HomeMy WebLinkAbout1977-02-23; Planning Commission; Resolution 1331> .t ,%' r. il 1) I) 1 1 PLANNING COMMISSION RESOLUTION NO. 1331 2 3 4 5 6 7 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A CONDITIONAL USE PERMIT REQUEST TO ALLOW RETENTION OF AN ADDITIONAL FREESTANDING SIGN AS REQUIRED BY SECTION 21.41.075(b) OF THE CARLSBAD MUNICIPAL CODE ON PROPERTY LOCATED ON PASEO DEL NORTE ON THE EAST SIDE OF INTERSTATE 5 BETWEEN CANNON ROAD AND PALOMAR AIRPORT ROAD. CASE NO.: CUP-1 33 APPLICANT: FEIST, VETTER, KNAUF AND LOY II 8 I1 WHEREAS, a verified application for a certain property, 911 wit: 10 11 12 13 14 15 16 17 18 19 2o I That portion of Lot 10 of Rancho Agua Hedionda in the City of Carlsbad, County of San Diego, State of California, according to Map thereof No. 7492, filed in the Office of the Recorder of said San Diego County, and also listed in Assessor's Book No. 211, Page 060, Parcel 07 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reques' provided by Title 21 of the "Carlsbad Municipal Code;" and WHEREAS, the public hearing to consider the subject Conditional Use Permit was held at the time and in the place specified in the public notice on February 23, 1977; and 21 22 23 24 25 26 27 28 WHEREAS, at said public hearing, upon hearing and consi the testimony and arguments, if any, of all persons who desi to be heard, said Commission considered all factors relatin5 the requested Conditional Use Permit and found the followin! and reasons to exist: 1) The subject application has complied with the requireme of the Carlsbad Environmental Protection Act of 1972 be a) The subject request is categorically exempt from th Environmental Protection Ordinance, Section 19.04.0 .- 5 q 0 1 2) 2 3 4 5 6 3) 79 4) 8 9 10 II 12 13 14 15 16 6) 17 18 5) 19 I 7) 20 21 22 23 24 25 8) 27 26 28 The proposed Conditional Use Permit is consistent with the General Plan because: a) The Land Use Element of the General Plan designates the subject site as RRE (Extensive Regional Retail), which permits such sign usage. The proposed Conditional Use Permit is consistent with applicable City Public Facilities and Ordinances because: a) All public facilities are existing for the site. The proposed sign is appropriate for the property because a) The requested sign will be separated sufficiently fro the only other freestanding sign on the property (300 The proposed sign is compatible with the adjacent propert because : a) Similar signs have been approved for existing and pla dealerships along Paseo del Norte (CUP-129). b) Two or more signs per property were approved for exis or planned dealerships under CUP-129. c) The design and dimensions of the requested sign are similar to those configurations approved for signs under previous approvals (CUP-129). The proposed sign will not interfere with the safety of . traveling public because: a) The sign is adequately separated from the visual cor: to insure proper sight distance. The proposed sign will not result in proliferation of si1 in the area because: a) Other dealerships in the area have been allowed at 1 two freestanding signs of the type requested. b) Other dealerships in the area could apply for a CUP allow more than one freestanding sign under Section 21.41.075. The proposed sign will not adversely affect the appearar of the area and will not unduly restrict views because: a) The requested sign is similar in size and design to other approved signs in the area. b) The sign is compatible in copy with other existing E planned/approved signs in the area C) No significant features exist near the Sign that WOI -2- be blocked from view by the structure. ”. ,{ w 0 I 1 2 3 4 5 6 9) The requested use is necessary or desirable for the develc ment of the community, and is essentially in harmony with the various elements and objectives of the General Plan, and is not detrimental to existing uses or to uses specif, cally permitted in the zone in which the proposed use is be located because: a) The sign is necessary to identify a type of subuse on the property not adequately identified by the existin perrn’i tted freestanding sign. 7 b) The additional sign will not detract from the overall visual appearance of the Auto Center. 8 9 10) The site for the intended use is adequate to accommodate use because: 10 I1 a) The width of the site (1,0892 feet is great enough to absorb an additional freestanding sign in addition to the existing sign without creating an undesirable clutter of signing. The Planning Director shall determine conformity with the referenced section prior to approval of a sign permit. PASSED, APPROVED AND ADOPTED at a regular meeting of the City of Carlsbad Planning Commission held on February 23, 197' by the following vote, to wit: AYES: Commissioners Larson, Rombotis, Nelson, L'Heurl and Jose.
