HomeMy WebLinkAbout1977-02-09; Planning Commission; Resolution 1328.m e 0 1 2 3 4 5 6 7 8 9 LO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 I PLANNING COMMISSION RESOLUTION NO. 1328 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, SETTING FORTH ITS FINDINGS AND RECOMMENDATIONS RELATIVE TO REZONING PROPERTY FROM R-3 TO RESIDENTIAL-PROFESSIONAL-QUALIFIED (R-P-Q) CASE NO.: ZC- 187 APPLICANTS: RONALD BONAGUIDI, WAYNE LILL AND BOB NEELY WHEREAS, a verified application for a certain property, as shown on the attached map, has been filed with the City o Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reque as provided by Title 21 of the "Carlsbad Municipal Code;" an ?dHEREAS,the public hearing to consider the subject rezon was held at the time and in the place specified in the publi notice on February 9, 1977; and WHEREAS, the subject application has complied with the requirements of the Carlsbad Environmental Protection Act of because'a Negative Declaration has been issued for the follo reasons: a) The Zone Change is necessary for conformity to the adopted General Plan; b) The project area is developed; and c) Uses permitted under the new zone would be compatib with freeway noise. WHEREAS, at said public hearing, upon hearing and consi the testimony and arguments, if any, of all persons who desi to be heard, said Commission considered all factors relatins to the Zone Change and found the following facts and reasons exi st: 28 xxxxxxxxxx -' I/ m 0 1 2 3 4 5 61 1) The proposed Zone Change is consistent with the General Plan because: a) The parcels are designated as the combination distri Recreational Commercial/Professional and Related Commercial (RC/O) on the General Plan Land Use Elemt b) The Residential-Professional Zone implements the US( permitted by the "0" portion of the above General P1 combination district. 7 c) The Qualified Overlay Zone will insure that future development of the subject parcels will preserve the integrity of the adjoining residential neighborhoods 8 by orienting towards Pi0 Pic0 Drive. 9 10 d) The Zone Change will have no adverse impact on any E of the General Plan. I1 City Public Facilities Policies and Ordinances because: 2) The proposed Zone Change is consistent with applicable 12 a) All basic public facilities exist for the site. 13 14 b) Any additional public facilities may be required wit approval of site development plans required by the Qual i f i ed Over1 ay Zone. 15 3) The Oualified Overlav Zone ("Q") is being applied to thi 16 area to assure that development of the different parcels be comprehensively designed to provide for: 17 18 19 a) Preservation of the existing residential neighborhoo the east. b) Orientation of any development on these parcels towa Pi0 Pic0 Drive. 20 e) Design compatibility of the different developments i 22 d) Mutual parking and driveway access if at all possibl 21 c) All primary access from Pi0 Pic0 Drive. 23 they are not developed together. NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio 24 25 of the City of Carlsbad as fol lows: 26 A) That the above recitations are true and correct. 27 B) That the Zone Change from R-3 to R-P (Residential Profes: al) is recommended fordenial; but a change to R-P-Q is recomme for approval, 28 PASSED, APPROVED AND ADOPTED at a regular meeting of the n /I - L- I . e a 1 2 3 4 5 6 7 a 9 10 11 12 City of Carlsbad Planning Commission held on February 9, I97 by the following vote, to wit: AYES : Commissioners Larson, Rombotis, L'Heureux, NOES: None.
