PLANNING COMMISSION RESOLUTION NO. 1375
RESOLUTION OF THE PLANNING COMMISSION OF THE CITY OF CARLSBAD, CALIFORNIA, RECOMMENDING APPROVAL OF A TRACT MAP FOR A FOUR-PLEX SITE
LOCATED ON 5.5 ACRE LOT ON THE EAST SIDE OF
EL CAMINO REAL BETWEEN ALGA ROAD AND S.D.G&E
EASEMENT.
CASE NO: CT 77-8 APPLICANT : ROLLY PULASKI & ASSOCIATES
WHEREAS, a vertified application for a certain property,
wit:
Situated in the State of California, County of San Diegc
Parcels 1, 2 and 3: All that portion of the west half
of the northeast quarter of Section 26, Township 12 sout Range 4 west, San Bernardino Meridian, in the County of San Diego, State of California, according to official plat thereof, and also listed in the County Assessor's
Book No. 215, Page 25, Parcel 49-55-511
has been filed with the City of Carlsbad and referred to the
Planning Commission; and
WHEREAS, said application constitutes a request as provi
by the "Carlsbad Municipal Code;" and
WHEREAS, the public hearing to consider the subject reqx
was held on June 22, 1977, at the time and in the place speci
in the public hearing notice, pursuant to the provisions of t
Carlsbad Municipal Code; and
WHEREAS, at said public hearing, upon hearing and consic
the testimony and arguments, if any, of all persons who desi]
to be heard, said Commission considered all factors relating
the Tentative Tract Map request (CT 77-8) and found the follc
facts and reasons to exist:
1) The proposed map is consistent with the General Plan beci

b) The increase in density over the 10 units per acre i
consistent because of the relatively flat terrain ar
the inclusion of public street to serve areas outsic
the subdivision.
2) The design or improvement of the proposed subdivision is
sistent with the General Plan because:
a) The project will provide orderly residential devel01 and
b) The project will not cause excessive expansion of PI
facilities and/or expense to the taxpayer; and
3) The site is physically suitable for th type of developmer
because :
a) The proposed development will not effect any unusua:
topographic or geologic features on the site;
b) No significant natural vegetation exists on the site
4) The site is physically suitable for the proposed density
development because:
a) Proposed dwelling units per acre do not exceed the 2
able maximum.
b) There are no significant physical features on the s:
that would hinder development as planned.
5) The design of the subdivision of the imposed improvement!
not likely to cause substantial environmental damage or s
stantially and unavoidable injure fish or wildlife or thc
habitat because:
a) A Negative Declaration has been issued for the propc

9) The subject application has complied with the requirement
the Carlsbad Environmental Protection Ordinance of 1972 5:
a) A Negative Declaration has been issued for the projc
based on the following findings:
1. The supplemental information supplied by the
applicant has adequately identified specific impacts within the general categories (Archae- ology and Traffic) pointed out in the initial Environmental Impact Report (EIR-283).
2. The supplemental information supplied by the applicant has adequately recommended measures
to mitigate the identified impacts. These
mitigation measures will be included as dev-
elopment conditions.
10) The proposed tentative tract map is consistent with appl
City Public Facilities Policies and Ordinances because:
a) At this time, all necessary public facilities, inclt
sewer service, and schools are available to serve tk subject project as proposed.
b) Leucadia County Water District in which the subject
is included has confirmed sewer availability.
NOW, THEREFORE, BE IT -SOLVED by the Planning Commissic ''(1 the City of Carlsbad as follows:

B) That in view of the findings heretofore made and consider the applicable law, the decision of the Planning Commissi
is to approve CT 77-8, subject to the following conditior
1) The approval is granted for the land described in tl:
application and any attachments thereto and as showr
the plot plan submitted labeled Exhibit C, dated 5/1

2) Park-in-lieu fees shall be paid to the City, to the
satisfaction of the Parks and Recreation Director, E
to approval of the final map.
3) Reciprocal easements for ingress and egress shall bc
granted across property lines traversed by drivewayE
parking areas, to the satisfaction of the City Engir

4) The public street shall not be blocked to restrict access to t
north.
5) Street "A" shall be dedicated and improved based on a 42 I widt
(half street plus 12' travel lane) .
6) El Camino Real shall be dedicated on the basis of a 126 foot s
section. The dan shall be constructed along the frontage c
El Camino Real.
7) A fully activated traffic signal, including channelization and
turn pocket, shall be constructed at the intersection of Stree
and El Camino Real.
8) The north end of Street "B" shall be constructed as a standard
de-sac with a driveway opening to the parcel to the north.
9) Prior to recordation of any final map for the subject properlq
a study of the noise levels of the project lots along El Camir
shall be made by an accoustical engineer experienced in noise
attenuation. Said study shall detemine if attenuation measw are necessary to bring noise levels within 65 dB (A) outdoors 45 dB (A) indoors. Said study shall recatmend such attenuatic
masures as deemed necessary and approved by the Planning Dire
Said masures shall be incorprated in the site design and bui
plans for said lots as a condition of the Specific Plan or add
as conditions to the Tentative Map approval.
Archaeology;
1) All requirmnts and recmuwndations found under mitigating rn
pages 39, 40, 41, of the Archaeology Evaluation, shall be spec
cally followed:
2) If, during the accomplishmt of the activities outlined above
unexpected or additional infornation is uncovered, different c
additional neasures may be required. Although unlikely, provj
should be made for this eventuality. Because of this, the arc
ologist who atterpts to achieve mitigation shall work closely
the City officials to insure the application of adequate and
sensible mitigating masures.
