PATRICK'S CHURCH SITE FOR RECREATIONAL ACTIVITIES AND MEETINGS ON PROPERTY LOCATED ON THE EAST AND WEST SIDES OF HARDING STREET BETWEEN OAK STREET AND ELM AVENUE. CASE NO.: CUP-128 APPLICANT: CITY OF CARLSBAD WHEREAS, a verified application for a certain property, to wit: Assessor's Book No. 203, Page 353, Parcels 5, 6, 7 and 12 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reques as provided by Tit1 e 21 of the Carlsbad Municipal Code; and WHEREAS, the public hzaring was held at the time and in the place specified in said notice on January 26, 1977; and WHEREAS, the applicant has complied with the Public Facilt ty Pol icy of the City of Carlsbad and has provided the necessary information which insures Public Facilities will be available and current with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protecti Ordinance of 1972'' because: 1) No new construction is proposed; therefore, disruption t the physical environment will be negligible; 2) The Community Center will provide social and recreationa services to Inner City residents; and 3) Traffic is not expected to increase as a result of the project. ,. ' ll w m 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 WHEREAS, at said public hearing, upon hearing and consi the testimony and arguments, if any, of all persons who desi to be heard, said Commission considered all factors relating to the Conditional Use Permit and found the following facts and reasons to exist: 1) The requested use is necessary and desirable for the deu opment of the Community, is essentially in harmony with various elements and objectives of the General Plan and not detrimental to existing uses or to uses specificall) permitted in the zone in which the proposed use is to be located because: a) The activities planned to take place at the subject location will utilize the facilities in a similar WE to the previously established activities. b) Some of the activities previously established will t continued. c) The subject site has been used for civic acitivites many years and is an established land use. d) The intensity of facility and site use will not incl at this time. 2) The site for the intended use is adequate in size and si to accommodate the use because: a) Expansion of existing facilities or intensification use are not planned at this time. b) Expansion of facilities or intensification of use w require an amendment to theis Conditional Use Permi. 3) All of the yards, setbacks, walls, fences, landscaping i other features necessary to adjust the requested use to existing or permitted future uses in the neighborhood w be provided and maintained. 4) The street system serving the proposed use is adequate properly handle all traffic generated by the proposed u because: a) No new construction is proposed; therefore, disrupt to the physical environment will be negligible. b) The Community Center will provide social and recrea services to Inner City resididents. NOM, THEREFORE, BE IT RESOLVED by the Planning Commissio the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi is to approve CUP-128, subject to the following conditior 1) The approval is granted for the land described in the apl: tion and attachments thereto, and as shown on the plot pl submitted labeled Exhibit A, dated October 29, 1976. Buildings, parking areas and landscaping shall be locatec substantially as shown on the plot plan, Exhibit A, excel or unless indicated otherwise herein. 2) Any modification to or expansion of the existing activit on-site will require an amendment to this Conditional Us1 Permi t. 3) An annual review of this CUP will be made by the Plannin Commission. 4) In the event that this property becomes headquarters for City of Carlsbad functions, an amendment to the CUP will be necessary. PASSED APPROVED AND ADOPTED at a regular meeting of the of Carlsbad Planning Commission held on January 26, 1977, by following vote, to wit: AYES: COMMISSIONERS LARSON, L’HEUREUX, WATSON, ROMP NOES: NONE.
