HomeMy WebLinkAbout1976-12-22; Planning Commission; Resolution 1310e e I I1 PLANNING COMMISSION RESOLUTION NO. 1310 2 3 4 5 6 7 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO REZONING PROPERTY FROM R-1-7500 TO RD-M ON PROPERTY LOCATED ON THE WEST SIDE OF FREEWAY 1-5 BETWEEN JEFFERSON AND MADISON STREETS APPLICANT: DAVID KOYL CASE NO. ZC-183 WHEREAS, a verified application for a certain property, i 8 Carlsbad and referred to the Planning Commission; and 9 shown on the attached mak has been filed with the City of 10 WHEREAS, said verified application constitutes a request 'I. 12 provided by Title 21 of the "Carlsbad Municipal code;" and 13 WHEREAS, the public hearing to consider the subject rezoning was held at the time and in the place specified in 14(1 said notice on December 8, 1976, and continued to January 12, 15/1 1977; and 16 I'7 Ordinance of 1972;" and I.8 requirements of the City of Carlsbad "Environmental Protectiol WHEREAS, the subject application has complied with the 19 I WHEREAS, at said public hearing, upon hearing and considl 20 21 the testimony and arguments, if any, of all persons who desired to be heard, said Commission considered all factors 22 23 relating to the Zone Change and found the following facts and reasons to exist: 24 25 1) The Change of Zone is consistent with the General Plan be 26 a) The proposed residential zone (RD-N) is consistent wi 27 Medium-High Density (10-20 dwellings per acre); and the site's Land Use Element designation of Residentia b) The Zone Change will have no adverse impact on any ot 28 xxxxx Element of the General Plan. /I W e 1 2 2) The proposed Zone Change is consistent with the Carlsbad Environmental Protection Ordinance of 1972 because: 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 2o I a) An Environmental Impact Assessment of the project has been conducted and negative declaration made for the following reasons: 1) The project site is within an urbanized area in which the natural land forms and vegetation have been inalterably modified; and 2) The project will not significantly increase air pollution,water runoff, traffic or noise in the area. 3) The proposed Zone Change is consistent with applicable City Public Facility Policies and Ordinances because: a) All.required'facilities are currently available to the site. NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That the Zone Change from R-1-7500 to RD-M is recommended for approval.
