HomeMy WebLinkAbout1977-04-13; Planning Commission; Resolution 1356* - I/ m m 1 PLANNING COMMISSION RESOLUTION NO. 1356 2 3 4 5 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A SITE DEVELOP- MENT PLAN FOR A 6,000 SQUARE FOOT PROFESSIONAL OFFICE BUILDING ON THE SOUTH SIDE OF ELM AVENUE BETWEEN PI0 PIC0 AND HIGHLAND AVENUE. CASE NO.: SDP 77-3 APPLICANT: DAVID MINNICH AND GENE YOCUM 6 WHEREAS, a verified application for a certain property, 7 wit: 8 9 10 11 12 13 14 15 16 16,000 Sq. Ft. rectangular parcel with approximately.! 80 feet frontage on the south side of Elm Avenue, between Pi0 Pic0 and Highland Drive and adjacent to the Colonial Mall Center. has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a reque, as provided by Title 21 of the "Carlsbad Municipal Code;" and WHEREAS, at said meeting the Planning Commission found the following facts and reasons to exist: - 1) The proposed development plan minimizes the impact of the 17 office uses on the adjoining land uses because: 18 19 a) The property will be graded and constructed in such a way as to allow the future integration with the devel able parcel to the east; 20 21 b) Building location and proper screening will preserve the integrity of the existing residential neighborhoo to the south; and 22 c) Pedestrian access will be provided to the commercial 23 24 Protection Ordinance of 1972 because: 25 compliance. 26 a) A Negative Declaration was issued for the rezoning of 28 3) The application is consistent with applicable City Public 27 complex to the west. 2) The application has complied with the Carlsbad Environmer this property and this project complies by prior Facilities Policies and Ordinances because: - m 0 I 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 a) At this time, all necessary public facilities, includ sewer service, are available to serve the subject prc as proposed. However, sewer facilities may not be a\ able when applications are made for building permits. sewer facilities are not available at the time of bui permit application, building permits will not be issx until arrangements satisfactory to the City Council c be made to guarantee that all necessary sewer facilit will be available prior to occupancy. NOW, THEREFORE, BE IT RESOLVED by the Planning Commiss of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and considex the applicable law, the decision of the Planning Commissi is to approve the Site Development Plan (SDP 77-3), subje to the following conditions: 1) The final Site Development Plan shall reflect the following changes: a) Pedestrian access from the parking area to the property to the west acceptable to the adjoining property owner and the Planning Director; and b) A trash area combined with the existing trash area on the property to the west acceptable to the property owner to the west, the Planning Director, and the sanitation company. 2) Prior to the issuance of occupancy permits, the applj shall submit landscape and irrigation plans to the Pz and Recreation Director for review and approval. All improvements shall be installed prior to final occupz 3) Prior to the issuance of any sign permits for this pl the applicant shall submit a comprehensive sign progl to the Planning Director for review and approval. 4) Prior to the issuance of building permits, the existj house and accessory structures shall be removed or dc molished per the requirements of the Director of Buil and Safety.
