HomeMy WebLinkAbout1977-02-09; Planning Commission; Resolution 1327... /I e e 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 PLANNING COMMISSION RESOLUTION NO. 1327 RESOLUTION OF THE PLANNING COMMISSION OF MENDING TO THE CITY COUNCIL ADOPTION OF THE DESIGNATION IN THE LAND USE ELEMENT RRE (EXTENSIVE REGIONAL RETAIL) ON PROPERTY LOCATED ON THE EAST SIDE OF AVENIDA ENCINAS, NORTH OF PALOMAR AIRPORT ROAD AND WEST OF CASE NO. : GPA-44 APPLICANT: L. BRUCE STALLARD /' 4 THE CITY OF CARLSBAD, CALIFORNIA, RECOFI- GPA-44, A GENERAL PLAN AMENDMENT TO CHANGE FROM TS (TRAVEL SERVICES COMMERCIAL) TO FREEWAY 1-5. WHEREAS, a verified application for a certain property, as shown on the attached map, has been filed with the City of Carlsbad and referred t the Planning Commission; and WHEREAS, said verified application constitutes a request as provide by Title 21 of the "Carlsbad Municipal Code;" and WHEREAS , the publ i c hearing was held at the time and in the place specified in the public notice on February 9, 1977; and WHEREAS, the subject application has complied with the requirements of the Carlsbad Environmental Protection Act of 1972 because: a) A Negative Declaration has been issued for the following reasor 1) The General Plan Amendment would not significantly alter the intensity of impacts resulting from development; 2) The site is graded and devoid of vegetation. Therefore, impacts to the physical environment will be minimal; and WHEREAS, the proposed General Plan Amendment is consistent with the the City of Carl sbad's pol i cies and ordinances dealing with the publ i c faci 1 i ties because: a) Conditions of approval of GPA-44 assure the above; and WHEREAS , at said publ i c hearing, upon hearing and considering the 1 mony and arguments, if any, of all persons who desired to be heard, said 28 Commission considered all facts relating to the General Plan Amendment ar 0 1 found the following facts and reasons to exist: // 2 3 4 5 6 7 1) The subject site is not a good location for travel services type uses because of the noise created by the nearby railroad, the traffic conf 1 i cts with industrial employees in the area and the general industrial character of the area. 2) The RRE category will permit the large-scale commercial uses that wou be compatible with the nearby industrialized uses and would benefit from exposure to 1-5. 3) The site is of sufficient size to accommodate an RRE land use. 4) The site is readily available to a large volume of customers as requi 8 for an RRE area. 9 NOW, THEREFORE, BE IT RESOLVED by the Planning Commission of the City 10 11 Carlsbad as follows: B) That an Amendment to the Land Use Element of the General Plan be adop. 13 A) That the above recitations are true and correct. 12 changing the designation from TS (Travel Services Commerci a1 ) to 14 RRE (Extensive Regional Retail ) on property located on the east si de ( Avenida Encinas, north of Palomar Airport Road and West of Freeway I-! 15 PASSED, APPROVED AND ADOPTED by the P1 anning Commission of the City 0' Carlsbad, California, at a regular meeting held on February 9, 1977, by tl 16 17 18 19 following vote, to wit: AYES : Commissioners, Larson, Rombotis, Watson and Fikes. 20 21 22 23 24 25 NOES : Commissioners L'Heureux and Jose.
