CONDITIONAL USE PERMIT TO 3 "THE CITY OF CARLSBAD, CALIFORNIA, CON- ALLOW A 12 X 42-FOOT (504 SQ. FT.! THE ENCINA JOINT WATER POLLUTION CONTROL AVENIDA ENCINAS BETWEEN PALOMAR AIRPORT CUP-131 6 ROAD AND 1-5 7 APPLICANT: CITY OF CARLSBAD LES EVANS - AGENT 8 /I 9 WHEREAS, a verified application for a certain property, 10 Assessor's Book 211, Page 030, Parcels O6'and 08 11 wit: has been filed with the City of Carlsbad and referred to the Planning Commission; and 12 13 provided by Title 21 of the "Carlsbad Municipal Code": and 14 WHEREAS, said verified application constitutes a request WHEREAS, the public hearing was held at the time and in 1 15 16 WHEREAS, at said public hearing, upon hearing and considc 17 the testimony and arguments, if any, of all persons who desirc to be heard, said Commission considered all factors relating t 18 the Conditional Use Permit and found the following facts and 19 reasons to exist: place specified in said notice on January 26, 1977; and I 20 21 22 23 24 25 1) The requested use is necessary or desirable for the develc of the Community and is essentially in harmony with the va elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specifically permi in the zone in which the proposed use is to be located be- cause: a) The requested structure will be located within boundar b) The existing facility site is designated by the Genera of an existing facility. Plan for public utility uses. 26 27 2) The site for the intended use is adequate in size and shapl c) The requested structure will provide necessary office space for administration (permanent plant manager). to accommodate the use because: 28 xxxxxxxxxx I1 - ll w 9 I/ 1 2 3 4 5 6 7 a 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 a) The subject site consists of approximately 25 acres an is fenced and screened from surrounding development. 3) All yards, setbacks, walls, fences, landscaping and other features necessary to adjust the requested use to existins or permitted future uses in the neighborhood will be provi and maintained because: a) The requested structure will be located inside the existing facility site and will not be readily visible from surrounding properties. b) The location of the subject structure will be at least 65 feet from the nearest property line and at least 90 feet from the nearest existing structure. 4) The street system serving the proposed use is adequate to properly handle all traffic generated by the proposed use because: a) An existing 14-foot paved roadway is existing on site, The proposed structure is to be located adjacent to tt exi s ti ng roadway. b) A maximum of 2 additional employees will result from 1 proposed structure. NOW, THERFORE, BE IT RESOLVED by the Planning Commission c the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and consideri the applicable law, the decision of the Planning Commissic is to approve CUP-137, subject to the following condition: 1) The approval is granted for the land described in the application and attachments thereto, as shown on the 1: plan submitted labeled Exhibit A, dated December 16, 1976. The structure shall be in substantial conformar to the design shown in the architectural elevations, Exhibit B, dated January 18, 1977. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on January 26, 1977, by the following vote, to wit: AYES: COMMISSIONERS LARSON, ROMBOTIS, L'HEUREUX, WATSON, FIKES, JOSE AND NELSON. ..
