RESOLUTION OF THE PLANNING COMMISSION OF
ING A PANHANDLE LOT ON PROPERTY LOCATED ON THE WEST SIDE OF MONROE STREET BETWEEN MAGNOLIA AVENUE AND TAMARACK AVENUE.

has been filed with the City of Carlsbad and referred to the
Planning Commission pursuant to Title 21, Section 21.70.080 fc

3) The development standards for panhandle lots under Section 21.10.080(d) are met because:
a) The buildable portion of the panhandle lot exceeds 3 10,000 square feet;

b) The width of the buildable portion of the panhandle lot (120 ft.) is greater than the minimum width re- quired (60 ft.);
c) The yard requirements of the R-1-7500 zone district can be met on the subject lot;
d) The panhandle portion of the subject lot does not exceed 150 feet in length and is not less than 20 feet in width;
e) A condition of approval has ensured the provisions ( an improved driveway on the subject lot;
f) A condition of approval has ensured the provision 01 adequate drainage on the subject lot;
g) A condition of approval has ensured the provision 0- at least three non-tanden parking spaces;

h) .A condition of approval has limited the structures tc be located in the access portion of the lot; and
i) A condition of approval has ensured that the proper. owner shall agree to hold the City or any other pub' service agency harmless from liability for any damac to the driveway when being used to perform a public service.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio'

1) Approval is granted for the land described in the a cation and attachments thereto, and as shown on the plan submitted, labeled Exhibit A, dated December 1 1976. The location of all buildings and lot lines be located substantially as shown on the plot plan ed Exhibit A, except as otherwise indicated herein.

Owner shall enter into a lien contract for future installation of complete half-width public frontage improvements of Monroe Street. The owner's engineer shall submit an estimate of the cost of these impro\ ments.
The tentative parcel map approval shall expire one J from the date of the letter containing the final de- cision for tentative map approval.
The structure crossing the proposed lot line shall b removed, or a bond shall be posted to assure removal prior to recordation of the parcel map. Prior to th issuance of building permits on ecGker parcel9 B e+- & a paved parking space, covered or uncovered, shal be constructed on parcel A in place of the garage tc be removed.
To ensure a legal sideyard for the existing house IC on parcel A, the lot line separating parcels A and E from parcel C shall be relocated south a distance sufficient to provide at least the minimum required side yard set back.
For development purposes, the front yard of parcel B shall be considered the eastern portion of the lot, 117 feet in width (120 feet with lot line modificati
Structures permitted in the access portion of the lo shall be limited to mail boxes, fences, trash enclos landscape containers and name plates. Except for ma boxes, these structures shall not be greater than fo two inches in height if located within twenty feet o the street property line or greater than six feet in height beyond this point.
The property owner of such a lot shall agree in writ to hold the City or any other public service agency harmless from liability for any damage to the drivew when being used to perform a public service prior to recordation of the final map.
An improved driveway shall be installed within the a portion of the lot at the time of building construct Said driveway shall have a width of at least 14 feet shall be construed to accommodate public service veh with a minimum of two-inch thick asphalt concrete pa on proper base with rolled edges.
Adequate drainage of the subject lot shall be providc at the time of building construction. This requiremc shall be met to the satisfaction of the City Engineeq
Building plans for the subject lot shall include thrl non-tandem parking spaces with approaches not less t' twenty-four feet in length with proper turnaround spl

to permit complete turnaround for forward access to the street. Said spaces shall be located on the SUI lot conformance with the development standards of t' R-1 zone.
