CASE NO. SDP 77-4 APPLICANT : RON BONAGUIDI WHEREAS, a verified application for a certain propertl OF CARLSBAD, CALIFORNIA, CONCERNING A SITE DEVELOP- wit: Lots 1, 2 and 3 of the subdivision of tracts 110 and 120 of Carlsbad Lands, in the City of Carlsbad, in the County of San Diego, State of California, according to map thereof No. 1744 filed in the Office of County Recorder of San Diego County, January 3, 1923, together with that portion of the northwesterly 10 feet of Pine Avenue, now vacated, immediately adjoining said Lot 3 on the southeast excepting those portions lying southwesterly and westerly as more particularly described in the files of the Planning Department has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a requc as provided by Title 21 of the "Carlsbad Municipal Code;' an( WHE'REAS, at said meeting the Planning Commission founc the following facts and reasons to exist: 1) The proposed development plan minimizes the impact of thc office uses on the adjoining residential uses because: a) Primary vehicular access is from Pi0 Pico; b) Orientation of the office use is towards Pi0 Pico; a1 c) A six foot masonry wall will separate the office use from the residential properties to the east. 2) The application has complied with the Carlsbad Environmer Protection Ordinance of 1972 because: a) A Negative Declaration was issued for the rezoning oj this property and this project complies by prior compliance. //// 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 0 e 3) The application is consistent with applicable City Public Facilities Policies and Ordinances because: a) At this time, all necessary public facilities, includi sewec service, are available to serve the subject proj as proposed, However, sewer facilities may not be ava able when applications are made for building permits. sewer facilities are not available at the time of buil permit application, building permits will not be issuc until arrangements satisfactory to the City Council ci made to guarantee that all necessary sewer facilities be available prior to occupancy. NOW, THEREFORE, BE IT RESOLVED by the Planning Commiss: of the City of Carlsbad as follows: A) That the above recitations are true and correct. B) That in view of the findings heretofore made and consider: the applicable law, the decision of the Planning Cornissic is to approve the Site Development Plan (SDP 77-4), subje to the following conditions: 1) The final Site Development Plan shall reflect the following changes: a) The back-up space shall be redesigned to the sati faction of the City Engineer; b) The possible future drive shall be 24' wide and t calculations for the future building and parking be recalculated. 2) All necessary street improvements along Pine Avenue frontage shall be installed per requirements of the C Engineer prior to the issuance of building permits. 3) Prior to the issuance of occupancy permits, the applj shall submit landscape and irrigation plans to the PE and Recreation Director for review and approval. In ition to showing a more detailed plan of the concept1 landscape plan, the final landscape plan shall show mounding and screening materials in the planting are; along Pi0 Pico.
