HomeMy WebLinkAbout1977-06-22; Planning Commission; Resolution 1374. , I! * 9 1 2 3 4 5 6 PLANNING COMMISSION RESOLUTION NO. 1374 RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, CONCERNING A SITE DEVELOPMENT PLAN FOR APARTMENTS, FOUR- PLEXES, AND A COMMERCIAL CENTER, LOCATED ON APPROXIMATELY 15 ACRES (3 LOTS) ON THE EAST SIDE OF EL CAMINO REAL BETWEEN ALGA ROAD AND S.D.G&E EASEMENT. CASE NO: SDP 77-1 APPLICANT: ROLLY PULASXI & ASSOCIATES 7 II 8 // WHEREAS, a verified application for a certain property, 9 /I wit: 10 11 12 13 Situated in the State of California, County of San Diego Parcels 1, 2 and 3: All that portion of the west half of the northeast quarter of Section 26, Township 12 sout Range 4 west, San Bernardino Meridian, in the County of San Diego, State of California, according to official plat thereof, and also listed in the County Assessor's ' Book No. 215, Page 25, Parcel 49-55-511 14 15 16 has been filed with the City of Carlsbad and referred to the Planning Commission; and WHEREAS, said verified application constitutes a request 17 18 19 20 21 22 23 as provided by Title 21 of the "Carlsbad Municipal Code;" and WHEREAS, at said meeting the Planning Commission found t following facts and reasons to exist: 1) The proposed development plan provides a comprehensively designed use of the property and also provides acceptable internal and external circulation because: a) The applicant has worked with the Planning, Fire ant Engineering Departments to develop an acceptable int and external circulation plan (additional changes wj be required through conditions of approval). 24 25 b) The entire parcel has been planned for three types C development that will function compatibility rather as independent units. 26 /I c) El Camino Real median breaks have been minimized. 27 // 2) The application has complied with the Carlsbad Environmel 28 11 Protection Ordinance of 1972 because: 0 0 1 2 A Negative Declaration has been issued for the project ba: on information received in the Environmental Impact Asses: form including supplemental information. 3 /I 3) The application is consistent with the applicable City Pu: Facilities Policies and Ordinances because: 4 5 6 7 a) Public Facilities provided by the City of Carlsbad a available to the site. b) A letter confirming availability of sewer facilities Leucadia County Water District has been received reg the subject project. 811 4, The proposed map is consistent with the General Plan beca 9 10 a) The Land Use Plan Map designates the subject site fo Residential Medium-High Density (10-20 dwelling unit per acre). The subject project will provide approxi I 12.36 dwelling units per acre. I1 II NOW, THEREFORE, BE IT RESOLVED by the Planning Commissio l2 // of the City of Carlsbad as follows: l3 // A) That the above recitations are true and correct. 14 15 3.6 17 18 19 20 21 22 23 24 25 26 27 28 B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi is to approve the Site Development Plan (SDP 77-11, subje to the following conditions: 1) The approval is granted for the property described i the application and as generally represented on the submitted plot plans labeled Exhibit E (6 sheets), c 5/3/77, Exhibit F, dated 5/19/77, Exhibit G, dated 5/19/77, Exhibit H, dated 6/2/77. 2) The final site development plan shall incorporate a1 conditions imposed herein to the satisfaction of the Planning Director. 3) Alga Road shall be dedicated on the basis of a 102 f street section. 4) El Camino Real shall be dedicated on the basis of a foot street section. 5) Complete half-street public improvements shall be PI along the entire Alga Road and El Camino Real frontz These shall include dedication and construction of E return at the intersection to provide a free right t lane to be approved by the City Engineer. 1 6) The applicant shall execute a secured agreement to 1 one-fourth of the cost of a traffic signal, includir I1 -2- I) 0 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 : 17 18 19 20 21 22 23 24 channelization, at the intersection of Alga Road and Camino Real, or participate in the cost of traffic s. in accordance with the City ordinances at the time bl ing permits are issued. 7) Dedication of Alga Road and El Camino Real shall inc a waiver of direct access rights except at the drive? on the approved site development plan. 8) The median shall be constructed along the entire El Camino Real frontage. The median may be constructed 3 phases to ensure that all access points along El C Real shall be right turn in-right turn out, expectin street A (between the commercial area and the four-p area). A fully activated traffic signal shall be co structed at the intersection of stree "A" and El Cam Real in conjunction with the construction of the com mercial area. 9) Street lighting along El Camino Real shall be the mi bell type. 10) A detailed landscape and irrigation plan shall be su mitted to the Planning Department and shall be appro by the Parks and Recreation Director prior to issuan a grading permit. This plan shall incorporate accep drought resistant plant materials and acceptable wat conserving irrigation systems. All improvements sha be installed prior to final occupancy. 11) ,.Sidewalk alignment as shown is not approved. Sidewa to City standards shall be installed to the satisfac of the City Engineer. 12) All requirements and recommendations found under mitigation measures, pages 39, 40, 41 of the Archaec Evaluation, shall be specifically followed: 13) If, during the accomplishment of the activities out1 above, unexpected or additional information is uncoL different or additional measures may be required. I though unlikely, provision should be made for this eventuality. Because of this, the archaeologist whc attempts to achieve mitigation shall work closely wj the City Officials to ensure the application of adec and sensible mitigating measures. A 5' view obscuring fence shall be constructed alon northeast property boundary to the satisfaction of t Planning Director. At the discretion of the Plann Director this fence may be reduced in height or eli ated in certain areas if such fence would block the view from this development. A driveway access, as approved by the City Engineer shall be provided as a connection between the south access road and cul-de-sac on the fourplex site. The northerly portion of the site (separated by a p street) shall be developed as part of the apartment elopment. The site may be developed to include a C for rent or a single family house for use as a man? residence. If maintenance equipment is stored on--E it shall be contained in a fully closed structure. for development of this site shall be submitted to Planning Commission prior to issuance of building E The driveway for the structure on lot 16 shall be 1 designed to meet City standards for ingress/egress public streets. A uniform view obscuring fence shall be constructec the El Camino Real street frontage, at the propert: or top of slope where a slope is present, to the satisfaction of the Planning Director. The parking areas shall incorporate a minimum of 5' foot unobstructable clear space to provide for emergency access, to the satisfaction of the Fire Marshall. The parking spaces shown on the plan are not appro' Required parking shall be based on the provisions Title 21. The parking configuration as shown on Exhibit E, P is not approved. A revised parking plan shall be mitted to the Planning Department and reviewed by Planning Department, Fire Dept, and Engineering De ment. This revised plan will be subject to Planni Commission review and approval. The approved park plan shall become a part of the final Site DeVelOF Plan. Areas of concern regarding the currently pr plan include: 1. The drive thru bank facility. 2. Emergency access to structures. 3. Parking stalls backing directly into major ins 4- Location Of loading docks, and trash pick-up B egress isles. .4 . .. r ,* e e 1 2 3 4 5 6 25) Architectural elevations shall be submitted for the eastern portion of the property, and shall be apprc by the Planning Director prior to building permit i ance. 26) A comprehensive sign program shall be submitted to approved by the Planning Director prior to issuance building permits. The approved sign program shall become part of the final Site Development Plan. 27) Only low flush faucets and low volume flush toileta ~ will be utilized. 7 28) Only fluorescent lighting shall be utilized in kit( 8 9 and bathrooms.
