-060-06 11 wit: 12 exist: 22 Conditional Use Permit, found the following facts and reasons t 21 be heard, said Commission considered all factors relating to th 20 the testimony and arguments, if any, of all persons who desired 19 WHEREAS, at said public hearing, upon hearing and consider 18 place specified in said notice on December 22, 1976; and 1'7 WHEREAS, the public hearing was held at the time and in th 16 provided by Title 21 of the "Carlsbad Municipal Code"; and 15 WHEREAS, said verified application consitutes a request as 14 Planning Commission; and 13 has been filed with the City of Carlsbad and referred to the 23 24 25 26 1) The requested use is desirable for the development of the Community, is in harmony with the General Plan, and is not detrimental to existing or permitted uses in the zone in which the proposed use is to be located because: a) Additional sign advertising will enhance the commerci viability of the site; and 27 28 b) The additional sign will not detract from the overall visual appearance of the auto center. , il 0 0 1 2 3 4 2) The site for the intended use is adequate to accommodate use because: a) The width of the site (481 feet) is great enough to absorb an additional freestanding sign in addition tl the existing sign without creating an undesirable clutter of signing. 5 3) All yards, setbacks and other features necessary to adju: the neighborhood will be provided and maintained because: 6 the requested use to existing or permitted future uses ir 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 a) All such features are guaranteed through conditions ( approval. 4) The street system serving the proposed use is adequate tc properly handle all traffic generated by the proposed US( because: a) Paseo del Norte, Cannon Road, and Palomar Airport Rc are all designed to handle the volume of traffic genc by the auto center, of which the additional sign is i I i part. 5) The proposed sign is appropriate for the use of the prop€ and compatible with the design of the development and ad: properties, and will not adversely affect the appearance the area because: a) The sign’s copy is of an automotive nature, appropric for a car dealer in an auto center. 22 23 6) The proposed sign will not interfere with the safety of 1 traveling public or restrict any views because: a) The sign is not of a size or bulk large enough to dis drivers or impede views of the hills to the east of t project site. 7) The proposed sign will not result in a proliferation of s in the area because: a) The width of the project site will not allow addition freestanding signs under the terms of Section 21.41.0 /i b) Attached signing is limited by Section 21.41.070. 24 The project has complied with the requirements of the Car 25 !I8) Environmental Protection Ordinances as a Cateaorical Exem 26 ll 27 0 (Section 19.05.090-C5) because: a) The proposed sign constitutes a minor appurtenance to existing commercial facility. 28 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission -2- I1 0 1 of the City of Carlsbad as follows: 211 A) That the above recitations are true and correct. 3 4 5 6 7 8 9 10 3.1 12 13 14 15 16 17 18 19 I B) That in view of the findings heretofore made and conside the applicable law, the decision of the Planning Commiss is to approved Case No. CUP-129, subject to the followin conditions: 1) The approval is granted for the land described in t application and attachments thereto, for one of the two signs shown on Exhibit A, dated December 9, 197 However, if a lot line adjustment is approved givin subject site sufficient frontage, the second sign m be placed upon the property per staff approval of 1 and sign. 2) The location of the sign on the lot shall conform t all locational requirements of Section 21.41.075(b) Carlsbad Municipal Code. The Planning Director sha determine conformity with that section prior to app of a sign permit. 3) All signs on the project site shall conform to the requirements of Chapter 21.41 (Signs) of the Carlsb Municipal Code. The erection of non-conforming sip shall be considered a breach of this approval. 4) The existing low profile signs advertising Honda an Oldsmobile shall be modified to include an arrow fo direction and be moved if necessary to give proper direction to service areas. I 5) This Conditional Use Permit shall automatically ter concurrent with termination of use of the site for Oldsmobile dealership (if the Oldsmobile sign is us or for a Honda dealership (if the Honda sign is use 20 PASSED, APPROVED AND ADOPTED at a regular meetinq of the 21 the following vote, to wit: 22 of Carlsbad Planning Commission held on December 22, 1976, by 23 24 25 AYES: Commissioners Rombotis, L'Heureux, Watson, Fikes, Larson, and Jose. NOES: Commissioner Nelson. 26 27 ABSTAIN: None.
