I ' '. /I w e I 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 I PLANNING cormtIssIor~ RESOLUTION NO. 1306 RESOLUTION OF THE PLANNING COMMISSION OF ING THE CONDITIONAL USE PERMIT TO ALLOW THE CITY OF CARLSBAD, CALIFORNIA, CONCERN- ONE FREESTANDING SIGN AS REQUIRED BY SEC- TION 21.41.075 (b) OF THE CARLSBAD MUNICI- PAL CODE FOR RORICK BUICK-OPEL ON PROPERTY GENERALLY LOCATED or4 THE EAST SIDE OF INTER- STATE 5 BETWEEN CANNON ROAD AND PALOMAR AIRPORT ROAD. CASE NO: CUP-129 APPLICANT: ROBERT KNAUF WHEREAS, a verified application for a certain property, wit: Assessor's Book ?lumber 211, Page 060, Parcel 211-060-02 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application consitutes a request provided by Title 21 of the "Carlsbad Municipal Code"; and WHEREAS, the public hearing was held at the time and in place specified in said notice on December 22, 1976; and WHEREAS, at said public hearing, upon hearing and consic the testimony and arguments, if any, of all persons who desil to be heard, said Commission considered all factors relating the Conditional Use Permit, found the following facts and rei to exist: 1) The requested use is desirable for the development of tht Community, is in harmony with the General Plan , and is nc detrimental to existing or permitted uses in the zone in which the proposed use is to be located because: a) Additional sign advertising will enhance the commerc. viability of the site; and b) The additional sign will not detract from the overal' visual appearance of the auto center. i I I I .- b " li w 0 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 i I I 2) The site for the intended use is adequate to accommodate use because: a) The width of the site (534 feet) is great enough to z an additional freestanding sign without creating an undesirable clutter of signing. 3) All yards, setbacks, and other features necessary to adjl the requested use to existing on permitted future uses ir neighborhood will be provided and maintained because: a) All such features are guaranteed through conditions ( approval. 4) The street system serving the proposed use is adequate tc properly handle all traffic generated by the proposed ust because: a) Paseo del Norte, Cannon Road and Palomar Airport Roac are all designed to handle the volume of traffic gen. erated by the auto center, of which the additional s' is a part. 5) The proposed sign is appropriate for the use of the propc and compatible with the design of the development and adjacent properties, and will not adversely affect the a1 ance of the area because: a) The sign's copy is of an automotive nature, appropril for a car dealer in an auto center. 6) The proposed sign will not interfere with the safety of traveling public or restrict any views because: a) The sign is not of a size or bulk large enough to di drivers or impede views of the hills to the east of project site. 7) The proposed sign will not result in a proliferation of in the area because: a) The width of the project site will not allow more th one freestanding sign under the terms of section 21.41.075 (b); b) Attached signing is limited by section 21.41.070. 8) The project has complied with the requirements of the Ca Environmental Protection Ordinances as a Categorical Exe (Section 19.05.090-C5) because: a) The proposed sign constitutes a minor appurtenance t existing commercial facility. B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Cornmiss, is to approve Case No. CUP-129, subject to the following conditions: 1) The approval is granted for the land described in thl application and attachments thereto, for the sign wi copy "Used Cars Rorick (!pel" as shown on Exhibit Cy 1 December 9, 1976. 2) The approval of this Conditional Use Permit constitu approval of sign copy and the general location shown Exhibit C, dated December 9, 1976. The erection of non-conforming sign shall be considered a break of this approval. 4) This Conditional Use Permit shall automatically term concurrent with termination of use of the site for a Ope1 dealership. PASSED, APPROVED, AND ADOPTED at a regular meeting of th City of Carlsbad Planning Commission held on December Z,, 197 the following vote, to wit: AYES : Commissioners !,!atson, L 'Heureux, Fi kes , Larson, Rombotis and Jose.
