'1338 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF AN AMENDMENT TO SPECIFIC PLAN TREATMENT FACILITIES AND A MAINTENANCE BUILDING AT THE ENCINA POWER PLANT. CASE NO.: SP-l44(C) APPLICANT: SAN DIEGO GAS & ELECTRIC CO. (SP-144) TO ALLOW THE CONSTRUCTION OF WATER WHEREAS, a verified application for an amendment to SP-1 to permit the construction of water treatment facilities and mai ntenance bui 1 ding for the foll owing described property: Those portions of Lots "F" and IIH" of Rancho Agua Hedior Map 823, and Block "W" of Pal isades Number Two, Map 180: in the City of Carlsbad, County of San Diego, State of California, shown and delineated on S.B.E. Map 141-37-7: Parcels 1 through 10. WHEREAS, in accord with Title 21 of the Carlsbad Municil Code, the matter was referred to the Planning Commission for public hearing. WHEREAS, a duly noticed public hearing was held at the and in the place specified in said notice on March 9, 1977, at which time all interested persons were heard, and WHEREAS, the applicant has complied with the Public Fac Element of the General Plan and has provided the necessary i formation which insures Public Facilities will be available concurrent with need; and WHEREAS, the subject application has complied with the requirements of the City of Carlsbad "Environmental Protecti Ordinance of 1972" in that an Environmental Impact Report on the project was certified in 1973 and has been fully supplen with additional current information which constitutes prior compliance. In addition, an EIR for the entire related Enci 0 e 1 2 5 project as certified by the Public Utilities Commission act as lead agency on the project has been considered; and 3 WHEREAS, at said public hearing, upon hearing and consic 4 to be heard, said Commission considered all factors relating 5 the testimony and arguments, if any, of all persons who desir reasons to exist: 7 to the Specific Plan Amendment and found the following facts 6 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 1) The proposed Specific Plan Amendment is consistent with 1 General Plan because: a) The Land Use Map of the General Plan shows the subjec property as "U" (Public Utility). The proposed projc is consistent with that designation. 2) The proposed Specific Plan Amendment is consistent with 1 City of Carlsbad Environmental Protection Ordinance of l! because: a) A negative declaration has been issued for the projec based on the following findings: 1) The construction of the treatment facilities is l necessary water pollution control measure which required by the U. S. Environmental Protection AI Discharged water must be treated so that levels ( copper, iron, oil, grease, and suspended solids \ be reduced; 2) The construction of the treatment facilities wil increase the amount of fresh water discharged in the ocean but will simply improve the quality of discharged water, in accordance with all State a Federal requirements; 3) The amount of grading associated with the projec not substantial, and does not pose any special geotechnical problems; 4) The treatment ponds will not be visible from off Landscaped berms will surround the ponds; 5) An impervious liner will be installed to prevent seepage from the ponds. As an auxilliary measur a subdrain system will be constructed to accommo seepage should the liner be punctured; 6) The applicant will construct overflow pipes to P discharge from rising too high in the P0hd-S; and )I -2- .. 0 0 1 2 7) Boiler blow-down water, which accounts for approx- 37% of the water which the company could legally discharge into the ocean, will be reused. 3 b) The maintenance building is exempted by Section 19.04 a.1. 4 3) The proposed project conforms to applicable City policies 5 ordinances dealing with public facilities because: 6 7 8 9 a) The project will not increase the need for any existii facilities. 4) This amendment is consistent with the Carlsbad General P1, and all applicable specific plans. The project is a logil extension of an existing use located in an area already committed to heavy public utility operations. 10 NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio 11 the City of Carlsbad as follows: 12 A) That the above recitations are true and correct. 13 14 15 16 17 18 19 2o ~ B) That an amendment to SP-144 be approved and is subje to the following conditions: 1) The approval is granted for the land described in the application and any attachments thereto a as shown on the plot plan labeled Exhibit A, dat January 31, 1977. The location of all proposed facilities shall be located substantially as sho on said plot plan except or unless indicated 0th herein. 2) The water treatment ponds shall be constructed a maintained to the following standards to minimiz the li kelyhood of the ponds serving as mosquito breeding sources: 21 22 23 a) Confine standing water impoundment to as sma an area as possible. b) All ponds areas shall be 1 ined with a non-po material acceptable to the City Engineer. 24 25 26 27 28 c) Maintain a removal program of dense aquatic vegetation, such as cattails, bulrush, tule, pondweed, etc. d) Maintain a mosquito fish (Gambusia affinis) population, as necessary. e) Maintain routine (weekly) inspections of wat impoundments to detect mosquito breeding. II n -5- 4 ./ - w e 1 II f) Abate any mosquito breeding, as it is detectel 2 3) 3 4 5 6 7 8 4) Prior to the issuance of building permits for the maintenance building, the applicant shall submit plot plan to the Planning Director for review and approval showing which existing shops and storage activities are to be removed and consolidated int the new structure. Prior to the issuance of building permits, the applicant shall submit a revision to Exhibit A of SP-l44(B), incorporating these new facilities on said exhibit.
