HomeMy WebLinkAbout1977-03-23; Planning Commission; Resolution 1342e a 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 t I PLANNING COMMISSION RESOLUTION NO. 1342 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A PLANNED UNIT DEVELOPMENT TO PRO- VIDE SIX SINGLE FAMILY DETACHED HOMES ON APPROXIMATELY 1.66 ACRES LOCATED ON THE SOUTH SIDE OF ALMADEN LANE BETWEEN ZAMORA WAY AND PAMPLONA WAY. CASE NO. : PUD-9 APPLICANT: ROBERT S, PHILLIPS (TAW, LTD. ) ~ WHEREAS, a verified application for a certain proper to wit: That portion of land situated in the State of California, County of San Diego, and described as follows - Lot 188 of La Costa Valley Unit No. 4, in the County of San Diego, State of California, according to map thereof No. 5781 filed in the office of County Recorder of San Diego County, September 14, 1966. Assessor's Book 215, Page 231, Parcel 16 and Book 215, Page 231, Parcel 15 and Book 215, Page 231, Parcel 17, has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a re( 17 18 19 as provided by Title 21 of the "Carlsbad Municipal Code; and WHEREAS, the public hearing was held at the time an' lithe place specified in said notice on March 23, 1977; and 20 I/ WHEREAS, at said public hearing, upon hearing and C8 21 11 sidering the testimony and arguments, if any, of all Persons 22 23 24 25 26 27 2% desired to be heard, said Commission considered all factors r to the Planned Unit Development and found the following facts reasons to exist: 1) The proposed use at the particular location is necessary desirable to provide a service or facility which will con to the general well-being of the neighborhood and the corn because : a) The development will allow the subject property to be developed to its allowable potential and density. 1 0 0 1 2) 2 3 4 5 3) 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 of A) B) The use will not be detrimental to the health, safety or general welfare of the persons residing or working the the vicinity or injurious to property or improvements in the vicinity because: a) The proposed PUD will be developed in a manner similar the anticipated future development in the area. The design criteria set forth in Section 21.45.110 and all minimum development standards set forth in Section 21.45.1 will be met because: a) The plot plan and additional exhibits include all deve ment aspects required. b) The plot plan and additional exhibits include adequate provisions for open space, recreational facilities, circulation and parking. c) The project will be developed in a manner to be compat with surrounding development. d) Internal circulation is acceptable to the City Engineā‚¬ shown on the plot plan and by conditions of approval. e) Private recreational facilities and public open space readily accessible. f) Dwelling unit density does not exceed the density all( in the underlying zone (P-C with Master Plan). NOW, THEREFORE, BE IT RESOLVED by the Planning Comm the City of Carlsbad as follows: That the above recitations are true and correct. That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi is to approve PUD-9, subject to the following conditions: 1) The approval is granted for the land described in the application and any attachments thereto, and as shown Plot Plan submitted labeled Exhibit A (10 sheets), da January 31, 1977, The location of all roadways, park areas, landscaping and other facilities or features s be located substantially as shown on Exhibit A unless wise provided herein. 2) All conditions shall be appropriately completed and t project commenced within 18 months from final City ac 3) All setbacks and building locations shall adhere to t dimensions shown on Exhibit A, sheet No. 2, titled "Technical Site Plan." I1 -2- ll 0 0 1 2 3 4 5 6 7 8 9 LO 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 4) Prior to the issuance of grading permits, the City Engj shall approve a plan submitted by the applicant for int erosion control on all man-made slopes in excess of fiT feet within the boundaries of this subdivision. Prior this issuance of grading permits, the applicant shall I bonds and agreements ensuring the installation and mair ance of the erosion control system until permanent lanc scaping is installed and maintained. 5) Prior to the issuance of any building permits, the app shall submit a permanent landscaping and irrigation pl to the Parks and Recreation Director for his approval. The plan shall include all artificial slopes. These s shall : a) Utilize fire-retardant, drought-resistant landscap which includes trees and shrubs which reach a vari of sizes at maturity; and b) Utilize an irrigation system appropriate for commc maintenance of the required landscaping in conforn with Conditions 5 and 6. 6) The final PUD plan and landscaping plan shall be submj to an approved by the Fire Marshall, to insure adequat turning radii, prior to issuance of building permits. 7) Permanent landscaping and irrigation shall be install, all lots identified in Conditions before any of those are occupied. If residential construction occurs in ' this condition shall be met on a unit-by-unit basis. 8) A fire hydrant with required fire flows shall be in s and accessible prior to combustibles on site to the s faction of the Fire Marshall. 9) Pursuant to the Carlsbad Municipal Water District's w service policies, individual services and water meter be required to each of the dwelling units.
