PLANNING COMMISSION RESOLUTION NO. 1320
A RESOLUTION OF THE PLANNING COMMISSION OF
MENDING APPROVAL OF AN AMENDMENT TO SPECIFIC PLAN 38 TO ALLOW THE DELETION OF CERTAIN
GENERALLY LOCATED ON THE NORTH SIDE OF
GIBRALTOR STREETS.
CASE NO. : SP-38(A) APPLICANT: CITY OF CARLSBAD
THE CITY OF CARLSBAD, CALIFORNIA, RECOM-
PROPERTY INCLUDED WITH PUD-7 (CT 76-17),
LA. COSTA AVENUE BETWEEN CADENCIA AND
illHEREAS, a verified application for deletion of certain
property from PUD-7 (CT 76-17), as shown on the attached map,
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHER~EAS,said verified application constitutes a request
as provided by Title 21 of the "Carlsbad Municipal Code;" and
WHEREAS, the public hearing was held at the time and the
place specified in said notice on January 26, 1977; and
WHEREAS, at said Public Hearing, upon hearing and con-
sidering the testimony and arguments, if any, of all persons
who desired to be heard, said Commission considered all facts
relating to the Specific Plan Amendment and found the followi:
facts and reasons to exist:
1) The proposed Specific Plan Amendment is consistent with the General Plan because:
a) The residential use and density of PUD-7 (CT 76-17) (14.2 dwelling units per acre) is consistent with the designation of the Land Use Element; and
b) PUD-7 (CT 76-17) does not conflict with any other element of the General Plan
2) The proposed Specific Plan Amendment is consistent with the adopted Master Plan because:

a) A partial amendment to the La Costa Master Plan ;,was adopted by City Council Ordinance 9469 (November 2, 1976) to accommodate PUD-7 (CT 76-17).
3) The proposed Specific Plan Amendment is consistent with the City of Carlsbad Environmental Protection Ordinance of 1972 because:
a) An EIR and supplemental information have been pre- viously submitted and accepted; and
b) The Planning Director has therefore determined
that the Environmental Protection Ordinance has been met by Prior Compliance (Section 19.04.153).
4) The proposed Specific Plan Amendment conforms to applicable City pol icies and ordinances dealing with public facilities because:
a) Conditions of approval on PUD-7 (CT 76-17) assure
the above.
NOW, THEREFORE, BE IT RESOLVED by the Planning Commissior
of the City of Carlsbad as follows:
A) That the above recitations are true and correct.
B) That anAmendment to Specific Plan 38 is approved deleting certain property included with PUD-7 (CT 76-17), generally located on the north side of La Costa Avenue between Cadencia and Gibraltor Streets, and as shown on the attached map, labeled Exhibit A.
PASSED, APPROVED AND ADOPTED by the Planning Commission
of the City of Carlsbad, California, at a regular meeting
held on January 26, 1977, by the following vote, to wit:
